SUBJECT: 6.1--Public Hearing to consider Rezoning Application RZ-2022-02356, by the
City of Redding (City), and Ordinance amending the City's Zoning Ordinance regarding the
short-term rental ordinance Reddin M�unici al Code RMC Section 18.43.180).
Recommendation
Conduct a Public Hearing, and upon conclusion:
(1) Offer an Ordinance amending Redding M�unicipal Code Title 18, (Zoning), Chapter
18.43, (Standards for Specific Land Uses) by amending Section 18.43.180 (Short-Term
Rentals), for first reading by title only, waive the first reading;
(2) Direct the City Attorney to prepare and the City Clerk to publish a summary ordinance
according to law; and
(3) Find that adoption of the ordinance is, pursuant to 14 CCR 15378, exempt from
environmental review, because the passage of the proposed ordinance is not a project
accarding to the definition in the California Environmental Quality Act and, therefore, is
not subject to the provisions requiring environmental review.
Fiscal Impact
Adoption of the proposed revisions to the Short-Term Rental Ordinance (Ordinance) would
require hiring additional staff in the Planning and Code Enforcement Divisions to adequately
process and enforce short-term rental permits. Fees collected from issuing short-term rental
(STR)permits could offset some or all of the staf�ng expenses depending on the established fee.
Alternative Actzon
The City Council (Council) could choose to not offer the proposed ordinance for first reading
and the regulations pertaining to short-term rentals will remain as they exist currently. The
Council could also provide other direction to staff such as modifying the ordinance.

Background/Analysis
In the past year, the topic of short-term rentals has been considered by the Planning Commission
(Commission) and the Council numerous times. In addition, community input has been received
during public hearings, a community workshop, and a community-wide online survey. Below is
a timeline of these actions:
July 19, 2022
The Council received a status update regarding implementation of the City of Redding's (City)
ordinance. Public comment received at the meeting was mixed, with speakers both supporting
and opposing tighter regulations for STRs. Following this ineeting, the Council and staff
continued to receive community feedback regarding STRs, specifically vacation rentals.
Au�ust 2, 2022
The Council directed the City Attorney to return with an Interim Urgency Ordinance which
would have had the effect of prohibiting the submission and receipt of applications for vacation
rental permits.
August 16, 2022
The Council considered, but ultimately did not approve, the Interim Urgency Ordinance;
however, the consensus of the Council was that the ordinance should be reviewed and possibly
updated. The Council directed staff to return with recommendations for potential amendments to
the ordinance for its consideration.
October 18, 2022
The Council reviewed staff's suggested modi�cations to the ordinance and provided further
direction to staff to craft a revised ordinance. The ordinance revisions would then need to be
brought before the Commission, and then subseguently to the Council for consideration.
January 10, 2023
The Commission reviewed the ardinance and subsequently provided comments,
recommendations, and proposed approvals to submit to the Council for consideration. During the
Commission meeting, the concept of a committee to study this issue was vocalized.
February 21, 2023
The Council did not hold a public hearing or consider adoption of revisions to the ordinance, but
instead provided direction to staff to form a Director's ad-hoc committee consisting of City staff
and seek additional community input for the purpose of developing new recommended
modifications to the ordinance.
March 8 —March 26 2023
Staff developed a basic online survey asking for community feedback on topics ranging from
density limits, overall caps, parking requirements, and more. The survey ran for over two weeks
and over 500 surveys were completed by the community.
March 16, 2023
Staff held a public workshop to hear the community's input and answer qu�stions. The workshop
was held at the City Hall Community Room and was well attended.

Apri125, 2023
Based on the Council's direction from its February 21, 2023 meeting, a Director's ad-hoc
committee was formed and recommended changes to the ordinance were presented to the
Commission at its April 25, 2023 meeting. The Commission was largely supportive of staff's
recommended changes to the ordinance, and provided comments and recommendations for the
Council's consideration.
Listed below, the proposed ordinance revision appears first followed by the Commission's
recommendation and comments in italics, as they were provided to staff at the Apri1 25, 2023
Commission meeting.
Density
(1) Limit the number of rentals within a geographic area based on distance.
a. 500-foot radius of an existing permitted vacation rental.
b. At the discretion of the Director, reduction down to 300 feet separation may be
considered when there are natural buffers such as major arterials, rivers, and
creeks.
Planning Coininission suppo�ts this revision.
(2) Provide a cap of 400 vacation rental permits to be allowed at any one time.
Planning Comtnission suppo�ts this revision, albeit by a nar�ow margin of 4-3.
Vacatzon Rental Criteria
(3) Location
a. Prohibit on properties containing an accessory dwelling unit with a building permit
application submitted on or after January 1, 2020, in compliance with State law
governing accessory dwelling units.
b. Exempt vacation rentals in the Downtown Redding Specific Plan Core District from
the parking and density requirements.
Planning Commission supports thi.s �evision. Commissioner Mine� expressed concern regarding
a. above, noting that state law speci�cally prohibits accesso�y dwelling units (ADUs) built afteN
Janua�y 1, 2020,from being used as STRs, but doesn't actually prohibit prope�ties with ADUs
from having STRs. The Commission discussed, but ultimately a majority of the Co�n�nissioners
supported keeping staff�'s recommended language.
(4) Owner Criteria - Must be a "natural person," trustee of a living trust, or limited liability
company.
Planning Commission was conce�ned the oNiginal language Nequiring the owner to be a "natuv�al
person," trustee of a living tr•u.rt, o� limited liability company was too narrow, and perhaps
unintentionally left out other pa�tne�^ships or company foNmations that would be bene�cial to
STR owne�s and operators. The�efore, .staff has revised this language to simply state that "any
natur^al person signing an application on behalf of an owner shall have legal authority to bind
the owne�."

(5) Permit Criteria
a. Require site manager information to be kept current at all times.
b. Revise the maximum occupants per bedroom from two adults to two persons.
c. Limit the occupancy to 16 persons.
d. Require an inspection by City staff prior to issuance of the permit.
e. Require a log of vehicle information including make, model, color and license
plates of all tenant vehicles.
£ Reduce site manager's response time from 60 minutes to 45 minutes.
g. When applying, the applicant must state the number of on-site parking spaces are
available to tenants,but in no case shall it be less than two on-site spaces.
h. Parking in excess of the stated number of on-site parking is not permitted.
i. Tenants are not permitted to park on the street.
j. All advertisements shall include the number of permissible parking spaces.
k. All required parking spaces shall reinain accessible and available to tenants at all
times during the rental periods.
1. Notification of application shall be sent to property owners within 600 feet of the
applicant's property.
m. The appeal period of a decision on vacation rental applications is 15 days.

because the Commissione�s conside� it an unnecessary complication and burden on STR
ope�ators and site nzanagers. Staff, however;feel this will be �elatively si�ple to implement, and
it will help enforce the parking standa�ds of the ordinance, therefore, the language has remained
as presented.
Hosted Homestay Criteria
(6) The floor plan documenting which rooms are to be rented is required.
(7) An affidavit is reguired to be signed on an annual basis.
(8) Wi11 expire twelve (12) months from issuance and is subject to a requirement for renewal.
(9) The owner shall be the applicant. Other than for purposes of daily routines, the applicant
must occupy the residence at all times when rooms are being rented.
(10) No owner shall cook, prepare, or serve for consumption, food of any kind for
consumption by the short-term-rental tenant.
Planning Cominission supports revisions 6 through 10.
Suspension and Terminatzon
(11) Language regarding suspension and termination has been added.

Legal Non-Conforming Uses
(12) Language has been added to address grandfathering under th� existing Non-Conforming
Regulations of the Zoning Code including allowances for temporary hardship and long-
term rental.

Planning Commission suppo�ts this revision. The�e was some discussion regarding the
tempo�ary ha�dship and long-term rental allowances, and staf'f has revised this language to
cla�ify the intent.
As previously noted to the Council, should the proposed changes to the ordinance be adopted,
additional staff resources would be necessary to process permit applications and adequately
enforce those permits. Specifically, if the required notification area to neighbors is increased
from 300 feet to 600 feet, this could be a significant time commitment for staff. Additionally,
increased enforcement and development of tools such as a short-term rental web portal with
centralized information for the public, for example, will require additional staff time and
resources. Increasing the annual permit application fee (currently $1,169) could assist in
providing the necessary funds to support additional staffing. At this point, it is estimated that one
additional Planning position and one additional Code Enforcement position is necessary. Staff
will return to the Council with a proposal for an adjusted fee and prepare an accompanying
budget resolution requesting and justifying additional staffing resources for consideration and
approval.
Environmental Determination
The passage of the proposed ordinance is not a project according to the definition in the
California Environmental Quality Act and, therefore, is not subject to the provisions requiring
environmental review. No further actions are necessary.
Council Priority/City Manager Goals

AN ORDINANCE OF THE CITY OF REDDING AMENDING TITLE 18
(ZONING), CHAPTER 18.43 (STANDARDS FOR SPECIFIC LAND USES)
BY AMENDING SECTION 18.43.180 (SHORT TERM RENTALS),
THEREBY MAKING CHANGES TO THE STANDARDS FOR
REGULATION OF SHORT-TERM RENTALS
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS:
Section L Title 18 (Zoning), Chapter 18.43 (Standards for Specific Land Uses),
Section 18.43.180 is amended to read in its entirety as follows:
18.43180 Short-Term Rentals
A. The purpose of this Section is to establish an appropriate permitting process and standards
for Short-Term Rental of dwelling units throughout the City;to provide a visitor experience
and accommodation as an alternative to the typical hotel, motel, and bed and breakfast
accommodations customarily permitted in the City; to minimize potential negative
secondary effects of Short-Term Rental use on surrounding residential neighborhoods; to
retain the character of the neighborhoods in which any such use occurs; and ensure the
payment of required transient occupancy taxes.
B. Types of Short-Term Rentals. For purposes of this Section, the following Short-Term
Rental facilities are established:
l. Hosted Homestay. An owner-occupied "Dwelling Unit," as defined by Section
18.61.020 under"Residential Structure Types"with more than one habitable room,
excluding apartment units and duplexes, where, for compensation, individ�ual
overnight room accommodations are provided for a period of less than thirty (30)
days.
2. Vacation Rental. An entire "Dwelling Unit," as defined by Section 18.61.020
under"Residential Structure Types" and excluding apartment units and duplexes,
where, for compensation, overnight accommodations are provided �or a period of
less than thirty(30)days and the owner may or may not reside within the dwelling
unit for the term of the rental.
C. Short-Term Rental Permit Requirements. No person shall use, advertise, or market for
use, any dwelling unit on any parcel in any zoning district for Short-Term Rental purposes
without first obtaining approval as required by this Section. The following approval process
is established:
1. Hosted Homestay: This use is permitted within all zoning districts subject to
obtaining a Zoning Clearance from the Director and providing an affidavit
certifying that the owner understands, agrees to, and is in compliance with the
requirements of this Section. Applicants may be required to provide a site plan or
other information determined necessary by the Director to determine compliance
with this Section and sha11 pay an application fee as may be established by
resolution of the City Council. Permits for Hosted Homestays shall expire twelve
(12) months from issuance and are subject to a requirement for renewal in
accordance with this Section.
2. Vacation Rental: This use is permitted within all zoning districts subject to
obtaining a Site Development Permit issued by the Director in accordance with the
provisions of Chapter 1$.11, Common Procedures and Chapter 18.13, Site
Development Permits of this Code, except that Site Development Permits for
Vacation Rentals shall expire twelve (12) months from issuance and are subject to
a requirement for renewal in accordance with this Section.
D. Districts in Which Permitted.The regulations of this chapter apply to Short-Term Rentals
in all zoning districts.
E. General Requirements - Hosted Homestay.
1. No more than one dwelling unit on a lot may be used at any one time.
2. A maximum of two rooms may be available for rent at any time. A floor plan sha11
be submitted with the affidavit indicating the rooms for rent.
3. Occupancy shall be limited to a maximum of two persons per rented room. Room
rental shall be limited to a maximum of 180 rental days per calendar year.
4. The owner shall be the applicant, and other than for purposes of daily routines, the
applicant must occupy the residence at all times when rooms are being provided for
rent.
5. At the time of permit renewal, the property owner shall attest they understand and
agree to the Hosted IHomestay requirements by signing the Hosted Homestay
Affidavit available at the Development Services Department and any payment due
must be remitted.
6. Except as set forth in Section ]8.43.060 as it relates to licensed bed and breakfast
inns, no owner shall cook, prepare or serve for consumption food of any kind for
consumption by the Short-Term-Renta] tenant.
7. The applicant shall state in the application the number of on-site parking spaces
available to tenants, but in no case shall it be less than two on-site spaees. Short-
Term-Rental tenant parking spaces shall be within the primary driveway or other
on-site location. No tenant parking in excess of this number of on-site parking
spaces is permitted. No tenant is permitted to park on the street. External changes
to a property such as converting significant areas of front yard landscape for
purposes of ineeting parking requirements is not allowed.
8. All required on-site parking spaces (including garage parking if identified at time
of approval) sha11 be accessible and available to Short-Term-Rental tenants at all
times during the rental periods.
9. Short-Term Rentals shall meet all applicable building,health,fire and related safety
codes at all times, including provision of working smoke and carbon monoxide
detectors.
10. The applicant shall post emergency evacuation instructions and "house policies"
within each Short-Term-Rental tenant bedroom. The house policies shall be
included in the rental agreement, and shall be enforced by the applicant. At a
minimum, the house policies should:
a. Reinforce the City of Redding's Noise Standards (RMC Section 18.40.100)
by establishing outdoor "quiet hours" between 10:00 p.m. and 7:00 a.m. to
minimize disturbance to neighboring residences. Outdoor activities are
prohibited during "quiet hours."
b. Require that Short-Term-Rental tenant vehicles be parked on the premises,
not the street in compliance with this Section.
1 l. The property shall not be used to host non-applicant related weddings, parties, and
other similar events.
12. On-site advertising signs or other displays indicating that the residence is being
utilized as a Short-Term Rental are prohibited.
13. No person shall advertise a Short-Term Rental on any media platform when such
advertisement or notice contains an inaccurate or misleading statement of the
reguirements of, or indicate amenities not allowed by the Redding Municipal Code
including the number of parking spaces.
14. All advertisements shall include the number of permissible parking spaces.
15. A City business license shall be obtained and transient occupancy taxes paid in
aeeordance with Chapter 4.12 as required. All advertising for any Short-Term
Rental shall include the City of Redding transient occupancy tax number and the
City of Redding business lieense number assigned to the applicant. With submittal
of transient occupancy taxes, the applicant sha11 also submit a statement indicating
the number o� Short-Term-Rental tenant stays, and the number of Short-Term-
Rental tenants for the reporting period.
16. The permit is not transferrable to a subsequent property owner or to another
property.
17. This ordinance shall not be construed as waiving or otherwise impacting the rights
and obligations of any individual, group, or the members of any homeowner's
association, as defined, to comply with or enforce CC&R's and no permit shall be
issued when it is demonstrated by substantial evidence that issuance of a permit
will be in contradiction to any recorded CC&R's or other record providing record
notice of a restriction on the use of the property.
F. General Requirements -Vacation Rentals.
1. With the exception of items 1 through 461isted in Section 18.43.180(E) above, the
General Requirements provisions for Hosted Homestays shall apply to Vacation
Rentals.
2. The following additional provisions shall also be applicable to Vacation Rentals
which may be supplemented by requirements established by the Director with
approval of the required Site Development Permit as necessary to maintain
compatibility of the use with the surrounding properties.
a. A Vacation Rental shall not be permitted on properties as follows:
l. Containing an Accessory Dwelling Unit with a building permit
application submitted on or after January 1,2020 in compliance with
Government Code Section 65852.2, as may be amended from time
to time; or
2. Within a five hundred (500) foot radius of an existing permitted
Vacation Rental except that, at the discretion of the Director or
appellate body as the case may be,within a three hundred(300) foot
radius of an existing Vacation Rental when there is a buffer such as
a major arterial, rail right-of-way, flood control channel or stream
corridor between the Vacation Rental units.
b. The total number of Vacation Rentals in the City shall not exceed four
hundred(400)rentals at any one time.
c. The owner sha11 be the applicant and any natural person signing an
application on behalf of an owner shall have legal authority to bind the
owner.
d. A Vacation Rental sha11 not be rented to multiple separate parties
concurrently.
e. The applicant shall keep on file with the City the name, telephone number,
and email address of a local contact person who shall be responsible for
responding to questions or concerns regarding the operation of the Vacation
Rental. This information shall be posted in a conspicuous location within
the Vacation Rental dwelling. The local contact person shall be available
twenty-four hours a day to accept telephone calls and respond physically to
the Vacation Rental within forty-five (45)minutes, if necessary. The name
and contact information of the local contact person will be made available
to the public. The contact information shall be kept current at all times.
£ Occupancy shall be limited to a maximum of two (2) persons per rented
room.
g. The maximum number of persons on the property at any time shall be
limited to siYteen(16)persons.
h. Prior to issuance of a permit, a physical inspection of the dwelling unit and
property shall be conducted by City staff.
i. Each operator shall maintain a log of each Short-Term-Rental tenant's
vehicle(s). The log shall minimally consist of the rental period, the license
plate, make, model, and color for each vehicle. The log shall be made
available at any time upon request by the City.
j. The requirements listed in Subdivisions E(7), E(8), E(14), and F(2)(a)(2)
shall not apply to a Vacation Rental located within Downtown Redding
Specific Plan Core District. Notwithstanding Subdivision B(2), an
apartment unit located in the Downtown Redding Specific Plan Core
District may be permitted as a Short-Term Rental.
G. Application Required.
l. Where a Site Development Permit is required by this Section, applicants for a
Short-Term Rental use shall pay the application fee established by resolution of the
City Council and apply for a permit in accordance with the provisions of Chapter
18.11 (Common Procedures),except that notices of the Vacation Rental application
shall be sent to all owners of real property within six hundred (600) feet of the
applicant's property for a fifteen(15) calendar-day notification period.
2. In making a determination to approve, conditionally approve, or deny any
application, including an application for renewal, for a Hosted Homestay or
Vacation Rental, the Director, or appellate body as the case may be, may also
consider any factor pertinent to the health, safety and wel�are of the immediate
neighborhood or public generally including, but not limited to, ability to comply
with the provisions set forth in this Section, evidence of operation in violation with
this Section, complaints of neighbors, code enforcement activity, timeliness of
business permit renewal, timeliness or non-payment of transient occupancy tax,
proxiinity of the property to group homes, residential care facilities, and other
neighborhood and site characteristics.
3. Appeal of any determination to approve or deny any application, including an
application�or renewal, shall be in accordance with Section 18.1 L090.
H. Suspension and Termination.
L The Director, or appellate body, shall apply the criteria set forth in Section
18.43.180(G)(2)in determining whether any permit issued pursuant to this Section
shall be suspended or terminated.Notice shall be provided to the applicant pursuant
to the procedure set forth in Section 18.11.060.
2. Appeal of the suspension or termination by the Director of a Vacation Rental Permit
shall be in accordance with the requirements of Section 18.11.090.
3. Appeal of the suspension or termination by the Director of a Hosted Homestay
Permit must be made to the Planning Commission within ten(10) calendar days of
service of the Director's decision, and appeal of the Planning Commission decision
to the City Council must be made within ten (10) calendar days of service of the
Planning Commission's determination. Decisions of the City Council are final, and
all challenging a decision of the Director must exhaust all remedies set forth in this
Section 18.43180(H)(3) prior to bringing a challenge pursuant to Code of Civil
Procedure section 1094.5.
4. Service shall be deemed effective upon the earliest of: 1) announcement by the
approving or appellate body of the decision in the presence of the appellant; 2)
personal service on the appellant of a written notice of decision; or 3) deposit of a
written notice of decision in the United States Mai1.
L Legal Non-Conforming Uses
1. Continuation and abandonment of short term rentals which are legal
nonconforming uses shall not be governed by Section 18.46.020. The sole
allowances for continuation of a legal non-conforming use as a short term rental are
by timely renewal of a valid and current short term rental permit or as follows:
a. A temporary hardship allowance of not more than six (6) months may be
granted by the Director of Development services, or designee, if: 1) a
medical condition of the permittee, spouse, domestic partner, or immediate
family member jeopardizes the ability of the owner to operate the Short-
Term Rental; or 2) the death of a spouse, domestic partner, or immediate
family member of the permittee jeopardizes the ability of the permittee to
operate the Short-Term Rental.
b. A long-term rental allowance may be granted by the Director of
Development Services, or designee, if the permittee provides proof of a
long-term lease of twelve (12) months or longer prior to the expiration of
the Short-Term Rental permit. This exemption may be repeated if the
conditions set forth in this subsection are met. The length of an exemption
shall not exceed the term o�the lease or twenty-four(24)months,whichever
is shorter. If an allowance is granted pursuant to this subdivision, the
existing permit shall terminate per its term. However, the Director of
Development Services shall consider said permit to be "active" solely for
the purpose of allowing the permittee to reapply for a permit after the
allowance granted pursuant to this subdivision has lapsed.
J. Enforcement and Remedies. Enforcement of the provisions of this Section incl�ude the
civil and equitable remedies as permitted by state law, the issuance of a citation and fine,
or other legal remedy as provided by Chapter 1.12 through 1.15, inclusive, of the Redding
Municipal Code. Upon notification by the City, any Short-Term Rental operating in
violation of the requirements of this Section must terminate operations immediately.
Further, a Site Development Permit issued under the authority of this Section may be
revoked in accordance with the procedures established in Chapter 18.11 (Common
Procedures).
Section 2. The Council hereby finds and determines that the enactment of this Ordinance
is exempt from review pursuant to the California Environmental Quality Act(Public Resources Code
section 21000 et seq.)("CEQA")because it has no potential to result in either a direct physical change
in the environment or a reasonably foreseeable indirect physical change in the environment. This
Ordinance is exempt from CEQA pursuant to the"common sense"exemption(14 CCR 15061(b)(3)),
as it can be seen with certainty that there is no possibility that the adoption of the Ordinance will have
a significant effect on the environment.
Section 3. Severability. If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid,the remainder of the Ordinance and the application of such
provision will remain in effect to the extent permitted by law.
Section 4. This Ordinance shall take effect thirry(30) calendar days after the date of its
adoption, and the City Clerk shall certify to the adoption thereof and cause publication according to
law.

and breakfast accommodations customarily permitted in the City; to minimize potential
negative secondary effects of ������-�,8�-�,T,��hs��•t-I"�rrr� R�n:t�l use on surrounding
residential neighborhoods; to retain the character of the neighborhoods in which any such
use occurs; and ensure the payment of required transient occupancy taxes.
B. Types of Short-Term Rentals. For purposes of this Section, the following Short-Term
Rental facilities are established:

C. Short-Term Rental Permit Requirements. No person shall use, advertise, or market for

L Hosted Homestay: This use is permitted within all zoning districts subject to
obtaining a Zoning Clearance from the Director and providing an affidavit
certifying that the owner understands-�� agrees to, �z�d�� in ����alian�e�i�h the
requirements of this Section. Applicants may be required to provide a site plan or
other information determined necessary by the Director to determine compliance
with this Section and shall pay an application fee as may be established by

obt���in�Site Development Permit issued by the Director in accordance with the
provisions of Chapter 1811, Common Procedures and Chapter 18.13, Site
Development Permits of this Code, except that ���� �����'�����4 ���°���s�Sit�
�ev�lc��rri���� ����i�s for Vacation Rentals shall expire twelve 12 months from

D. Districts in Which Permitted. The regulations of this chapter apply to ������
�+���Sh�rt�T�z���R�r��a1s in all zoning districts.
E. General Requirements - Hosted Homestay.
1. No more than one dwelling unit on a lot may be used at any one time-����t-��

2. A maximum of two rooms may be available for rent at any time. �1 f1c��a1 l�� s11��1

3. Occupancy shall be limited to a maximum of two ��� �� rs�a�� per rented room.
Room rental shall be limited to a maximum of 180 rental days per calendar year.

being provided for rent.

purposes of ineeting parking requirements is not allowed.

�9. Short-Term Rentals shall meet all applicable building,health,fire and related safety
codes at all times, including provision of working smoke and carbon monoxide
detectors.
��0, The ���t��licarat shall post emergency evacuation instructions and "house
� policies" within each�-���c�rt-Te�-��-I�����1�������bedroom. The house policies
shall be included in the rental agreement, and sha11 be enforced by the
���a�7�lic�l�t. At a minimum, the house policies should:
a. Reinforce the City of Redding's Noise Standards (RMC Section 18.40.100)
by establishing outdoor "quiet hours" between 10:00 p.m. and 7:00 a.m. to
minimize disturbance to neighboring residences. Outdoor activities are
prohibited during "quiet hours."
b. Require that ���Sl�c�rtmT�rzr��IZ�r�t�l t��ailt vehicles be parked on the
premises, not the street in compliance with this Section.
�-11, The property shall not be used to host non-��-������ li�t related weddings,parties,
� and other similar events.
�22, On-site advertising signs or other displays indicating that the residence is being
utilized as a ��°°����¢���° ���*��, �;�S�c�r�-T�z-xrx IZ�r�tal �r��prohibited.

a 1 S, A City business license shall be obtained and transient occupancy taxes paid in
� accordance with Chapter 4.12 as required. All advertising for any ����
��--�Sh�rt-'T'��� IZ�z�t�1 shall include the City of Redding transient occupancy tax
number and the City of Redding business license number assigned to the ������m
applicant. With submittal of transient occupancy taxes, the�r�a��li��r�� shall
also submit a stateinent indicating the number of�t�Shc�rt-T'�rrrl-I2�r�t�� t�n�nt
st�, and the number of����c�rt-'['�rrn-EZen��l t�n���ts for the reporting period.
�-1F�, The permit is not transferrable to a subsequent property owner or to another
property.

and obligations of any individual, group, or the members of any homeowner's

F. General Requirements -Vacation Rentals.
1. With the exception of items 1 through 46 listed in Section 18.43.180(E) above, the
General Requirements provisions for Hosted I�omestays shall apply to Vacation
Rentals.
2. The following additional provisions shall also be applicable to Vacation Rentals
which may be supplemented by requirements established by the Director with
approval of the required Site Development Permit as necessary to maintain
compatibility of the use with the surrounding properties.

SUBJECT: 4(b)2-- Rezoning Application RZ-2022-02356, by the City of Redding, to
consider an amendment to the City's Zoning Ordinance pertaining to modifications to the short-

Recommendation
Conduct a public hearing, and upon conclusion, recommend that the City Council adopt an
Ordinance amending Title 18, Zoning, of the Redding Municipal Code as it pertains to short term
rentals.
Background/Analysis
The Short-Term Rental Ordinance has been before Planning Commission and Council numerous
times in the past year. In addition, community input has been received during public hearings, a
community workshop, and a community-wide online survey. Below is a timeline of these
actions:
July 19, 2022 — The Council received a status update regarding implementation of the City
of Redding's (City) ordinance. Public comment received at the meeting
was mixed, with speakers both supporting and opposing tighter regulations
for short-term rentals. Following this meeting, the Council and staff
continued to receive community feedback regarding short-term rentals,
specifically vacation rentals.
August 2, 2022 — The Council directed the City Attorney to return with an Interim Urgency
Ordinance which would have had the effect of prohibiting the submission
and receipt of applications for vacation rental permits.
August 16, 2022 — The Council considered, but ultimately did not approve, the Interim
Urgency Ordinance; however, the consensus of the Council was the
ordinance should be reviewed and possibly updated. The Council directed
staff to return with recommendations for potential amendments to the
ordinance for its consideration.

October 18, 2022 — The Council reviewed staff's suggested modifications to the ordinance and
provided further direction to staff to craft a revised ordinance. The
ordinance revisions would then need to be brought before Planning
Commission (Commission), and then subsequently to the Council for
consideration.
January 10, 2023 — The Planning Commission reviewed the ordinance and subsequently
provided comments, recommendations, and proposed approvals to submit
to the Council for consideration. During the Planning Commission
meeting, the concept of a committee to study this issue was vocalized.
February 21, 2023— The Council did not hold a public hearing or consider adoption of
revisions to the ordinance, but instead provided direction to staff to form a
Director's ad-hoc committee and seek additional community input for the
purpose of developing new recommended modifications to the ordinance.

March 8 —March 26, 2023 - Staff developed a basic online survey asking for community
feedback on topics ranging from density limits, overall caps,
parking requirements, and more. The survey ran for over two
weeks and over 500 surveys were completed by the community.
March 16, 2023 — Staff held a public workshop to hear the community's input and answer
their questions. The workshop was held at the City Hall Community
Room and was well attended.
Based on the feedback received during public hearings at Council and Planning Commission,
direction provided by Council Members and Planning Commissioners, as well as the results of
the online community survey and feedback received during the public workshop, the Director's
ad-hoc committee has new recommended changes to the ordinance for Planning Commission's
consideration.
The proposed text amendments are summarized below. While staff has made significant
revisions from the version that came before Planning Commission on January 10, 2023 (staff
report attached), some proposed revisions remain the same. In such cases, Planning
Commission's support, or lack thereof, as provided to staff during the January 10, 2023 Planning
Commission meeting is indicated in italics.
Density
(1) Limit the number of rentals within a geographic area based on distance.
a. 500-foot radius of an existing permitted vacation rental.
b. At the discretion of the Director, reduction down to 300 feet separation may be
considered when there are natural buffers such as major arterials, rivers, and
creeks.
Planning Commission originally supported this p�oposed revision, which previously included
1,000 feet separation on the sarne street. The 1,000 foot separation requiNement has been
reinoved.

(2) Provide a cap of 400 vacation rental permits to be allowed at any one time.
Planning Commission did not o�i ig nally suppo�t this p�oposed�evision. The Commission was of
the opinion that the combination of the proposed density requi�ement and enforcement of the
o�dinance would eliminate those rentals that are not willing to comply with the �egulations.
Thereby, a maximum cap on the numher is units is unnecessary.
Vacation Rental Criteria
(3) Location
a. Prohibit on properties containing an accessory dwelling unit with a building permit
application submitted on or after January 1, 2020 in compliance with State Law
governing accessory dwelling units.
b. Exempt vacation rentals in the Downtown Redding Specific Plan Core District from
the parking and density requirements.
(4) Owner Criteria - Must be a "natural person," trustee of a living trust, or limited liability
company.

(5) Permit Criteria
a. Require site manager information to be kept current at all times.
b. Revise the maximum occupants per bedroom from two ad�ults to two persons.
c. Limit the occupancy to 16 persons.
d. Require an inspection by City staff prior to issuance of the permit.
e. Require a log of vehicle information including make, model, color and license
plates of all tenant vehicles.
f. Reduce site manager's response time from 60 minutes to 45 minutes.
g. When applying, the applicant must state the number of on-site parking spaces are
available to tenants,but in no case shall it be less than two on-site spaces.
h. Parking in excess of the stated number of on-site parking is not permitted.
i. Tenants are not permitted to park on the street.
j. All advertisements shall include the number of permissible parking spaces.
k. All required parking spaces sha11 remain accessible and available to tenants at all
times during the rental periods.
1. Notification of application shall be sent to property owners within 600 feet of the
applicant's property.
m. The appeal period of a decision on vacation rental applications is 15 days.

by the short-term-rental tenant.

AZteNnatives
The Planning Commission has the option of recommending that the City Council adopt or not
adopt the proposed amendments or directing staff to modify the proposed amendments prior to
consideration by the Council. Should changes be requested, the Commission should provide
clear direction to staff.
Environmental Determination
The passage of the proposed ordinance is not a "project" according to the definition in the
California Environmental Quality Act and, therefore, is not subject to the provisions requiring
environmental review.
Planning Commission Authority
Section 18.10.030 of the Zoning Ordinance authorizes the Planning Commission to make
recommendations to the City Council on amendments to Title 18.

Conclusion
Adoption of the proposed amendments to the short-term regulations of the Redding Municipal
Code would enhance the existing and clarify the intent of the existing regulations and provide
additional flexibility in the administration of the Code. Therefore, staff recommends that the
Commission recommend adoption of the proposed amendments by the Council.

THE CITY COUNCTL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS:
Section l. Title 18 (Zoning), Chapter 18.43 (Standards for Specific Land Uses),
Section 18.43.180 is amended to read in its entirety as follows:
18.43.180 Short-Term Rentals
A. The purpose of this Section is to establish an appropriate permitting process and standards
for Short-Term Rental of dwelling units throughout the City;to provide a visitor experience
and accommodation as an alternative to the typical hotel, motel, and bed and breakfast
accommodations customarily permitted in the City; to minimize potential negative
secondary effects of Short-Term Rental use on surrounding residential neighborhoods; to
retain the character of the neighborhoods in which any such use occurs; and ensure the
payment of required transient occupancy taxes.
B. Types of Short-Term Rentals. For purposes of this Section, the following Short-Term
Rental facilities are established:
1. Hosted Homestay. An owner-occupied "Dwelling Unit," as defined by Section
18.61.020 under"Residential Structure Types" and excluding apartment units and
duplexes,with more than one habitable room,where, for compensation,individual
overnight room accommodations are provided for a period of less than thirty (30)
days.
2. Vacation Rental. An entire "Dwelling Unit," as defined by Section 18.61.020
under"Residential Structure Types" and excluding apartment units and duplexes,
where, for compensation, overnight accommodations are provided for a period of
less than thirty(30) days and the owner may or may not reside within the dwelling
unit for the term of the rental.
C. Short-Term Rental Permit Requirements. No person shall use, advertise, or market for
use, any dwelling unit on any parcel in any zoning district for Short-Term Rental purposes
without first obtaining approval as required by this Section.The following approval process
is established:
1. Hosted Homestay: This use is permitted within all zoning districts subject to
obtaining a Zoning Clearance from the Director and providing an affidavit
certifying that the owner understands, agrees to, and is in compliance with the
requirements of this Section. Applicants may be required to provide a site plan or
other information determined necessary by the Director to determine compliance
with this Section and shall pay an application fee as may be established by
resolution of the City Council. Permits for Hosted Homestays shall expire twelve
(12) months from issuance and are subject to a requirement for renewal in
accordance with this Section.
2. Vacation Rental: This use is permitted within all zoning districts subject to
obtaining a Site Development Permit issued by the Director in accordance with the
provisions of Chapter 18.11, Common Procedures and Chapter 18.13, Site
Development Permits of this Code, except that Site Development Permits for
Vacation Rentals shall expire twelve (12) months from issuance and are subject to
a requirement for renewal in accordance with this Section.
D. Districts in Which Permitted.The regulations of this chapter apply to Short-Term Rentals
in all zoning districts.
E. General Requirements - Hosted Homestay.
1. No more than one dwelling unit on a lot may be used at any one time.
2. A maximum of two rooms may be available for rent at any time. A floor plan shall
be submitted with the affidavit indicating the rooms for rent.
3. Occupancy shall be limited to a maximum of two persons per rented room. Room
rental shall be limited to a maximum of 180 rental days per calendar year.
4. The owner shall be the applicant, and other than for purposes of daily routines, the
applicant must occupy the residence at a11 times when rooms are being provided for
rent.
5. At the time of permit renewal, the property owner shall attest they understand and
agree to the Hosted Homestay requirements by signing the Hosted Homestay
Affidavit available at the Development Services Department and any payment due
must be remitted.
6. Except as set forth in Section 18.43.060 as it relates to licensed bed and breakfast
inns, no owner shall cook, prepare or serve for consumption food of any kind for
consumption by the Short-Term-Rental tenant.
7. The applicant shall state in the application the number of on-site parking spaces
available to tenants, but in no case shall it be less than two on-site spaces. Short-
Term-Rental tenant parking spaces shall be within the primary driveway or other
on-site location. No tenant parking in excess of this number of on-site parking
spaces is permitted. No tenant is permitted to park on the street. External changes
to a property such as converting significant areas of front yard landscape for
purposes of ineeting parking requirements is not allowed.
8. All required on-site parking spaces (including garage parking if identified at time
of approval) shall be accessible and available to Short-Term-Rental tenants at all
times during the rental periods.
9. Short-Term Rentals shall meet all applicable building,health, fire and related safety
codes at all times, including provision of working smoke and carbon monoxide
detectors.
10. The applicant shall post emergency evacuation instructions and "house policies"
within each Short-Term-Rental tenant bedroom. The house policies shall be
included in the rental agreement, and shall be enforced by the applicant. At a
minimum, the house policies should:
a. Reinforce the City of Redding's Noise Standards (RMC Section 18.40.100)
by establishing outdoor "quiet hours" between 10:00 p.m. and 7:00 a.m. to
minimize disturbance to neighboring residences. Outdoor activities are
prohibited during "quiet hours."
b. Require that Short-Term-Rental tenant vehicles be parked on the premises,
not the street in compliance with this Section.
11. The properry shall not be used to host non-applicant related weddings,parties, and
other similar events.
12. On-site advertising signs or other displays indicating that the residence is being
utilized as a Short-Term Rental are prohibited.
13. No person shall advertise a Short-Term Rental on any media platform when such
advertisement or notice contains an inaccurate or misleading statement of the
requirements of, or indicate amenities not allowed by the Redding Municipal Code
including the number of parking spaces.
14. All advertisements shall include the number of permissible parking spaces.
15. A City business license shall be obtained and transient occupancy taxes paid in
accordance with Chapter 4.12 as required. All advertising �or any Short-Term
Rental sha11 include the City of Redding transient occupancy tax number and the
City of Redding business license number assigned to the applicant. With submittal
of transient occupancy taxes, the applicant shall also submit a statement indicating
the number of Short-Term-Rental tenant stays, and the number of Short-Term-
Rental tenants for the reporting period.
16. The permit is not transferrable to a subsequent property owner or to another
property.
17. This ordinance shall not be construed as waiving or otherwise impacting the rights
and obligations of any individual, group, or the members of any homeowner's
association, as defined, to comply with or enforce CC&R's and no permit shall be
issued when it is demonstrated by substantial evidence that issuance of a permit
will be in contradiction to any recorded CC&R's or other record providing record
notice of a restriction on the use of the property.
F. General Requirements -Vacation Rentals.
L With the exception of items 1 through 46 listed in Section 18.43.180(E) above, the
General Requirements provisions for Hosted Homestays shall apply to Vacation
Rentals.
2. The following additional provisions shall also be applicable to Vacation Rentals
which may be supplemented by requirements established by the Director with
approval of the required Site Development Permit as necessary to maintain
compatibility of the use with the surrounding properties.
a. A Vacation Rental shall not be permitted on properties as follows:
1. Containing an Accessory Dwelling Unit with a building permit
application submitted on or after January l,2020 in compliance with
Government Code Section 658522, as may be amended from time
to time; or
2. Within a five hundred (500) foot radius of an existing permitted
Vacation Rental except that, at the discretion of the Director or
appellate body as the case may be,within a three hundred(300) foot
radius of an existing Vacation Rental when there is a buffer such as
a major arterial, rail right-of-way, flood control channel or stream
corridor between the Vacation Rental units.
b. The total number of Vacation Rentals in the City shall not exceed four
hundred(400) rentals at any one time.
c. The owner shall be the applicant and shall be a"natural person," trustee of
a living trust, or limited liability company thereby excluding all other legal
entities which protect against, in whole or in part, the liability of its
members or shareholders.
d. A Vacation Rental shall not be rented to multiple separate parties
concurrently.
e. The applicant shall keep on file with the City the name, telephone number,
and email address of a local contact person who shall be responsible for
responding to questions or concerns regarding the operation of the Vacation
Rental. This information shall be posted in a conspicuous location within
the Vacation Rental dwelling. The local contact person shall be available
twenty-four hours a day to accept telephone calls and respond physically to
the Vacation Rental within forty-five (45) minutes, if necessary. The name
and contact information of the local contact person will be made available
to the public. The contact information shall be kept current at all times.
£ Occupancy shall be limited to a maximum of two (2) persons per rented
room.
g. The maximum number of persons on the property at any time shall be
limited to siYteen(16)persons.
h. Prior to issuance of a permit, a physical inspection of the dwelling unit and
property shall be conducted by City staff.
i. Each operator shall maintain a log of each Short-Term-Rental tenant's
vehicle(s). The log shall minimally consist of the rental period, the license
plate, make, model, and color for each vehicle. The log shall be made
available at any time upon request by the City.
j. The requirements listed in Subdivisions E(7), E(8), E(14), and F(2)(a)(2)
shall not apply to a Vacation Rental located within Downtown Redding
Specific Plan Core District. Notwithstanding Subdivision B(2), an
apartment unit located in the Downtown Redding Specific Plan Core
District may be permitted as a Short-Term Rental.
G. Application Required.
l. Where a Site Development Permit is required by this Section, applicants for a
Short-Term Rental use shall pay the application fee established by resolution of the
City Council and apply for a permit in accordance with the provisions of Chapter
18.11 (Common Procedures),except that notices of the Vacation Rental application
shall be sent to all owners of real property within six hundred (600) feet of the
applicant's property for a fifteen(15) calendar-day notification period.
2. In making a determination to approve, conditionally approve, or deny any
application, including an application for renewal, for a Hosted Homestay or
Vacation Rental, the Director, or appellate body as the case may be, may also
consider any factor pertinent to the health, safety and welfare of the immediate
neighborhood or public generally including, but not limited to, ability to comply
with the provisions set forth in this Section, evidence of operation in violation with
this Section, complaints of neighbors, code enforcement activity, timeliness of
business permit renewal, timeliness or non-payment of transient occupancy tax,
proximity of the property to group homes, residential care facilities, and other
neighborhood and site characteristics.
3. Appeal of any determination to approve or deny any application, including an
application for renewal, shall be in accordance with Section 18.11.090.
H. Suspension and Termination.
1. The Director, or appellate body, shall apply the criteria set forth in Section
18.43.180(G)(2) in determining whether any permit issued pursuant to this Section
shall be suspended or terminated.Notice shall be provided to the applicant pursuant
to the procedure set forth in Section 1811.060.
2. Appeal of the suspension or termination by the Director of a Vacation Rental Permit
shall be in accordance with the requirements of Section 18.11.090.
3. Appeal of the suspension or termination by the Director of a Hosted Homestay
Permit must be made to the Planning Commission within ten(10) calendar days of
service of the Director's decision, and appeal of the Planning Commission decision
to the City Council must be made within ten (10) calendar days of service o�the
Planning Commission's determination. Decisions of the City Council are final, and
all challenging a decision of the Director must exhaust all remedies set forth in this
Section 18.43.180(H)(3) prior to bringing a challenge pursuant to Code of Civil
Procedure section 1094.5.
4. Service shall be deemed effective upon the earliest o£ 1) announcement by the
approving or appellate body of the decision in the presence of the appellant; 2)
personal service on the appellant of a written notice of decision; or 3) deposit of a
written notice of decision in the United States Mail.
T. Legal Non-Conforming Uses
1. Continuation and abandonment of legal nonconforming uses shall be governed by
Section 18.46.020. In addition to the conditions set forth therein, the following
allowances are permitted:
a. A temporary hardship exemption from this Section of not more than six (6)
months may be granted by the Director of Development services, or
designee, if: 1) a medical condition of the permittee, spouse, domestic
partner, or immediate family member jeopardizes the ability of the owner
to operate the Short-Term Rental; or 2) the death of a spouse, domestic
partner, or immediate family member of the permittee jeopardizes the
ability of the permittee to operate the Short-Term Rental.
b. A long-term rental exemption from this Section may be granted by the
Director of Development Services, or designee, if the permittee provides
proof of a long-term lease of twelve (12) months or longer prior to the
expiration of the Short-Term Rental permit. This exemption may be
repeated if the conditions set forth in this subsection are met. The length of
an exemption shall not exceed the term of the lease.
J. Enforcement and Remedies. Enforcement of the provisions of this Section include the
civil and equitable remedies as permitted by state law, the issuance of a citation and fine,
or other legal remedy as provided by Chapter 1.12 through 1.15, inclusive, of the Redding
Municipal Code. Upon notification by the City, any Short-Term Rental operating in
violation of the requirements of this Section must terminate operations immediately.
Further, a Site Development Permit issued under the authority of this Section may be
revoked in accordance with the procedures established in Chapter 18.11 (Common
Procedures).
Section 2. The Council hereby finds and determines that the enactment of this Ordinance
is exempt from review pursuant to the California Environmental Quality Act(Public Resources Code
section 21000 et seq.)("CEQA")because it has no potential to result in either a direct physical change
in the environment or a reasonably foreseeable indirect physical change in the environment. This
Ordinance is exempt from CEQA pursuant to the"common sense"exemption(14 CCR 15061(b)(3)),
as it can be seen with certainty that there is no possibility that the adoption o�the Ordinance will have
a significant effect on the environment.
Section 3. Severability. If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid,the remainder of the Ordinance and the application of such
provision will remain in effect to the extent permitted by law.
Section 4. This Ordinance shall take effect thirty(30) calendar days after the date of its
adoption, and the City Clerk shall certify to the adoption thereof and cause publication according to
law.

Recommendation
Conduct a public hearing, and upon conclusion, recommend that the City Council adopt an
4rdinanca amending Titlo 18, Z�ning, of the Redding Municipal Code as it pertains to short term
rentals.
Desc�iption
Over the past year, the City Council (Council) has held discussions regarding the City of
R�dding's (City) Short-Term R�ntal Ordinane� (Ordinanee). Be1ow is a sulnmary of thasa
discussions:
July 19, 2022 — The Council received a staYus update regarding implementation of the
City's Short-Term Rantai Qrdinance. Public comment received at the
meeting was mixed, with speakers both supporting and opposing tighter
regulations for short-term rentals. Following this meeting, Council and
staff continued to reeeive commu�ity feedback regarding short-term
rantals, specifically vacation rentals.
August 2, 2022 — Council directed City Attorney to raturn with an Interim Urgency
Ordinance which would have the effect of prohibiting the submission
and receipt of applieations for vacation rentals.
August 16, 2022 — Council considered but ulti�nately did not approve, the Int�rim Urgency
Ordinance; however, the consensus of Council was the Ordinance
should be reviewed for updat�s and additional regulations. Council
direeted staff to return to Council with reeoinmendations for potential

Council meeting.
October 18, 2022 — Council reviewed staff's suggested modifications to the Ordinance and
provided direction �o staff to craft a revised Ordinance for consideration
by the Planning Commission and subsequently to Council for
consideration.
The proposed text amendments are summarized below:
Density
(1) Limi�the number of rentals within a geographic area based on street and neighborhood.
a. 1,000 feet minimum separation on the salne street
b. 500 feet minimum separation on different streets
c. R�duction down to 300 feet s�paration may ba consid�rad when thera are natural
buffers such as major arterials, rivers, and creeks.
Tlacation Rental C�iteria
(2) Location—Prohibit on properties eontaining an accessory dwelling unit.
(3) Tota1 Number of Rentals — The total number of p�rmittad Rentals shall not exce�d 400
rentals at any one �ime.
(4) Public Hearing—Raquire a Planning Commission hearing when one or more party within
the notification area objects.
(5) Owner Critaria
a. Must be a "natural person."
b. A Shasta County residant
(6} Permit Cri�eria
a. Ona parson shall not have financiai interest in more than two vacation rentals
within the City of Reddi�lg at any one time.
b. Requira site manag�r information to be kept eurr�nt at all tiln�s.
c. Revise the maximum occupants per bedroom from�wo adults to two persons.
d. Limit the occupancy to 16 persons.
e. Provide one additional parking space in addition to the one per bedroom already
required.
£ Require an inspection by City staff prior to issuance of the permit.
g. Require a floor plan
h. Require a log of vehiele information i�lcluding make, model, color and license
piates of a11 tenant vehicles.
i. Reduce site manager's response time from 60 minutes to 45 minutes.
j. All requir�d parking spacas shall remain accessible and available to tenants at all
times during the rental periods.
k. Dwelling unit may not contain more than five bedrooms.
l. Notification of application shall be sent to property owners within 1,000 feet of
the applicant's property.
m. The appeal period af a decision on vaeation rental applications is 15 days.

continual rights to operate for three years from the effective date of the new regulations
and thereafter antared into a lottery to apply for th�necessary permit.
Issue
Shauld the Planning Commission r�commend that tha City Couneil adopt the propos�d
amendments to the short term regulations of the Redding Municipal Code?
Alternatives
The Planning Commission has the option of reeoininending that the City Council adopt or not
adopt th� proposed amendmants or directing staff to modify the propos�d amendments prior to
consideration by the Council. Should changes be requested, the Gommission should provide
cloar directian to staff.
EnviNonmental DeteNmination
The passage of tha proposed ordanance is not a "project" according to the definition in the
California Environmental Quali�y Ac� and, therefore, is not subject to the provisions reauiring
environmental review.
Planning Com�nission Autha�ity
Section 18.10.Q30 of th� Zoning Ordinanee authorizes the Planning Commission to make
recommendations to the City Council on amendments to Title 18.
Conclusion
Adoption of the proposed amendments to the short-term regulations of the Redding Municipal
Code would �nhance the existing and clarify th� intent of tha existing regulations and provide
additional flexibility in the administration of the Code. Therefore, staff reeommends that the
Commission recommand adoption of the proposed amendments by the Council.

A. Purpose �
�
�
The purpose of this Section is to establish an appropriate permitting proeess and standards for
Short-Term Rental of dwellin� units throughout the city; to provide a visitor experience and °�
accommodation as an alternative to the typical hotal, motel, and bed and br�akfast �
accommodations customarily permitted in the city; to miniinize potential negative secondary �
effects of Short-Term Rental use on surrounding residential neighborhoods; to retain the charaeter �
�
of the neighborhoods in which any such use occurs; and ensure the payment of required transient �
occupaney tax�s. .e
�
�
�
. Types af Short-Ter � entais. For purposes of this Section, the following Short-Term
Rental facilities are established: �

�
l. osted omestay. An owner-occupied"Dwellin�Unit", as de�ned by Section 18.61.020
und�r "Residential Structure Types" and excluding apartment units and duplex�s, with
more than one habitable room, where, for compensation, individ�ual overni�ht rooin
accommodations are provided for a period of less than thirty days.
2. Vacatian Rental. An entir� "Dwelling Unit", as defined by S�ction 18.61.020 under
"Residential Structure Types" and excluding apartinent units and duplexes, where, for

compensation,overnight accommodations are provided for a pariod of less than thirty days
and the owner may or inay not reside within the dwelling unit for the term of the rental.
C. Short-Term Rental Permit Requirements. No person shall use, advertise, or Inarlcet for
use, any dwelling unit on any parcal in any zoning distriet for Shart-Tenn Rental purposas
without first obtaining approval as required by this Section. The following approval process �,

Zoning Clearance from the Director and providing an affidavit certifying that the owner �,

understands, agrees to, and is in complianee with the requiraments of this Section.
Applicants may be rec�uired to provide a site plan or other information determined �
neeessary by the Director to det�rmine compliance with this Section and shall pay an �
applieation fee as may be established by resolution of the City Council.Permits for Hosted <"'

Hoinestays shall expire twelve(12)months from issuance and are subject to a requirelnent �
for renewal in accordance wi�h this Sec�ion. �

2. Vacaticrn ental: This use is permitted within all zonin� districts subject to obtaining a �

Rentals in all zoning districts. �

E. Generai� equire ents -� �osted � o estay. �
�
�
1. No more than one dwelling unit on a lot may be used at any one time. �
�
�
2. A maxiznum of two rooms may be available for rent at any time. A floor plan sha11 be
submitted with the affidavit indicating the rooms for rent. �

�
3. Occupancy shall be limited to a maximum of two persons per rented room. Rooln rental
shall be limited to a maximum of 180 rental days per calendar year. �
�
�
4. The owner shall be the applicant,and other than for purposes of daily routines,the applicant '�
must occupy the residence at all times when rooms are beulg provided for rent. �
�
5. At the time of permit renewal, the property owner shall attest they ullderstand and agree to �,
the Hosted Ho�nestay requirelnents by signing the Hosted Homestay Affidavit available at �
the Development Serviees Department and any payment due must be remitted.
6. Except as set forth in Seetion 18.43.060 as it relates to licensed bed and breakfast inns, no
owner shall cook, prepare or serve for consumption food of any kind for consutnption by
the Short-Term-Rental tenant.
7. Minimum required on-site parking space shall include one spaee for eaeh room rented plus

one additional parking spac�. Short-Term-Rental tenant parlcing spaces shall be within the
primary driveway or other on-site location. External changes to a property such as
converting signifieant areas of front yard landscape for purposes of ineeting parking
requirements is not allowed.
8. All required on-site parking spaces (including garage parking if identified at tiine of �,
approval) shall ba accessible and availabl�to Short-Tenn-Rental t�nants at all times during �
the rental periods. �
�
�
9. Short-Term Rentals shall meet all applieable building, health, fire and related safety codes °
�
at all times, including provision of working smolce and carbon monoxide detectors.
�.
10. Tha applicant shall post emergency evacuation instructions and"house policies"within each �
Short-Term-Rental tenant bedroom. The house policies shall be included in the rental �
agreement,and shall be enforced by the applicant.At a minimum,tha house policias should: �
�
a. Reinforce the City of Redding's Noise Standards (RMC Saction 18.40.100) by "
establishing outdoor "quie�hours" between 10:00 p.m. and 7:00 a.m. to ininimize �
disturbanca to n�ighboring residencas. Outdoor activiti�s are prohibited during �
�
"auiet hours." �

b. Require that Short-Tenn-Rental tenant vehicles be parked on the premises, not the
street in complianca with this Section. �
e�
�
�
11. The property shall not be used to host non-applicant relatad weddings, parties, and other 08
similax events. �
�
12. On-site advertising signs or other displays indicating that the residence is being utilized as �
a Short-Term Rental, are prohibited. �
�
�
�
13. No person shall advertise a Short-Term Rental on any media platform when such �
�
advertiselnent or notice contains an inaccurate or misleading statement of the requirements
of, or indicate amenities not allowed by the Redding Municipal Cade. �

�
14. A City business lieense shall be obtained and transient occupancy taxes paid in aeeordance
with Chapter 4.12 as required. All advertising for any Short-Term Rental shall include the �
City of Redding transient occupancy tax number and the City of Redding business license �
number assigned to the applicant. With submittal of transient oecupancy taxes,the applicant c�
shall also submit a statement indicating the number of Short-Ter�n-Rental tenant stays, and �
the number of Short-Term-Rental tenants for the reporting period. �
�
�
15. The permit is not transferrable to a subsequent property owner or to ano�her property. �
16. This ordinance shall not be construed as waiving or otherwise ilnpacting the rights and
obligations of any individual, group, or the members of any homeown�r's association, as
defined, to comply with or enforce CC&R's and no permit shall be issued when it is
d�monst�ated by substantial evidence that issuance of a permit will be in contradiction to
any recorded CC&R's or other record providing record notice of a restriction on the use of
the property.

F. General equire ents -Vacation entals.
l. With the exception of items 1 through 6listed in Section 18.43.180(E) above, the General
R�quirements provisions far I�ost�d Homestays shall apply to Vaeation Rentals.

2. Th� following additional provisions shall also be applicable to Vaeation Rantals which �
may be supplemented by requirements established by the Director with approval of the �
required Site Development P�rmit as necessary to maintain compatibility of the use with �
the surrounding properties. �°,

a. A Vacation Rental shall not be pel�nitted on properties as follows: �''
�
�
l. Containing an Accessory Dwellin�Unit with a building permit application <"'
submitted on or after January 1, 2020 in compliance with Stat� Law �
governing Accessory Dwelling Units (Government Code Section 65852.2); �
or �
�
2. Within one thousand(1,000)fe�t of an existing Vacation Rantal on the same �
street; or �
.�
3. Within a five hundred (500) foot radius of an existing pennitted Vacation
Rental; or �
e�
�
�
4. At the discr�tion of the Director and notwithstanding subparagraph (iii), 08
within a three hundred (300) foot radius of an existing Vacation Rental �
�
when there is a natural buffer such as a major arterial, rail right-of-way,
flood control channel or stream corridor between the Vacation:lZental units. �
�
�
b. The total number of Vacation Rentals in the City shall not exceed four hundred �
(440)rentals at any one time. =�
�
c. The owner shall be the applicant and shall be as follows: �
a�
�
l. A "natural person" or trustee of a living trust, thereby excludi��g all liinited
liability companies, partnerships, corporations or other entities whieh �
protect against, in whole or in part, the liability of its members; and �
�
2. A Shasta County resident, as verified by a California Driver Lieense or �
Identi�cation Card issued by the California Department of 1Vlotor Vehicles. �
�
�
d. A Vacation Rental shall not be rented to multiple separate parties concurrently. �
e. The applicant shall keep on file with the City the name, telephone number, and
email address of a lacal contact person who shall be rasponsible for respoliding to
questions or concer�as regarding the operation af the Vacation Rental. This
information shall be posted in a conspieuous location within the Vacation Rental
dwelling. Tl�e local contact person shall be available twenty-four hours a day to
accept telephone calls and respond physically to the Vacation Rental within

forty-five minutes, if necassary. The name and contact infonnation of the local
contact person will be made available to the public. The contact information shall
ba lcept eurrent at all times.
f. No person shall have a finaneial int�rest in mor� than two (2) Vacation Rentals
within the jurisdictional boundaries of the City of Redding at any one (1} time. �,

l. "Financial Interest"is defined as having an ownership interest in any entity �,

compensation of any kind from a Vacation Rantal;having a right to receiva
incoine of any kind resulting from a loan (i.e., repayment of principal or �
int�r�st) or other instrument applicable to a property hosting a Vacation �
Rental; or having any right to derive monetary compensation from the �
provision of servic�s to an owner, or said owners ag�nt, of a Vacation �
RentaL �

g. A Vacation Rental shall not be operated from a dwelling unit containing more than �
five (S) b�drooms. A fioor plan shall be submitt�d with the permit application �
�
identifying the bedroolns of the single-fainily residence. To qualify as a bedroom, �
th�room sha11 contain a built-in closet. �
�
h. Occupancy shall be limited to a maximum af two persons p�r r�nted room. �

�
�
i. The maximum number of persons on the property at any time shall be limited to 08
sixteen (16)persons. �

j. Prior to issuance of a permit, a physieal inspection of the dwelling unit and property �
sha11 be conducted by Ciry staf£ �
�
�
�
lc. Each operator sha11 maintain a log of each Short-Terin-Rental tenant's vehicle(s). �
�
The log sha111ninimally consist of the rental period,the license plate, malce,model,
and color for each vehicle. The log shall be made available at any time upon request �
by the City. �
�
G. Application equired. °'
�
�
1. Where a Site Development Permit is required by this Section, applicants for a Short-Term '�
Rental use shall pay the application fee established by resolntion af th� City Council and �
apply for a permit in accordance with the provisions of Chapter 18.11, Common �
Procedures, except as follow: �
�
�
�
a. Notiees of th� Vaeation Rental applieation shall be sent to a11 owners of real
property within one thousand (1,000) feet of the applicant's properiy for a fifteen
(15) day noti�eation period. Should one or more owner(s) of real property within
the notification area object in writing to the approval of the Vacation Rental or
appeal the approval by the Director within the �fteen (15) day appeal period, the
application shall be brought forth before the Planning Commission for
consideration.

2. In making a determination to approve, conditionally approve, or deny any application,
including an application for rsnewal, for a Hosted Homastay or Vacation Rental, the
Director, or appellate body as the case may be, may consider such factors including, but
not limited to, ability to comply with the provisions set forth in this Section, evidenca of
operation in violation with this Section, complaints of neighbors, code enforceinent �,
activity, timeliness of busin�ss permit renewal, timeliness or non-payment of transient �
oecupancy tax, proxiinity of the property to group homes, residential care facilities, and �
other neighborhood and site charaeteristics. o
�
�
. Sus ension and Ter ination.
�.
1. The Director,or appellate body, sha11 apply the crit�ria set forth in Section 1�.43180(G)(2) �
in determining whether any permit issued pursuailt to this Section shall be suspended or �
terminatad. Notice shall be provided to the applicant pursuant to the procadure set forth in �
Section 18.11.060. �
�

2. Appeal of the suspension or tennination by the Directar of a Vacation Rental Permit shall �
be in aeeordanee with Section 18.11.090. �
�
�
�
3. Appaal of the suspension or termination by the Director of a Hostad Homestay Permit shall
be to the Planning Coinmission within ten days of service of the Director's decision, and �
�
finally to the City Council within ten days of service of the Planning Commission's �
determina�ion.Decisions of the City Council are�nal, and all challen�ing a decision of the �
Director must exhaust a11 ramedies set forth in this Section 18.43.1�0(H)(3) prior to �
bringing a chailenge pursuant to Code of Civil Procedure section 1094.5. �
�
4. Service shall be determined to be effective upon personal delivery or deposit in the United �
States mail pastage prepaid, whiehever is earlier. �
�
�
�
I. Legai Non-Confor ing Uses and A ortization of Non-Confor ing Uses. '�
�
l. No permit issued pursuant to this Section shall be considered as creating a vested property �
right to a renewal of said permit, and no condition of economic or personal investment or �
expectation of the same in an existing Vacation Rental or Hosted Homestay shall create �
any such vested property right. �
�
�
2. Except as provided in Section 18.43.180(I)(3),no permit shall be issued which would cause '�
a violatian of any provision of this Sectian. �
�
3. Those possessing a current, valid permit for a Vacation Rental issued pursuant to this �,
Section which is effective as April 1, 2023, are excused from compliance with the �
requir�ments of Sections 18.43.180(E)(7)-(8), 18.43.180(F)(2)(a)-(b), and
18.43.180(:F)(2)(�. Notwithstanding the preeeding, no pennit shall be renewed as of April
l, 2026, without demonstration of compliane� with all the terms and conditions of this
Section.
4. As of April 1, 2026, or as soon thereafter as may feasibly be accomplished, all operations
in naneomplianee with the site-distance and/or density requirements set forth in Section
Packet Pg�2'�
18.43.180(F)(2)(a)-(b), shall be entered into a lottery ar lotterias to dat�rmine which
permit(s) will not be renewed due to non-compliance with �he rec�uirements set forth in
Section 18.43.180(F)(2)(a)-(b). Those select�d by lott�ry for continuad operation of a
Vaca�ion Rental may,assuming compliance with all the provisions of this Section,continue
in oparation thereafter and apply for r�newal of said permit thar�after without n�cessity of
undergoing further random processes of selection. Those not seleeted for continued �,
operation of a Vaeation Rental may continue operation but only until such time as the �
permit issued has lapsed due to expiration. Thereafter, the use shall cease. �
�
�
5. Excl�usion from continued operation pursuant to Section 18.43.180(I)(4) shall not be °
�
construed as barring subsequent application. �
�.
6. As of April 1, 2026, and only as it relates to the density requir�mant set forth in Section �
18.43.180(F)(2)(b}, if the total number of Vacation Rentals falls below the number of four �
hundrad (400}, applications will be received and processed on a first come-�rst serv�d �
basis. Thereafter, to remain eligible for consideration of an application, the applicant must �
reapply prior to the �xpiration of one (1) year, and, assuming a timaly reapplication, the �
date of application for purposes of receipt on a first come-first served basis shall be the �
date of the initial application. �
�
�
�
J. Enforce ent and e edies. �
�
Enforcament of tha provisions of this Section may include tha civil and �quitable remedies as �
permitted by state lawz the issuance of a citation and fine, or other legal remedy as provided by �
Chapt�r 1.12 of the Redding Municipal Coda. Upon notification by the City, any Short-Term �
Rental operating in violation of the requirements of this Section must terminate operations �
immediately. Further, a Site I�evelopment Permit issued under the authority of this Section may �
be revoked in accordance with the procedures established in Chapter 18.1 l, Common Procedures. �'
�
�
Section 2. Severability. If any section, subsection, sentenee, clause or phrase of this �
Ordinance is for any reason held by a court of competent jurisdiction to be invalid or �
unconstitutional, sueh decision shall not affect the validity of the remaining portions of the �
ordinance. The City Council of the City of Redding hereby deelares that it would have passed this �
ordinanee and each section, subsection, selltence, clause and phrase thereof irrespective of the fact ��
that one or more sections, subsections, sentences, clauses or phrases may be held invalid or �°
unconstitutional. �
�
�
Sec�ion 3. The passage of this ordinanee is nat a "projeet" accarding to the definition in �
the California Environmental Quality Act, and therefore is not subject to the provisions requiring �
environmental review. �'

Seetion 4. This ordinance shall take effect thirty (30) days after the date of its adoption, �
and the City Clerk shall certify to the adoption thereof and cause its publication according to law. �
