Fiscal Impact This action has no fiscal impact on the City of Redding (City) as the assignee will assume all terms, conditions, and obligations of the existing lease, including payments. Alternative Action The City Council may choose not to authorize the mayor to execute the Consent to Assignment and Assumption of Sublease (Consent to Assignment). The Consent to Assignment would not be approved and the assignment of the lease for the premises between the parties to the agreement will not move forward and the Lessee would need to find another entity to assume the lease. Background/Analysis The original lease (C-3078) was entered into between the City and Chiang Ping Chu (aka Peter Chu) on June 8, 2017, for the operation of Peter Chu's Skyroom. On June 21, 2022, Peter Chu exercised the option for a five-year extension of the lease agreement. On May 1'7, 2023, Peter Chu notified the Redding Regional Airport of his intent to assign the lease of the restaurant spaee at the airport to Yangda Pan,potential buyer of his business, Peter Chu's Skyroom. Report to Redding City Council July 12, 2023 Re: 4.2(a)--Consent to Assignment Page 2 Pursuant to the provision of the lease agreement, Peter Chu has requested in writing the City consent to assign the lease and a11 subsequent amendments to Yangda Pan, the proposed assignee. Mr. Pan has co-owned other Chinese restaurants, has been a chef for more than 10 years and is currently a chef in Sacramento. He plans to operate Peter Chu's Skyroom in the same general manner it is today. There are no remaining options to exercise in the contract, and as a result, the lease for the restaurant space at the Redding Regional Airport will most likely be awarded via a competitive bidding process prior to the expiration of the current lease agreement, September 2027. Environmental Review Staff has determined that the action is categorically exempt from review under the California Environmental Quality Act, pursuant to Section 15301 — Existing Facilities. Class 1 exemptions include the permitting, leasing, and operation of public or private structures, facilities, mechanical equipment, or topographical features that involve negligible or no expansion of existing or former use. The action will not result in expansion of use, as the existing restaurant facility will continue to operate as a restaurant and the lease area will not be expanded or enlarged. The lease area is located within a built environment, the Airport Terminal, and the action has no potential to have a significant effect on the environment. Council Priority/City Manager Goals • Economic Development — "Facilitate and become a catalyst for economic development in Redding to create jobs, retain current businesses and attract new ones, and encourage investment in the community." RECITALS WHEREAS, City of Redding and Lessee entered into Redding Municipal Airport Restaurant Lease Agreement and Permit for Commercial Activities at Redding Municipal Airport dated June 8, 2017 and the First Amendment to License and Permit for Commercial Activities by and between the City of Redding and Peter Chu's Skyroom,dated August 11,2020, to provide temporary fee abatement due to the COVID 19 pandemic, and Option Contract dated June 21, 2022 that City of Redding accepts Lessee intent to exercise the 5-year option in contract C-3078. NOW, THEREFORE, Lessee/Assignor and Assignee have requested City's consent to the Assignment and Assumption of Lease(C-3078)dated May 12, 2023, and the Parties agree as follows: 1.
