Fiscal Impact There will be no fiscal impact to the project as release of these retention funds will be used to pay subcontractors for work that was already completed. Retention is withheld from progress payments on all Public Works construction projects for numerous reasons, one of which being to cover claims that arise from underpayment to subcontractors. The release of these withheld funds will satisfy this condition. There have been no claims from subcontractors on this project. Alternative Action The City Council (Council) may choose not to reduce the retention to Tullis, Inc., and provide staff with alternate direction. Without this release, the City of Redding (City) would continue to withhold five percent retention on previous and forthcoming project progress payments until project completion which is currently unknown. This would cause Tullis, Inc., and its subcontractors, to continue carrying the burden of covering costs without compensation. Background/Analysis At its regular meeting on July 19, 2022, the Council awarded the construction contract for the Bechelli Lane Improvements Active Transportation Project (Project) to the low bidder, Tullis, Inc., in the amount of $9,463,617.46. Tullis, Inc., began work in August 2022, and was substantially complete in May 2023. As of the end of May 2023, remaining work included completing lane striping and marking, Report to Redding City Council June 9,2023 Re: 4.11(d)--Retention Reduction BS 5290 Bechelli Lane Imp (ATP)Proj Page 2 installation of signs, object markers, and the three-pole flashing beacon systems. As such, Tullis, Inc., has requested, in the attached email, a partial release of retention that would reduce monies withheld to two- and one-half percent. Pex Public Contract Code (PCC) section 9203, "at any time after 50 percent of the work has been completed, if the legislative body finds that satisfactory progress is being made, it may make any of the remaining progress payments in full for actual work completed." As 95 percent o�the contract has been completed to date, staff is requesting, in accordance with PCC to limit retention to two- and one-half percent and all other monies withheld be released to the contractor. Envir�onmental Review This action is not a project as defined by the California Environmental Quality Act (CEQA), and no further action is required. On July 19, 2022, Council found the Project to be categorically exempt froln review under the CEQA Guidelines, pursuant to Section 15301(c) — Existing Facilities. Fiscal Impact The Bechelli Lane Improvements (ATP) Project (Project) is being funded by multiple sources which consist of a grant in the amount of $6,740,000 from the State of California Active Transportation Program (ATP), $3,341,057 in Loca1 Street and Road funds, $500,000 in American Rescue Plan Act funding dedicated to storm drain improvements, $300,000 in Water funds, $423,'7'70 in Wastewater funds and$],023,'790 in Redding Electric LTtility funds. On January 24, 2022, the City Council (Council) accepted and appropriated ATP grant funds in the amount of $6,740,000 for construction costs related to the project. In addition, the report identified funding sources for the remaining funds that would be budgeted once the bids were opened and project costs fully understood. Additional Streets Division funds are needed to fund the project. All other revenue sources are included in the current fiscal year budget. Alternative Action The Council may choose to not award the bid for the Bechelli Lane Improvements ATP Project and provide staff with alternative direction. Without this project, much needed pedestrian and bicycle inobility and safety improvements will not be completed, and the project may not be completed. In addition, if this project is not awarded, the City of Redding (City) is at risk of losing nearly$7 million dollars in federal funding due to grant requirements for project delivery. Background/Analysis The Bechelli Lane Improvements Project is a planned active transportation improvement to provide continuous sidewalk and bicycle facilities, enhanced pedestrian crossings, and other similar improvements along Bechelli Lane from Cypress Avenue to the new Costco Development, in addition to improvements along Loma Vista Avenue between Bechelli Lane and Churn Creek Road. The improvements include Americans with Disabilities Act (ADA) compliant curb ramps, sidewalk gap completion, enhanced pedestrian crossings, buffered bike lanes, functional landscaping, corridor lighting, asphalt concrete cold milling and placement, micro-surfacing, and restriping, as is detailed on the plans. This project is incl�uded in the City's Active Transportation Plan and the Regional Transportation P1an. Attached is a tabulation of bids received and opened on June 14, 2021, for the Bechelli Lane Improvements (ATP) Project. The low bid in the amount of $9,463,617.46 was received from Tu11is, Inc., of Redding, California. The engineer's estimate was $8,649,000. Total project development costs for this project are estimated to be $1,095,000. Project development costs include engineering, surveying, right-of-way, environmental, and consultant services. The ARPA funding is dedicated to storm drain improvements and accounts for overage amounts not previously budgeted. Staff has reviewed the project and determined that the project is Categorically Exempt from review under the California Environmental Quality Act (CEQA) Guidelines, per Section 15301(c) - Existing Facilities. Class 1 exemptions include minor alteration of existing public or private structures, facilities, or topographical features involving negligible or no expansion of use. This includes the addition of bicycle lanes and bicycle facilities, sidewalk and pedestrian crossings, transit improvements, street trees, and other similar alterations that do not create additional automobile lanes. Th� proposed project will enhance the existing facility for pedestrians and bicyclists, but will not create additional vehicle capacity. The project has been reviewed for sensitive resources and wi11 not have a significant effect on biological or cultural resources sueh as threatened or endangered speeies or their habitats, sensitive vegetation communities, tribal lands, or tribal cultural resources. The project has no potential to have a significant e�feet on the environment.
