Recommendation Approve the sale of City-owned property located at 6550 Lockheed Drive (APN 054-280-008) to the County of Shasta; and provide direction relative to determination of terms and conditions of the sale. Fiscal Impact There is no f scal impact associated with this action. If a sale of property occurs, there will be a positive fiscal impact to the Airports Division. Alter�native Action The City Council (Council) could choose not to se11 the property. Background/Analysis The County of Shasta presented a letter to the City of Redding regarding the potential purchase of property located at 6550 Lockheed Drive, (APN 054-280-008). The subject property is included in the Redding Municipal Airport portfolio (see map attached). As such, it has already been declared by resolution and approved by the California Department of Housing and Community Development as Exempt Surplus per the Surplus Land Act, Government Code section 54221 (� and (g). At this time, there is no pre-determined use for the property, and it has been released from federal obligations via the F�deral Aviation Administration. As stated in its letter of interest, the County of Shasta owns the adjacent parcel located at 6590 Loekheed Drive and intends to expand its Emergency Operations Center and eo-locate South County Patrol services. Any sale of the property is subject to a current valid appraisal per local and federal guidelines that include: the City is obligated to expend the amount realized from the sale of the property for specific items or improvements at Redding Regional Airport(RDD) within 5 years of the close of escrow; the City shall not permit access to RDD from the subject property; City will file an FAA Form 7460-1, Notice of Proposed Construction or Alteration which requires the new owner to coordinate any iinprovements with RDD; and covenants, conditions, restriction and reservations further described in the Instrument of Release (C-3722). Environmental Review This is not a project defined under the California Environmental Quality Act (CEQA), and no further action is required. Anderson Mayor of Redding 760 Parkview Avenue Redding, CA 96001 Dear Mayor Anderson: Consent to Land Release at the Redding Municipal Airport This letter ie in response to your letter dated March 1, 2000. In your letter, you requested the release of 52.75 acres of airport property to facilitate an airport land sale. This letter constitutes the Federal Aviation Administration�s (FAA) consent to the release of approximately 52.75 acres oE airport property described as part of Parcel C, as depicted in the �enclosed Airport Layout Plan (ALP) , from the restrictions contained in the Instrument of Transfer dated October 7, 1947. This release is granted subject to the following conditions: a. The city of Redding is obligated to expend an amount equal to the proceeds realized from the sale of the property for specific items or improvements at Redding Municipal Airport five years from the date of close of escrow. b. In the event the net proceeds exceed the cost of the capital improvements, the balance of the funds will be used as followa: (1) Payment for airport improvements not eligible for federal participation. {2) Investment in an interest bearing account for future airport capital improvements not listed in items a. and b. (1} above. (3) Retirement of general obligation bonds or airport bonds used to fund capital improvements at the Redding Municipal Airport. (4) Placed in the Operations and Maintenance Budget for current fiscal year or subaequent fiscal year airport operations. (5) Development of common-use facilities and utilities of the dedicated revenue production property of the airport now owned or subsequently acquired. • c. The city of Red�g, its succesaors, and assign�hall not permit . access to the Redding Municipal Airport from the subject property ' without prior consultation and approval of the FAA. d. The city of Redding agrees, for itself, its successors and assigns, that it will file an FAA Form 7460-1, Notice of Proposed Construction or Alteration, for purposes of airspace evaluation for any and all conatruction proposed on the premises. Enclosed is an original notarized Instrument of Release and three original Agreementa between the United Statea of America and the city of Redding. Please return two executed agreements to this office for our records. It is also necessary to release this property from the terms and conditions of the grant agreements issued under Airport Development Aid Program projects Nos. 8-06-0194-01 through 6-06-0194-07 and Airport Improvement Program projects Nos. 3-06-0194-0182 through 3-06-0194-2199. This release is granted subject to revising the ALP and Airport Property Map. This action does not release, modify, or amend any of the federal obligations for the balance of the airport property. The decision to grant this release was made only after due consideration of the effects of the proposed action. Pursuant to FAA Order 5050.4A, paragraphs 23 (a) {1Q) and 35, dated October 8, 1995, the release of the subject property is categorically excluded from an environmental assessment. There is hereby reserved to the City of Redding, Grantor, its successors and assigns, for the use and benefit of the public, a right of flight for the passage of aircraft in the airspace above the surface of the above described real property, together with the right to cause in said airspace such noise as may be inherent in the operation of aircraft, now known or hereafter used for navigation of or flight in the said airspace, and for the use of said airspace for landing on, taking off from, or operating on Redding Municipal Airport. b. Grantee, by accepting this real property, expressly agree, for itself, its successors and assigns� that it will not erect nor permit the erection of any structure or building nor permit objects of natural growth or other obstructions on the above described real property above a mean sea level elevation of five hundred eighty four (584) feet. In the event the aforesaid covenant is breached, Grantor reserves the right to enter on the above described real property and to remove the offending structure or object and to cut the offending natural growth, all of which shall be at the expense of the Grantee. c. Grantee, by accepting this real property, expressly agrees, for itself, its successors and assigns, that it will not make use of the above described real property in any manner which might interfere with the landing and taking off of aircraft at the Redding Municipal Airport or otherwise constitute an airport hazard. In the event the aforesaid covenant is breached, Grantor reserves the right to enter on the said real property and cause the abatement of such interference at the expense of the Grantee. 2. W I T N E S S E T H: WHEREAS, Resolution No. 99-24 was adopted by the Council of the city of Redding on February 16, 1999, a copy of which is attached hereto, and is hereby incorporated herein and made a part hereof by reference; and WHEREAS, Resolution No. 99-24 obligates the city of Redding to expend an amount equal to the proceeds that could or will be realized from the sale or disposition of land at the Redding Municipal Airport for specific items or improvement at the airport or other specified public airports within five (5) years and further authorizes the Mayor of the city of Redding to enter into this aqreement on behalf of the city of Redding. NOW, THEREFORE, in consideration of the covenants and agreements contained herein, FAA and City mutually agree as follows: ARTICLE I Pursuant to the authority contained in Public Law 81-311 and FAR Part 155 of the Federal Aviation Regulations, FAA shall deliver to City a letter releasing the excess portion of that real property covered by the various Grant Agreements in effect at the Redding Municipal Airport from all conditions, covenants, and assurances contained in said Grant � � Agreements. ARTICLE III Incident to performing under ARTICLE II above, City agrees that for purposes of this agreement, the terms and conditions of Resolution No. 99-24, as attached hereto, are controlling and shall remain in full force and effect throughout the life of this agreement. ARTICLE IV This agreement shall remain in effect until the FAA determines that City has complied with all terms thereof and FAA so informs City. ARTICLE V The parties hereto agree that this agreement is personal and does not run with the land.
