RESOLUTION NO. 2004-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING THE DESTRUCTION OF CERT AINRECORDS IN THE CUSTODY OF THE REDDING POLICE DEPARTMENT WHEREAS, the Chief of Police has recommended that certain records of the Redding Police Department, which have been retained for two or five years pursuant to Penal Code Section 832.5 and are not required to be kept by statute, should be destroyed; and WHEREAS, section 34090 et seq. of the Government Code specifically provides that certain records may be destroyed, provided the written consent of the City Attorney has been obtained, and provided the City Council gives its approval of such destruction by resolution; and WHEREAS, the City Attomey has given his written consent hereunder to the destruction of said records; NOW, THEREFORE, BE IT RESOLVED by the City Council that the Chief of Police is hereby authorized to destroy records of the Redding Police Department that are two (2) or five (5) years old, which are identified in the attached Exhibit A. Nothing herein shall be deemed to authorize the destruction of any records which are specifically required to be kept by statute. Records of vehicles towed by the Redding Police Department. Includes 03/00 registered owner notification receipts. 01/01 to 09/01 (Original tow reports maintained in 11/01 to 12/01 Records Division). Records of items of property sold, bought, or pawned through secondhand 05/01 to 09/01 dealers. Paperwork forwarded to our agency by repossession companies and/or lenders 07/01 to ]2/01 . as follow-up to their phone call when the vehicle was repossessed. The teletype reflecting our entry of the vehicle into the California Law Enforcement System as repossessed and the vehicle registration information is attached. For misdemeanors and infractions which would include traffic violations, some 09/01 to 12/01 municipal code violations, misdemeanor warrant cites to court, and misdemeanors such as possession of tobacco by a minor. (Misdemeanors being prosecuted by the DA are not included. The DA receives those copies). The original copy of the citation is retained by the court. Cards filled out by officers in the field when making contact with subjects 2001 under suspicious circumstances. This data is input into the computer system b the Investigations Division. Latent Print Cards Training Cards Reports S.H.O. services, vehicle releases, etc. A copy of each receipt is forwarded daily to the City Treasurer and is retained in their records. Fingerprint cards received from the Shasta County Sheriff's Department when a subject is booked at the jail. The fingerprint cards are retained by the Shasta County Sheriff's Department and the D artment of Justice. Training cards of employee's training completed. Information maintained in com uter s em.
