STREET. '(A=4-80) . WHEREAS, the City of Redding has been- requested .to abandon • a water line easement along the' south property line of 2:50,5' Butte Street, which is described as follows - • The easterly 60 feet`of the northerly 10 feet of that certain alley shown on the 'map of ,C.' L. :Jezle_r' Subdivi- sion of. Block. •"J"', • Dakyn' s. Addition to Redding,. recorded ' January 22, 1902 , in Book 1 of Maps, at page• 67', ' Shasta County Records; ' and shown 'on .the : diagram which is' attached.'hereto as "Exhibit A" , • and • WHEREAS, it is the determination of the City Council of • ' the City of Redding that the said easement is• not- necessary or con- - • venient to the public, use, and • WHEREAS," the Director of Public Works of the •City '•of ' Redding has duly investigated the proposed abandonment, and has , ' determined there will be no furtherr need for the easement proposed ` • to be abandoned, and • • WHEREAS, the .CityPlanning. Commission has reviewed, and ' . approved said'-.propos'ed'abandonment, and ' - - WHEREAS, ahe City,'Council of.tthe ',City`:of Redding elects to• proceed in this . matter under' the .prbvisions- of the Publ.ic' Ser- viceEasements ,Vacation .Law',` with the' provision 'that this..,,resdiu- • • tion 'shall be deemed an ordinance of intention, . .. ' NOW, THEREFORE, BE IT RESOLVED by the City Council of the: 'City o-f, Redding as follows : • • - _1_ . - • 1. That all of the foregoing recitals are true and correct. • • 2. That the City Council intends to and hereby declares • its intendion to vacate and abandon the water line easement which is described hereinabove and shown on "Exhibit A" attached hereto. BE TT FURTHER RESOLVED that a public hearing is set for Monday, June 16, 1980 , at 7: 30 P.M. , at the City Council Chambers, 1313 California, Street, Redding, when and where all persons inter- ested in or objecting to the abandonment of said easement will be heard. BE IT FURTHER RESOLVED that the Director of Public Works .be and he is hereby instructed to post or cause-.to. be conspicuously. posted, at points not more than three hundred (300) feet in distance apart and along the line of the subject easement hereinabove de- scribed notices -of this intention to abandon said easement. Said notices shall set forth the passage of this resolution of intention • and ' shall also set forth the time and place of hearing as herein- above set forth. At least three such notices as above set forth shall be- posted in the manner above set forth, and said posting 'shall :be completed not less than ten (10) days prior to the date of hearing.
