SUBJECT: 4.11(a)--Accept Grant Funds, Approve the Hazard Mitigation Grant Program
Agreement with Centerville Community Services District and Adopt Resolution Appropriating
Funds
Recommendation
Authorize and approve the following actions:
(1) Accept grant funds from the Hazard Mitigation Grant Program (HMGP) on behalf of
Centerville Community Services District(CCSD);
(2) Approve the HMGP Project Agreement with CCSD for the Muletown Pump Station
Generator Project;
(3) Adopt Resolution approving and adopting the 12�' Amendment to City of Redding
Budget Resolution No. 2023-060 appropriating $350,000 for the Centerville Generator
Project, $225,000 in federal grant funding and $125,000 in local match funds from
Redding Electric Utility; and
(4) Find that the action is exempt from review under the California Environmental Quality
Act Guidelines,per Section 15061(b)(3)—Common Sense Exemption.
Fiscal Impact
The total requested project budget is $350,000. The Hazard Mitigation Grant Program (HMGP),
a federally funded grant requires a 25 percent local match for all projects. The Water Utility is
seeking to accept $225,000 in HMGP funding.
Redding Electric Utility (REU) has sufficient funds within its reserves to fulfill the local
matching requirement of an amount not to exceed $125,000.
Alternative Action
The City Council (Council) may choose not to accept the grant funds on behalf of Centerville
Community Services District (CCSD) or approve the agreement with CCSD for the HMGP
project. CCSD would not be able to meet the requirements to receive federal funding and the
project would not be designed and constructed.

Background/Analysis
The HMGP is intended to implement short-term and long-term solutions to mitigate post disaster
loss of life and property from future events. Funding for the program is managed by the
California Office of Emergency Services (CalOES), is available after a disaster is federally
declared, and is available on a competitive basis statewide for eligible mitigation activity.
The City has a Local Hazard Mitigation Plan (LHMP), which is a requirement for HMGP
funding applications. The LI�MP allowed the City of Redding (City) to apply for funding
through the HMGP, post Carr Fire, on behalf of CCSD. In September 2021, CaIOES was
notified of the HGMP funding approval for a CCSD emergency backup generator at the
Muletown Pump Station (Project). The agreement allows CCSD to receive federal funding and
the City will provide match funds and assist CCSD through the HMGP project process.
The City and CCSD have an emergency water intertie agreement that allows water to flow to
either utility/district in need. REU Power Plant is located adjacent to the intertie and would
benefit greatly in the event of an emergency where the City was unable to provide water and the
CCSD, through the intertie, could provide water. REU provided funds for the initial construction
of the Muletown Pump Station in the early 2000s. REU has agreed to provide funds not to
exceed$125,000 for the HMGP required match for the design and construction of the Project.
The agreement has been approved as to form by the City Attorney.
EnviNonmental Review
Staff has reviewed the action and determined that it is exempt from review under the California
Environmental Quality Act (CEQA) Guidelines, per Section 15061(b)(3) (Common Sense
Exemption). CEQA applies only to projects which have the potential for causing a significant
effect on the environment. The agreement will provide match funds for the project, but wi11 not
result in direct physical alteration of the environment. It can be seen with certainty that there is
no possibility that the activity may have a signi�cant effect on the environment. As the CEQA
lead agency, the CCSD will prepare all necessary technical studies and prepare the CEQA
compliance document for the HMGP project.

T IS AG E ENT is made at Redding, CalifQrnia, by and between the City of Redding a
Municipal Carporation{°'CITY'°), whose address is 777 Cypress Avel�ue, Redding CA 96001 and
the CENTERVILLE CQMMLTNITY SERVICES DISTRIGT, ("DISTRICT"},A California Water
District, whose address is 893Q Placer Road, Redding; CA 96001; for the Muletown Pu1np Station

ECITALS
A. The DISTRICT provides water service to residents in the Centerville Community
Services I�istrict as depicted in Exhibit A, attached and incorporated herein. The Muletown Pump
Station is an infegral part of the water system.
: The CITY and the DISTRICT have an emergency water intertie agreement, C-4942.
The District can provide water to the CITY in an erneTgency, and vice versa. The City's Redding
Electric Utility (REVj power plant is located ad�acent to the intertie on Clear Creek Road. The
power plant would benefit greatly in the eveilt of an emergency wllere the CITY was unable to
provide water and the DISTRICT through the intertie could supply water.
C. The federally funded Hazard Mitigation Grant Pr�gram (HMGP) is intended to

PRQJECT.

1. Ternaination: Th�s agreement shall terminate upon the earlier of: (i) At the time the
PR4JECT has been colnpleted and closed aut per E�ibit B; (ii) or Decernber 31,,
2025. CITY may terminate this agreement and be relieved of�ny payments should
the DISTRTCT fail to perforrn the requirements of Exhibit B or this agreement at the
time and in the manner herein provided.
2. Project Conditions; The DISTRICT and the CITY agree to follaw the project
canditions as requ�red by Exhibit B.
3. Proiect LTnderstandin�: The DISTRICT sha11 take the lead on the project and
becolne the point of cantact for Ca10ES and the HMGP. The DISTRICT wi11
camplete and submit quarterly reports as required. The CITY wi11 assist the
DISTRICT as needed to navigate t�ie HMGP prc�ce�s through project campletion.
DISTRICT will perform project approval and environmental documents, plans;
specifications and estirnates, prepare the cantract docu�nents, adVertise for award,
administer the canstniction contract, and perform a11 necessary requirements per
Exhibit B to campletion and close out of the FROJECT.
4. Reimbursernent: The DISTRICT agrees ta request reimbursement through the
GITY to CaIOES and the HMGP as described inExhibit B. CaIOES reimbursement
requests shall be subinitted quarterly along with the required quarterly reporting.
5. Indemnification: Each party agrees to be respansible for the acts a�d conduct of its
own agents, officers and emplayees, and any and all actions, clairns, damages,
demands,losses,disabilities,defense costs or liability of any kind or nature,including
attorney's fees, that may be asserted by any person or entity arising out of or in
connection with the performance of this agreement.
Each party shall defend, indemnify; and hold the other party, its officials, of�cers,
employees, agents, and volunteers, harmless from and against any and all liability,
loss, expenses (including reasonable attorney's fees), or claims for injury or damage
arising aut af the perfarmance of this agreament, but only in praportion to and to the
extent such liability, loss, expenses (including reasonable attorney°s fees), or claims
far injury or damage are caused by or result from negligent acts or omissions of fihe
indemnifying party, its officials, officers, employees, agents, subcantraetors, or
volunteers.
DISTRICT agrees to indeinnify, defend and save harmless the CITY, its officers,
agents and employees frorn any and all claims and losses accruing or resulting to any
and a11 contractors, subcontractars, suppliers;laborers; and any other person,firm, or
corporation fiirnishing or supplying wark services, materials, or supplies in
connection with the performance of this agreement, and from any and all claims and
losses accruing ar resulting to any person, firm or carporation who rnay be killed
injured ar damaged except to the extent that such death injury ar damages results
from sole or active negligence af CITY.

6. Disputes. If any action is commenced to enforce any of the terms or conditions
herein, ar ta enforce ccrllection of lnonies due pursuant to this Agreement, the
prevailing party shall be entitled to reasonable attorneys' fees and casts.
7. Date of A�reeinent: The effective date of this Agree�nent sliall be the date it is
signed by the second party tc� sign.

Dear Mr. Ghilarducci:
We approve and issue Hazard Mitigation Grant:Program(HMGP) funds for the City of Redding (sub-
recipient), HMGP DR-4382-131-3R, Redding Centerville Community Services District Generator
Mitigation:Project.
The total project cost is $300,000. As shown in the enclosed Obligation Report- Supplement 38 we
are obligating $225,000 for the 75 percent Federal share; the 25 percent non-Federal share is $75,000.
These funds are available in Smart:Link for immediate and eligible disbursements.

This HMGP project approval and obligation of funds are subject to the following conditions:
l. Scope of Work(SOW)—This project will require minor demolition work to modify the
existing motor eontrol eenter to aeeept the new automatie transfer switch. Additionally, the
existing generator J-Box (on the outside-west wall of the existing building) will be removed,
along with all exposed conduits and conductors. A cast-in-plaee eonerete support pad
(approximately 6 feet wide by 18 feet long and 8 to 12 inches deep) will be required for the
new generator. Approximately 10 feet of new conduit will be installed in a trench via open
trench method between the existing generator J-Box to the new generator; at least 24 inches
of imported gravel backfill will be used for cover. All proposed work and the construction
staging area will be on a previously graded site and paved parking area, both previously
disturbed areas. The project will affect less than one acre in area.

The project will not occur within a regulatory floodway or floodplain or near wetlands. As
such, no impacts on floodplains or wetlands are anticipated.
2. Project Completiion Date—The project completion date is August 4, 2023. Please inform the
sub-recipient that work completed after this date is not eligible for federal funding, and that
federal funds may be de-obligated for work completed outside the completion date when there
is no approved time extension.
3. Project Closeout—Within 120 days of project completion, all project funds must be
liquidated and final closeout documentation for the project must be submitted to FEMA.
Please note the project must comply with Code of Federal Regulations Title 2, Part 200
reporting requirements at the time of closeout.
4. Record of Environmental Consideration (REC)—This project has been determined to be
Categorically Excluded from the need to prepare either an Environmental Impact Statement or
Environmental Assessment in accordance with FEMA Instruction 108-1-1 and FEMA
Directive 108-1-1 as authorized by DHS Instruction Manual 023-01-001-01, Revision l.
Categorical Exclusion N18 (Federal Assistance for Construction or Installation of Structures,
Facilities, or Equipment to Ensure Continuity of Operations)has been applied. Particular
attention should be given to the project conditions before and during project implementation.
Failure to comply with these conditions may jeopardize federal assistance including funding.
Please reference the enclosed REC for further information.
5. Standard Conditions—This project approval is subject to the enclosed Standard Mitigation
Grant Program (HMGP) Conditions, amended August 2018. Please note that federal funds
may be de-obligated for work that does not comply with these conditions.

Comment The Centerville Community Services District(Subapplicant)proposes to install a standby generator
(approximately 350 kilowatts[kW])and automatic transfer switch(ATS)at the Muletown Pump Station
(MTPS)to provide a backup power supply and mitigate the risk of an outage at the MTPS,The MTPS is

Standard Mitigation Grant Program (HMGP) Conditions

The following list applies to Recipients and Subrecipients accepting HMGP funds from the Federal
Emergency Management Agency(FEMA)of the Department of Homeland Security(DHS):
1. Applicable Federal, State, and Local Laws and Regulations. The Recipient/Subrecipient must
comply with all applicable Federal, State, and Locallaws and regulations,regardless of whether they
are on this list or other project documents. DHS financial assistance Recipients and Subrecipients are
required to follow the provisions of the State HMGP Administrative Pian, applicable Hazard
Mitigation Assistance Uniform Guidance, and Uniform Administrative Requirements, Cost
Principies, and Audit Requirements for Federal Awards located in Title 2 of the Code of Federai
Regulations (CFR)Part 200, adopted by DHS in 2 CFR 3002.
2. Financial Management Systems. The Recipient and Subrecipient must maintain financiai
management systems to account for and track funds, as referenced in 2 CFR 200.302.
3. Match or Cost Share. Non-federal match or cost share must comply with 2 CFR 200306,the scope
of work(SOW), and any agreements among the Subrecipient,the Recipient, and FEMA.
4. Budget Changes. Unanticipated adjustments are permitted within the approved total cost. However,
if costs exceed the federal share,the Subrecipient must notify the Governor's Authorized
Representative(GAR) of overruns before implementation. The GAR shall submit a written request
for approval to FEMA Region IX. The subaward must continue to meet HMGP requirements,
including cost effeetiveness and eost share. Refer to 2 CFR 200.308 for additional information.
5. Real Property and Land. The acquisition,use, and disposition must comply with 2 CFR 200.311.
6. Equipment. The acquisition,use, and disposition must eomply with 2 CFR 200.313.
7. Supplies.Upon project completion,FEMA must be compensated for unused supplies, exceeding
$5,000(fair market value), and not needed for other federal programs. Refer to 2 CFR 200.314.
8. Procurement. Procurement procedures must be in conformance with 2 CFR 200.318-320.
9. Monitoring and Reporting Program Performance.The Reeipient and Subrecipient must submit
quarterly progress reports, as referenced in the 2 CFR 200.328 and State HMGP Administrative Plan.
10. Records Retenfion. In accordance with 2 CFR 200.333,financiaU programmatic records related to
expenditures must be maintained at least 3 years after the date of Recipient's final expenditure report.
11. Enforcement and Termination. If the Recipient or Subrecipient fails to comply with the award or
subaward terms,whether stated in a Federal statute or regulation,the State HMGP Administrative
Plan, subpplication,a notice of award,an assurance, or elsewhere,FEMA may talce one or more of
the actions outlined in 2 CFR 200.338,including tennination or partial termination of the award or
subaward outlined in 2 CFR 200.339.
12. Allowable Costs. Funds are to be used for allowable costs in compliance with 2 CFR 200.403,the
approved SOW, and any agreements among the Subrecipient,Recipient,and FEMA.

13. Non-Federal Audit. The Recipient and Subrecipient are responsible for obtaining audits in
accordance with the Single Audit Act of l 984,in compliance with 2 CFR 200.SO1.
14. Debarred and Suspended Parties. Recipients and Subrecipients are subject to the non-procurement
debarment and suspension regulations implementing Executive Orders 12549 and 12689, and 2 CFR
180. These regulations restrict federal�nancial assistance awards, subawards, and contracts with
parties that are debarred, suspended, or otherwise excluded from or ineligible for participation in the
federal assistance programs or activities.
15. Equipment Rates. Rates claimed for use of Subrecipient-owned equipment in excess of the FEMA-
approved rates must be approved under State guidelines issued by the State Comptroller's Office or
must be certified by the Recipient to include only those costs attributable to equipment usage less any
fixed overhead and/or profit.
16. Duplication of Funding between Public Assistance(PA) and HMGP. Funding for PA Section 406
and HMGP Section 404 are permitted on the same facility/location,but the activities identified under
each program must be distinct with separately accounted funds, At closeout, FEMA may adjust the
funding to ensure the Subreeipient was reimbursed for eligible work from only one funding source.
17. Historic Properties and Cultural Resources. In compliance with 2 CFR 800,if a potential historic
property or eultural resource is diseovered during construction,the Subreeipient must eease work in
the area and take all reasonable measures to avoid or minimize harm to the discovered
property/resource. During construction,the Subrecipient will monitor ground disturbance activity,
and if any potential archeological resources are discovered,will immediately cease work in that area,
and notify the Recipient and FEMA. Construction in the area may resume with FEMA's written
approval after FEMA's consultation,if applicable,with the State Historic Preservation Officer
(SHPO).
14. NEPA and Changes to the Scope of Work(SO�. To comply with the National Environmental
Policy Act(NEPA),and other Laws and Executive Orders,any change to the approved SOW shall be
re-evaluated before implementation. Construction associated with a SOW change,prior to FEMA
approval,may be ineligible for funding. Acceptance of federal funding requires environmental
permits and clearances in colnpliance with a11 appropriate federal, state and local laws, and failure to
comply may jeopardize funding.
