Fiscal Impact Storm Drain Maintenance funding in the amount of $562,427.07 was approved for this project for Fiscal Year 2022-23. The total project cost, including surveying, design, bidding, construction, field engineering, inspection, and contract administration, is $527,467.02. Alternative Action The City Council (Council) may choose not to accept the project as satisfactorily complete, and advise staff on how to proceed. Background/Analysis Northstate Earth and Water, Inc., has completed all items of work on the East Cypress Avenue Storm Drain Replacement Project as of July 21, 2023, which was within the contract time frame. Subsequently, the Public Works Department filed a notice of completion with the County. The project warranty period expires one year from the completion date of July 21, 2023. At its meeting of June 7, 2022, the Council awarded a construction contract to Northstate Earth and Water, Inc. for $322,472.07 and approved a $35,000 construction contingency fund. Also authorized was $85,000 for contract administration and construction inspection fees, $30,000 for project development costs, and the City Manager was authorized to approve additional increases in either the construction management or construction contingency amounts up to $15,000, for a total authorized project amount of $487,472.07. During construction, there were areas that required design changes and quantity adjustments due to several unknown utility conflicts discovered during excavation. On February 3, 2023, the City Engineer authorized a transfer of construction management funds in the amount of $25,000 to the projects contingency fund which increased the projects contingency to $60,000. Additionally, after project contingency funds were transferred, more design changes were required for further utility conflicts, including a PG&E gas line conflict, requiring additional funds to be added to the project. At its February 21, 2023, the Council approved an increase of $75,000 to the construction contingency budget. These increases to the projects contingency budget increased the total authorized amount to $562,427.07. There were six change orders in the amount of $129,994.95, leaving a balance of $5,005.05 in the contingency fund. The final project cost was $527,467.02. Additionally, this project upgraded the storm drain connections on the upstream side of the box culvert which incorporated the installation of a new catch basin and replaced some concrete sidewalk adjacent to the new catch basin. Environmental Review This activity is not a project as defined by the California Environmental Quality Act (CEQA), and no further action is required. On June 7, 2022, Council determined that the project is categorically exempt from environmental review under the CEQA Guidelines, pursuant to Section 15301(b) - Existing Facilities. Fiscal Impact The East Cypress Storm Drain Replacement Project (Project) is being funded by the Storm Drain Utility Fund. The proposed $75,000 increase will come from already budgeted funds in the Strom Drain Division. The total project cost, including the proposed increase, is expected to be just under $563,000. Alternative Action The City Council (Council) may choose to reject the request and provide alternative direction to staff. Background/Analysis On June 7, 2022, the Council awarded the construction contract for the project to Northstate Earth and Water, Inc. The project consists of replacing a deteriorating six-foot by two -feet -eight - inch storm drain box culvert that has reached the end of its useful life with a new pre -cast box culvert. This facility crosses East Cypress Avenue between Oxford Road and Bunker Street. This project also includes replacing asphalt concrete paving, curb, gutter, sidewalk, storm drainage inlets, and other miscellaneous items of work. During the course of construction, conditions in the field warranted changes to meet the original project's intent. These changes include unidentified water service conflicts, trench shoring, and compaction issues. The noted changes will result in the contract bid item exceeding the bid quantity. The additional work will also cause the project budget to exceed the awarded amounts. Staff has determined that the project qualifies as Categorically Exempt from environmental review under CEQA Guidelines Section 15301. The project has been reviewed for sensitive resources such as threatened or endangered species or their habitats, sensitive vegetation communities, and tribal cultural resources.
