(A-2-79) . � � 0 WHEREAS, proceedings have been duly corid'ucted 'and" ,�, � . •� . held in accordance with the provisions of, the St 'reet Vacation Act of 1941 (Streets and Highways Code Sections 8300 , et seq. ) , and �vHEREAS, the City Council of the City of Redding finds and determines that the hereinafter described real property is not necessary for present or prospective street purposes, but that certain easement interests must be retained, NOW, THEREFORE, the City Council of the City of Red- ding resolves and orders as follows : 1. That the Council makes the follocaing findings in connection herewith : (a) The project is compatible with the Redding General Plan , (b) The project wi11 not significantly alter existing land form, (c) The project is compatible v�ith surround- ing land use, ' (d) The project is compatible with the Redding Municioal Code, and the Council hereby ratifies the negative declaration approved by the Board of Administrative. That certain real property in the City of Redding, County of Shasta, State of California, being a ten foot wide �� strip on the east side of Court Street, between Grandview � 9 Avenue and a . point 380 feet northerly thereof , and as the .� � -1- � � • • ' � . same is more particularly described as follows : Commencing at the most northeasterly corner of Grandview Heiyhts Subdivision as shown in Book 5 of Record D9aps at page 51 , Shasta County Records , said corner lying on the westerly right of way line of Railroad Avenue; thence on and along the northerly line of said subdivision S . 82° W. , 224 feet to a point �on the easterly right of way line of Court Street, the true point of beginning; thence running the following bearings and distances, continuing S. 82° W. , 10 . 00 feet; thence leaving said northerly subdivision line, S . 8° E. , 370 . 00 feet; thence on a 10. 00 foot radius curve to the left , through a central angle of 90° 00 ' 00" , a distance of 15 . 71 feet to a point on the easterly right of way line of Court Street; thence on and along said right of way line, Di. 8° W. , 380. 00 feet to a point common to the easterly right of way line of Court Street and the northerly line of said subdivision , the point of ter- mination , containing 3 , 779 square feet, more or less , be and the same is hereby vacated and abandoned as a public street, except that the City retains an easement interest over the entire abandoned area for utility purposes and an area for a corner rounding , all as depicted on "Exhibit A" attached hereto. 3 . That the City Clerk of the City of Redding be and she hereby is directed to record a certified copy of this Resolution, attested by the City Clerk under the seal of the City of Redding , in the office of the Shasta County Recorder. The Board of Administrative P.e�iiew, at tneir regular meeting of Mav 16 , � 1979, found that Abandonment Application A-2-79 by Grandvie�a Nursery, requesting abandonment of ten feet of excess street right-of-way on the east side of Court Street, north of Grandview Avenue, � has no substantial impact upon the environment and that an environmental impact report is not necessary. The 6oard of Administrative Revie�a makes its findings . . 6ased on the folloaiing reasons: 1 . Project is compatible with the Redding General Plan. 2. Project will not significantly alter existing land form. 3. Project is compatible �aith surrounding land use. 4. Project is compatible with the Code of the City of Redding, California. The foregoing decision that the proposed project t��ill have no significant effect upon the environment is based on an initial study prepared by the City Planning Department and reviea�ed at a Board of Administrative Revie�a meeting. If there are substantial changes that alter the character of the proposed project, another environmental impact determination will be necessary.
