SUBJECT: 4.8(a)--Office Lease at Shield Training Center
Recommendation
Approve and authorize the following actions:
(1) Approve the month-to-month lease with Shield Regional Training Consortium in the
amount of$241.50 per month for one office space located at 4300 Caterpillar Road for
the Fire Department's Battalion Chief of Training; and
(2) Authorize the Redding Fire Department's Chief to execute the lease and any other
documents to complete the transaction.
Fiscal Impact
The City of Redding Fire Department (RFD) can absarb this cost in its training budget. There
will be no fiscal impact from the lease cost of$241.50 per month or $2,898.00 per year.
Alternative Action
The City Council could choose not to approve the office space lease and provide alternative
direction to staff.
Background/Analysis
RFDs Fire Administration, housed at City I�all, is at maximum capacity far office spac�. Over
the past th.ree years, RFD has converted two storage areas within Fire Administration to office
space. How�ver, more room is needed to accommodate current staff..
The Battalion Chief of Training works from Fire Administration in a converted office. RFD
would like to relocate their office to the Shield Training facility to allow for better
interdepartmental training development. Shield Regional Training Consortium is an organization
where publie safety entities have formally joined forces to exeeute a vision to provide frequent
and affordable training courses for all publie safety organizations in the north state.
If the lease is approved, the office space will be available on October 3, 2023.

restraoms,utilifres, undesignated parking and janitr�rial services, as shown an the attached Exhibit"A"and
laeated at SHIELD REGIONAL TRRINING GONSORTIUM,4300 Gaterpiltar Road, in Redding, Caunty of
Shasta.
2. The term of this I�ase shall be month-ta-monfih commencing on October 1st. 2d23, with such rights of
termination as may be hereinafter expressly s�t forth.
3. �ITY OF REDDING or LESSOR may terminate this lease-any time effective trn or after Novemb�r 1,
2Q23, by giving notice at least thirty(3Q)days prior to the date when su�h terrrrination shall become
effeetive.
4. Rantal paymants shall be paid by CITY tJF REDDING,from legally available funds and subject to the
California Constitution, beginning on October 1, 2Q23. Renfi for the month wiBl be$241.50 due on
Oct�ber 1;2023(prior ta moving in)and shall continue in advance on the first dav�f each month
during said term as fallows:

6. LESSOR agrees that, prior to, the leased premises will be made ready far CITY OF REDDING"s

occupancy in full compliance with Exhibit"A", consisting of one(1) sheet titled, "Safety Training Center"
and in accordance with Exhibit"B", consisting of three(3) pages, titled"Delegated Short Form Lease
Specifications", which Exhibits"A"and"B"are by this reference incorporated herein.
7. Lessor shall furnish to CITY OF REDDING, during the lease term, at Lessor's sole cost,the following
services and utilities:
A. Janitorial services, including but not limited to, regular cleaning of office areas and restrooms, toilet
supplies and waste disposal.
B. All utilities except telephone.
8. During the lease term, LESSOR shall maintain the leased premises together with appurtenances, rights,
privileges, and easements belonging or appertaining thereto, in good repair and tenantable condition, except in
case of damage arising from the negligence of CITY OF REDDING 's agents, invitees or employees. CITY OF
REDDING is responsible for any damage beyond normal wear and tear.
9. LESSOR reserves the right to enter and inspect the leased premises, at reasonable times, and to make any
necessary repairs to the premises.
10. LESSOR agrees that CITY OF REDDING, keeping and performing the covenants and agreements herein
contained on the part of CITY OF REDDING to be kept and performed, shall at all times during the existence
of this lease, peaceably and quietly, have hold and enjoy the leased premises, without suit, trouble or
hindrance from LESSOR, or any person claiming under LESSOR.
11. In the event the leased premises or any essential part thereof shall be destroyed by fire or other casualty, this
lease, shall, in the case of total destruction of the leased premises, immediately terminate. In case of partial
destruction or damage CITY OF REDDING may elect to terminate by giving written notice setting forth the
date of termination to the LESSOR within fifteen (15)days after such fire or casualty, and no rent shall accrue
or be payable to the�ESSOR after such termination. In the event of any such destruction where the CITY OF
REDDING remains in possession of said premises, whether for the remainder of the term or temporarily
pending termination, the rental as herein provided shall be reduced by the ratio of the floor space CITY OF
REDDING is precluded from occupying to the total floor space of the leased premises.
12. Rental payable hereunder for any period of time less than that for which periodic rental is payable shall be
determined by prorating the rental due for the applicable period of occupancy.
13. To the e�ent authorized by any fire and extended coverage insurance issued to LESSOR on the herein
demised premises, LESSOR releases CITY OF REDDING from liability for loss or damage covered by said
insurance and waives subrogation rights of the insurer unless caused by SHIELD REGIONAL TRAINING
CONSORTIUM, its subcontractors or employees.
CITY OF REDDING has elected to be self-insured against loss or damage to, or liability arising from, the
use of leased equipment. Under this system, loss or damage, if any, to the equipment shall be borne by
CITY OF REDDING.
14. During the performance of this lease,the LESSOR shall not deny benefits to any person on the basis of
religion, color, ethnic group identification, sex, age, physicai or mental disability, nor shall they discriminate
unlawfully against any employee or applicant for employment because of race, religion, color, national origin,
ancestry, physicai handicap, mental disability, medical condition, marital status, age, or sex. LESSOR shall
insure that the evaluation and treatment of employees and applicants for employment are free of such
discrimination.
LESSOR shall comply with the provisions of the Fair Employment and Housing Act(Government Code,
Section 12900 et seq.),the regulations promulgated thereunder(California Code of Regulations,Title 2,
Section 7285.0 et seq.), the provisions of Article 9.5, Chapter 1, Part 1, Division 3, Title 2 of the Government
Code(Government Code, Sections 11135-11139.5), and the regulations or standards adopted by the awarding
CITY OF REDDING agency to implement such article.

15. In the event the CITY OF REDDIPIG remains in possession of the premises after the expiration of
the lease term, or any extension thereof, this lease shali be automaticaily extended on a month-to-
month basis, subject to thirty (30) days termination by either party, and otherwise an the terms and
conditions herein specified, so far as applicable.
16. LESSOR hereby warrants and guarantees that the space leased to the CITY OF REDDING
will be operated and maintained free af hazard from Asbestos Containing Constructions
Materials.
17.The State of California supports the use of Disab(ed Veteran Business Enterprise(DVBE) and
California Certified Small Business {SB) and we encourage the LESSOR to utilize DVBE and
Certified SB to fulfill its lease obligation under this lease.
18. Except in emergency situations, the LESSOR shalt give not less than 24 hours' prior notice to
CITY C1F REDDING tenants when any pest control, remodeling, renovation, or repair work
affiecting the CITY OF REDDING occupied space may result in employee health concerns in the
work environment.
19. Pursuant to California Civil Code §1938, the LESSOR states that the leased premises:
� have not undergone an inspectian by a Certified Access Specialist {CASp). A CASp can
inspect the subject premises and determine whether the subject premises comply with all of the
applicable construction-related accessibility standards under California law. Although Califomia law
does not require a CASp inspection of the premises, the Lessor may not prohibit the tenant from
obtaining a CASp inspection of the premises for occupancy by the tenant, if requested by the
tenant. The parties shall mutually agree on the arrangements for the time and manner of the CASp
inspectian, the payment of the fee fo� the GASp inspection, and the cost of making any repairs
necessary to correct violatians of construction-related accessibility standards within the premises.

determined that the leased premises met all applicable construction-related accessibility standards
pursuant to California Civil Code§55.53 et seq. Lessor shall provide a copy of the current disability
access inspection certificate and any inspection report to the CITY UF REDDING within seven
days of the date of execution of the lease pursuant to subdivision (b).

determined that the leased premises did not meet all applicable construction-related accessibility
standards pursuant to Galifornia Civil Code §55.53 et seq." Lessar shall provide a copy of any
inspection report to the CtTY OF REDDING prior ta the execution of the Lease. If the report is not
provided to the CITY OF REDDING at least 48 hours prior to execution of the lease, the CITY OF
REDDING shall have the right to rescind the lease, based upon the information contained in the
report, for 72 hours after execution of the lease.
