HomeMy WebLinkAboutReso 2023-070 - LMD A-CRESOLUTION NO. 2023-070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING: (1) CONFIRMING THE MAPS OF THE ASSESSMENT DISTRICTS CONTAINED IN THE ENGINEER'S REPORTS ON FILE WITH THE CITY CLERK; (2) CONFIRMING THE ANNUAL ASSESSMENTS AND ORDERING THE LEVY AMOUNTS FOR FISCAL YEAR 2023-24 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE WHEREAS: A. On June 20, 2023, by Resolution No. 2023-053, the City Council approved the Reports of the Engineer as filed with the City Clerk relating to the Landscape Maintenance Districts outlined in the table below and gave notice of the time and place of the July 18, 2023, public hearing regarding the levy and collection of assessments for Fiscal Year 2023-24; and B. A general location of each District is included in the table below, and maps of these Districts are attached to the Engineer's Reports on file with the City Clerk; and C. The purpose of these Districts is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval for each District and the general locations as outlined in the table below; and D. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq; and E. This Resolution is made in satisfaction of those requirements set forth in the Streets and Highways Code Section 22631; and F. The public hearing, duly and properly noticed, commenced at the Council Chambers, 777 Cypress Avenue, Redding, California on July 18, 2023, and was concluded prior to the adoption of this Resolution. At the public hearing, the Council gave every interested person an opportunity to object to the proposed assessments; and G. All legal prerequisites to the adoption of this resolution have occurred; NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: 1. The matters set forth above are true, correct, and are adopted herein. 2. The Report of the Engineer, on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the assessable acres and remaining parcels within the District. The existing improvements for each subdivision in the District are set forth in Part B of the Engineer's Reports on file with the City Clerk. 4. Pursuant to Streets and Highways Code Section 22631, the maps of the assessment districts addressed herein and contained in the Report of the Engineer are confirmed. The general locations of the acres and remaining parcels in the District are set forth in Part A of the Engineer's Reports on file with the City Clerk. 6. Only costs for the maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, and debris, maintenance of the detention basin, and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531 will be assessed. 7. The assessments against each developable lot or remaining parcel located within the Districts for Fiscal Year 2023-2024 are confirmed, adopted, and levied as outlined in the table below, except that an assessment shall not be levied on property owned by a federal or state governmental agency or another local agency. The City Clerk shall forthwith transfer to the Auditor -Controller and Assessor -Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment maps contained in the Engineer's Report for the Landscape Maintenance Districts outlined in the table below. 9. That the City Clerk gave notice of said hearing pursuant to the Streets and Highways Code Section 2262(a).
