A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING COOPERATIVE AGREEMENT FOR SHARING FACILITY COSTS,
BASS MOUNTAIN REPEATER SITE; AND AUTHORIZING ITS EXECUTION. •
WHEREAS, under a nonexclusive Lease agreement with the
U. S . Department of Interior, the City of Redding proposes to in-
• stall radio transmission facilities at the Bass Mountain Repeater
Site, where communication facilities of the Northern California
• Medical Care Council and the U. S. Forest Service also exist, and
WHEREAS, said Lease agreement requires that the City •
also enter into a Cooperative Agreement which provides for 'shar-
ing the costs of electric service to the site, maintenance of

an emergency generator on the site, and maintenance of the •
access road to the site, and •
• WHEREAS , the City Council--.has examined the Cooperative
• Agreement submitted for execution, and finds it satisfactory,
NOW, THEREFORE, 'BE ' IT 'RESOLVED' by' the City Council of
• the City iof Redding that the C400perative .Agreement, for Sharing
Facility ' Costs, Bass Mountain Repeater Site, which is attached
hereto as "Exhibit A" r

authorized to execute same on behalf of the City.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council
of the City of Redding on the 7th day, of April , 1980 , and
was duly adopted at said meeting by the following vote:

Cooperative Agreement
For Sharing of Facility Costs
•
Bass Mountain Repeater Site
This cooperative agreement, made and entered into between Northern California
Medical Care Council, hereinafter referred to as MED-CAL, Shasta County, here-
inafter referred to as the County, the City of Redding, hereinafter referred to
as the City, and the Forest Service, U.S. Department of Agriculture, hereinafter
referred to as the Service, under the provisions of t1 Act of June 30, 1914,
(16 USC 498) .
WITNESSETH:

Whereas, the parties herein jointly occupy a site on Bass Mountain, Shasta
County, Section 7, T. 33 N. , R. 4 W. , for purposes of communicationsm under
lease with the U.S. Bureau of Reclamation, and
Whereas, there is an annual cost incurred for consumption of electrical power
and maintenance of an access road, and
Whereas, it is proper that each party pay an equal share of the above costs,
Now therefore in consideration of the above premises, the parties agree as
follows:
A. The County, MED-CAL and the City shall:
1. Make advance payments, as requested by the Service, to be deposited in
the cooperative work fund.
B. The Service shall:
1 . Perform road maintenance which will consist of annual grading of the
road to Bass Mountain Repeater Site.
2. Pay Pacific Gas and Electric Co. for all electrical charges as
incurred.
3. Maintain emergency generator in a serviceable condition.
4. Refund any unexpended balance which exceeds actual costs each year, or
credit said amount to the ensuing years costs.
C. It is Mutually Agreed that:
1 . Each party will share equally in the cost of road maintenance and
electric power.
2. Estimated total cost for the period January 1 , 1980 to December 31 ,
1980 is:

3. Service will revise above estimates annually based on prior year costs
and other factors. However, final costs shall be based upon actual
expense incurred, including an allowance for overhead charges not to
exceed 20%.
4. No member of, or Delegate to, Congress or Resident Commissioner, shall
be admitted to any share or part of this agreement, or to any benefit
that may arise therefrom; but this provision shall not be construed to
extend to this agreement if made with a corporation for its general
benefit.
5. Nothing herein shall be construed as obligating the Forest Service to
expend or as involving the United States in any contract or other
obligation for the future payment of money in excess of appropriations
authorized by law.
6. No contribution to the cooperative fund herein provided for shall
entitle the cooperator to any share or interest in the said facilities
other than the right to use the same under the regulations of the
Forest Service. All improvements shall be and remain the property of
the United States.
7. Either party may terminate the agreement by providing 60 days' written
notice. Unless terminated by written notice, this agreement will
remain in force indefinitely.
