The meeting was called to order at 12:00 Noon by Vice Mayor
Anderson with the following Councilmen present: Demsher, Gard,
Pugh, and Anderson. Absent: Mayor Fulton
Also present were Assistant City Manager Courtney, City Attorney
Murphy, Planning and Community Development Director Harris, and
City Clerk Brayton.
ORDINANCE - Calling a Special Municipal Bond Election
MOTION: Made by Councilman Pugh, seconded by Councilman Demsher
that full reading of Ordinance No. 1314 be waived, and that the City
Attorney be instructed to scan same. The Vote: Unanimous Ayes
MOTION: Made by Councilman Pugh, seconded by Councilman Demsher
that Ordinance No. 1314 be adopted, an ordinance calling a special
municipal bond election in the City of Redding for the purpose of sub-
mitting to the electors of said City the measure of incurring a bonded
indebtedness of said City for the acquisition, construction and com-
pletion of the following municipal improvement, to wit: electric
service facilities; declaring the estimated cost of said municipal
improvement, the amount of the principal of said indebtedness to be
incurred therefor, and the maximum rate of interest to be paid
thereon; making provision for the levy and collection of taxes; fixing
the date of said election and the manner of holding the same; estab-
lishing twenty-three election precincts and polling places for said
election and appointing election officers therefor; and providing for
notice thereof.
Voting was as follows:
Ayes: Councilmen - Demsher, Gard, Pugh, and Anderson
Noes: Councilmen - None
Absent: Councilmen - Fulton
Ordinance No. 1314 is on file in the office of the City Clerk.
USE PERMIT - UP -35-77 - Lewis McCaslin
A request from Lewis McCaslin for reconsideration of the denial of
Use Permit UP -35-77 was reviewed by Council. Mr•. McCaslin sub-
mitted petitions containing 38 signatures supporting his application
for a Use Permit. In his letter to Council he indicated he is prepared
to accept as a condition of the use permit that the plumbing in the
three duplexes be compatible with the use of sewers and to promise
that he will connect to a sewer line; if and when Redding sewer service
is extended to the 2100 block of Marlene Avenue.
In a discussion of this request, Councilman Demsher said that his
main concern was not the sewer problem, but the traffic that multiple
family development would create. It is his belief that the traffic prob-
lem that already exists in the vicinity of Mr. McCaslin's property must
be resolved before approval can be given for any new multiple -family
development.
Councilwoman Gard indicated that she had three concerns; i.e. , the
use of septic tanks; the fact that there is considerable vacant land in
the vicinity of the McCaslin property and a decision to approve
UP -35-77 pre -determines the dispostion of the vacant land; and the
aggravation of a traffic problem. Mrs. Gard said she would be
willing reconsider the matter at another public hearing.
Councilman Pugh said he favored the issuance of the Use Permit at
the last public hearing, although he does appreciate the concerns
expressed by Councilman Demsher and Councilwoman Gard. He
noted that the property owners who oppose the development were
aware of the zoning (County zoning was R-2) and no effort was made
to have a more restrictive zoning imposed. He acknowledged that
sewers could be a problem but noted that Mr. McCaslin has indicated
his willingness to connect to a sewer line when one is extended. He
said he doubts that the traffic generated by the three duplexes would
add substantially to the traffic problem. Mr. Pugh thinks the matter
should be reconsidered.
MOTION: Made by Councilman Demsher, seconded by. Councilwoman
Gard that a Public Hearing be set for 7:30 P.M. , May .2";. 1977 to re-
consider Use Permit UP -35-77 re Lewis McCaslin. The Vote:

APPEAL OF,USE PERMIT - UP -57-77 by Frank Giordano
Council was advised that Frank Giordano has withdrawn his Appeal of
Use Permit UP -57-77, and that the Public Hearing set for 7:30 P.M.
on April 18, 1977 will not be held.
ADJOURNMENT
There being no further business, at the hour of 12:10 P.M. , the Vice
Mayor declared the meeting adjourned.

IN TIME CITY OF REDDING FOR THE PURPOSE OF SUBMITTING TO
THE ELECTORS OF SAID CITY THE MEASURE OF INCURRING A
BONDED INDEBTEDNESS OF SAID CITY FOR THE ACQUISITION,
CONSTRUCTION AND COMPLETION OF THE FOLLOWING MUNICIPAL

CLARING THE ESTIMATED COST OF SAID MUNICIPAL IMPROVEMENT,
THE AMOUNT OF THE PRINCIPAL OF SAID INDEBTEDNESS TO BE
INCURRED THEREFOR, AND THE MAXIMUM RATE OF INTEREST
TO BE PAID THEREON; MAKING PROVISION FOR THE LEVY AND
COLLECTION OF TAXES; FIXING THE DATE OF SAID ELECTION
AND THE MANNER OF HOLDING THE SAME; ESTABLISHING TWENTY-
THREE ELECTION PRECINCTS AND POLLING PLACES FOR SAID
ELECTION AND APPOINTING ELECTION OFFICERS THEREFOR; AND
PROVIDING FOR NOTICE THEREOF
WHEREAS, the City Council (the "Council") of the
City of Redding (the "City"), by resolution duly passed and
adopted at a meeting of the Council duly and regularly held,
by affirmative vote of more than two-thirds of all its members,
did determine that the public interest and necessity demand
the acquisition, construction and completion of the municipal
improvement hereinafter mentioned, that the acquisition, con-
struction and completion of said municipal improvement is
necessary and convenient to carry out the objects, purposes

t and powers of the City, that the cost of..the acquisition,

construction and completion of said municipal improvement is
r.
and will be too great to be paid out of the ordinary annual
income and revenue of the City, that said municipal improve-
ment will require an expenditure greater than the amount al-
lowed therefor by the annual tax levy, and that the City should
incur a bonded indebtedness therefor, which resolution was duly
entered on the minutes of said meeting of the Council, and is
now on file and of record in the Clerk's office of said City;
NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN
AS FOLLOWS:
Section 1. A special municipal bond election shall
be and is hereby ordered and will be held in the City on Tues-
day, May 31, 1977, at which election shall be submitted to the
qualified electors of the City the question of incurring a
bonded indebtedness of the City,for the object and purpose

MEASURE (A): Shall the City of Redding
(Electric Ser- incur a bonded indebtedness
vice Facilities) in the principal amount of
$9,800,000 for the acquisi-
tion, construction and completion of the follow-
ing municipal improvement, to wit: Electric ser-
vice facilities, including transformers and switch-
es to be acquired and installed in a United States
Bureau of Reclamation owned substation, other modi-
fications to be made to said substation, transmis-
sion lines to be acquired and constructed between
said substation and city distribution facilities,
the existing privately-owned.electric distribution
system serving a recently annexed part of the city,
facilities for interconnecting existing city elec-
tric service facilities with the existing privately -
owned electric distribution facilities to be ac-
quired, and other works, property or structures
necessary or convenient for electric service for
the City?
The estimated cost of the municipal improvement set
forth in said measure is the sum of $9,800,000 and the amount
of the indebtedness proposed to be incurred for said municipal

improvement is the sum of $9,800,000. The esti.ma.ted cost

hereinabove stated of said municipal improvement includes
legal and all other fees incidental to or connected with the
authorization, issuance and
sale of
the
bonds evidencing the
indebtedness proposed to be
incurred
for
said municipal im-
provement and the costs of
printing
said
bonds and all other
costs and expenses incidental to or connected with the author-
ization, issuance and sale of said bonds.
Section 2. The Council does hereby submit to the
qualified electors of the City at said special municipal bond
election said measure set forth in Section 1 of this ordinance,
and designates and refers to said measure in the form of bal-
lot hereinafter prescribed for use at said election.
(a) Said special municipal bond election shall be
held and conducted, and the votes thereof canvassed, and the
returns thereof made, and the result thereof ascertained and
determined, as herein provided; and in all particulars not
prescribed by this ordinance, said election shall be held as
provided by law for the holding of municipal elections in
the City.
(b) All persons qualified to vote at municipal
elections in the City upon the date of the election herein
provided for shall be qualified to vote upon the measure sub-
mitted-at
ub-mitted at said special municipal bond election..
(c) The polls at the polling place hereinafter
designated shall be opened at 7:00 o'clock A.M. of said day
of election and shall be kept open continuously thereafter
until 7:00 o'clock P.M. of said day of election, when the
polls shall be closed (except as provided in Section 14301
of the Elections Code), and the election officers shall there -

upon proceed to canvass the ballots cast thereat.
(d) For the conduct of said special municipal bond
election, the City shall constitute twenty-three (23) special
bond election precincts, constituting in sum the entire area
of the City. Said special bond election precincts (compris-
ing, respectively, one or more Shasta County General Elec-
tion Precincts, as hereinafter noted) and the polling places
therein and the election officers appointed to conduct said
election thereat are set forth in Exhibit A attached 'hereto,
which is incorporated herein and made a part hereof.
(e). The ballots to be used at said special munici-
pal bond election shall be substantially in the following form,
to wit:

(f) Each. voter to vote for said measure hereby
submitted and for incurring said bonded indebtedness shall'
stamp a cross (+) in the blank space opposite the word "YES"
on the ballot to the right of said measure, and to vote against
said measure and against incurring said indebtedness shall
stamp a cross (+) in the blank space opposite the word "NO"
on the ballot to the right of said measure. On absent voter
ballots the cross (+) may be marked with pen or pencil.
(g) The returns of said election shall be made out
and signed by the election officers and shall be by them de-
posited with the City Clerk, together with the ballots cast
at said election; and the Council shall meet at its usual
meeting place and canvass said returns on Tuesday, the 7th
day of June, 1977 (the first Tuesday after said election) at
the hour of 12:00 o'clock Noon and declare the result of said
election.
Section 3. The Council proposes to issue and sell
bonds of the City for the object and purpose, but not exceed-
ing the amount, specified in said measure, if two-thirds of
the qualified electors voting on such measure at said special
municipal bond election shall vote in favor of said measure.
Said bonds shall be negotiable in form and of the
character known as serial, and shall bear interest at a rate
not to exceed eight per cent (8%) per annum, payable semi-
annually (except that interest for the first .year after the
date of said bonds may be made payable at or before the end
of said year). Provision is hereby made for the payment of
the principal of and interest on said bonds as follows: At
the time of making the general tax levy after incurring the
bonded indebtedness, and annually thereafter until the bonds

are paid or until there is a sum in the treasury set apart
for that purpose sufficient to meet all payments of princi-
pal and interest on the bonds as they become due, the Council
shall levy and collect a tax sufficient to pay the interest
on the bonds and such part of the principal as will become due
before the proceeds of a tax levied at the next general tax
levy will be available; provided, however, that if said bonds
Are authorized to be issued at said election, and it is ex-
pected that all or any part of said bonds will be sold at such
time that the principal of or interest on such bonds will be-
come due before the proceeds of a tax levied after such sale
would be available to pay such principal or interest, the
Council, at the time of fixing the annual tax levy, may levy
a tax in an amount clearly sufficient to pay that portion of
the principal of and interest on said bonds which it is ex-
pected will
become due
before the proceeds
of the next suc-
ceeding tax
levy.will

of the bonds is more than one year after the date of issuance,
the Council shall levy and collect annually a tax sufficient
to pay the interest as it falls due and to constitute a sink-
ing fund for the payment of the principal on or before maturity.
Such taxes shall be levied and collected as other City taxes
and shall be in addition to all.other taxes and shall be used
only for payment of the bonds and the interest thereon.
Section 4. The City Clerk of the City is hereby
directed, upon the passage and adoption of this ordinance, to
publish the same once a day for at least seven (7) days in the
Redding Record -Searchlight, a newspaper of general circulation
published at least six days a week in the City. No other notice
of the election hereby called need be given.

Section S. This ordinance shall be forthwith en-
tered upon the minutes of the Council and in the Ordinance
Book of'the City. This ordinance, being an ordinance calling
and ordering an election, shall take effect from and after
its final passage and approval.

in said minutes and Ordinance Book. That said ordinance has
not been amended, modified or rescinded since the date of its
passage and that the same is now in full force and effect.
