HomeMy WebLinkAbout _ 4.12(a)--Resolution amending City's Conflict of Interest Code CITY OF REDDING REPORT TO THE CITY COUNCIL Recommendation Adopt Resolution approving an amended Appendix A (Designated Positions) to the City of Redding’s Conflict of Interest Code, Redding Municipal Code Chapter 2.90 (Conflict of Interest for designated positions of the City), in compliance with the California Fair Political Practices Commission biennial review requirements. Fiscal Impact There is no fiscal impact to the General Fund resulting from this action to comply with Fair Political Practices Commission regulations. Alternative Action The City Council (Council) could choose to amend Appendix A and/or B in a different manner; or decline to adopt the Resolution and provide direction to staff. Background/Analysis Redding Municipal Code Chapter 2.90 – Conflict of Interest for Designated Positions of the City lists designated positions within City of Redding (City) departments and agencies, boards, commissions, and committees that make or participate in the making of governmental decisions. Government Code Section 87302 requires that employees in positions involved in making (and/or those who participate in making) decisions that may have a material effect on personal financial interest shall file applicable Statement(s) of Economic Interests. The Political Reform Act requires every local agency to review its conflict of interest code biennially to determine whether the code is accurate or if an amendment is necessary. Based on this review, it is recommended that the Conflict of Interest Code Appendix A, the list of designated positions, be amended. The City Clerk and City Attorney have completed a biennial review, and recommend that the attached resolution be adopted amending Appendix A to the Conflict of Interest Code to accurately reflect designated positions within the City’s jurisdiction. Environmental Review This is not a project defined under the California Environmental Quality Act, and no further action is required. (the “Act”), which contains provisions relating to conflicts of interest which potentially affect all officers, employees and consultants of the City of Redding (the “City”), and which requires all public agencies to adopt and promulgate a conflict of interest code; and WHEREAS, the City Council adopted a Conflict of Interest Code (the “Code”), which was last amended on September 18, 2018, in compliance with the Act; and WHEREAS, subsequent changed circumstances within the City have made it advisable and necessary to amend and update the Appendix to the City’s Code pursuant to Sections 87306 and 87307 of the Act; and WHEREAS, the potential penalties for violation of the provisions of the Act are substantial and may include criminal and civil liability, as well as equitable relief which could result in the City being restrained or prevented from acting in cases where the provisions of the Act may have been violated; and WHEREAS, Ordinance No. 2426, adopted on December 16, 2008, ordained that Redding Municipal Code Title 2, Chapter 2.90 - Conflict of Interest for Designated Positions of the City, Section 2.90.020, Appendix A and Appendix B, be periodically updated by resolution of the City Council and shall constitute the Conflict Interest Code of the City and for each agency for which the City serves as the Code Reviewing Body; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council that “Appendix A” of the City’s Conflict of Interest Code be amended, as attached and made a part hereof by reference, to accurately reflect designated positions and disclosure categories within the City’s jurisdiction. APPENDIX B LIST OF DISCLOSURE CATEGORIES SPECIFICATION SHEET REPORTABLE INVESTMENTS, INTERESTS IN REAL PROPERTY AND INCOME CONFLICT OF INTEREST CODE FOR THE CITY OF REDDING AND RELATED AGENCIES Disclosure Category 1 All investments and business positions in business entities, sources of income, and interests in real property in the City of Redding or property located within a two-mile radius of any property owned or used by the City of Redding or it’s related agencies, whether in the City or not. 2 Investments and business positions in business entities, and sources of income from entities providing supplies, services, equipment, or machinery of the type used by the designated employee's unit. 3 Investments and business positions in business entities, and income from sources engaged in construction, building, or material supply. 4 Investments and business positions in, and income from sources engaged in, the construction of public works projects. 5 All reportable interests in real property located in the City and located within or outside the City if within a two-mile radius of any open space or park property owned or used by the City.
