HomeMy WebLinkAboutReso. 1979-068 Initiating Proceedings for Annexation to the City of Redding of Uninhabited Territory Described Herein & Designated "Enterprise Annex No. 78-8" & Giving Notice of Time & Place for Hearing Protests Thereto � � � RESOLUTION NO. 79_L�� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING INITIATIPdG PROCEEDINGS FOR ANNEXATION TO THE CZTY OF REDDING OF UNZNHABZTED TERRITORY DESCRIBED HEREIN AND DESIGNATED "EVTERPRISE AtdNEX NO. 78-8" AND GIVING NOTICE OF TIi1E AND PLACE FOR HEARING PROTESTS THERETO. BE IT RESOLVED by the City Council of the City of Redding as follows : 1. That, pursuant to the provisions of the t+lunicipal Organization Act of 1977, a petition signed by owners of more than twenty-five per cent (258) of the land in the hereinafter described property by area and by assessed value as shown on the last equal- ized assessment roll of the County of Shasta, was filed with the City Council of the City of Redding on January 15 , 1979 . 2 . That the territory which the petitioners request be ' annexed to the City of Redding and which said City and its Council propose to annex, is uninhabited territory situate in the County of Shasta, State of California , hereby designated "Enterprise Annex tdo. 78-8" and more •particularly described in "Exhibit A" attached hereto and incorporated herein by reference . 3 . The City Council has reviewed the Negative Declara- tion prepared in connection herewith and has determined that no significant effect on the environment is created hereby. � , 4 . That the Local Agency Formation Commission of 5hasta County, California, did in session duly assembled on Wednesday, March 14 , 1979 , consider and approve the proposed annexation of said "Enterprise Annex No. 78-8" , as above described. 5. That iNonday, June 18 , 1979 , at the hour of 7 : 30 �J P.M. in the Council Chambers in the Police Department and City ' r . . � Council �Chambers°Building, 1313 California Street, Redding , Shasta � . t'� ' � , . , . ' -1- \ � � � � County, California , is hereby fixed as the time and place when and where any person now owning real property within the uninhabited territory above described and proposed to be annexed to the City of Redding, and having any objections to the propo'sed annexation , may appear before the Council of the City of Redding , and show cause why such uninhabited territory.'should not, be so, annexed to the City of Redding. The protest must be in writing , may be filed at any time prior to the termination of said hearing for objections to the proposed annexation , and shall state the name or names of the owner or owners of property affected and the description and area of such property in qeneral terms . . 6 . The City Clerk of the City of Redding is hereby authorized and directed to cause a copy of this Resolution to be published .twice, but not oftener than once a week , in the Redding Record-Searchlight, a newspaper of qeneral circulation published in said City of Redding, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least twenty (20) days prior to the date set for hearing . 7 . The City Clerk of the City of Redding is further authorized and directed to cause a copy of this Resolution to be published twice , but not oftener than once a week , in the Valley Times, a newspaper of general circulation published outside of the City of Redding but in the County of Shasta , in which is located the territory proposed to be annexed , said publication to be complete at least twenty (20) day,s prior to the date set for the hearing. 8 . The City Clerk is further authorized and directed to file a copy of this Resolution with LAFCO. -z- - � � � . 9 . The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed was assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk , and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable , with said Clerk, such notice to be given not less than ten (10) days before the first public hearing on the proposed annexation . 10. The City Clerk is furth�r authorized and directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of Sha,sta� County, since the County has a legal interest in certain portions of the territory proposed to be annexed. 11. The City:�Clerk is directed to cause written notice to be given to such otner persons 'as, may be legally entitled thereto, . . , in the manner required by law.
