I ".~' _ i" .. e e ORDINANCE NO. 2342 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING REDDING MUNICIPAL CODE SECTIONS 10.20.040 and 10.20.048 (POSSESSION OR CONSUMPTION OF ALCOHOLIC BEVERAGES IN CITY PARKS AND POSSESSION OR CONSUMPTION OF ALCOHOLIC BEVERAGES PROHIBITED ON PUBLIC TRAILS TO REFLECT CURRENT CONDITIONS AND PARK INVENTORY The City Council of the City of Redding does ordain as follows: Section 1. Subsection B.1. of Section 10.10.040 (Possession or Consumption of Alcoholic Beverages in City Parks) of the Redding Municipal Code is amended to read as follows: 10.20.040. Possession or Consumption of Alcoholic Beverages in City Parks. B.I. Except as set forth in subsection B2 following, it is unlawful for any person to possess or consume any alcoholic beverage at any time within the boundaries of or the parking lots of the following parks: Alta Mesa Park Amethyst Park Benton Dog Park Bob White Park Buckeye Community Park Buenaventura Park Caldwell Memorial Park Carnelian Park Cascade Community Park Churn Creek Park City Hall Sculpture Park Civic Center Park Clover Creek Neighborhood Park Clover Creek Preserve Country Heights Park Creekside Park Enterprise Community Park Foothill Park Foxtail Neighborhood Park Graham Park Hawn Neighborhood Park Indian Hills Park Lake Redding Park Library Park ~ Martin Luther King, Jr. Memorial Park (expressly excluding ~ therefrom the Martin Luther King, Jr. Memorial Center Building) 'Y Mary Lake Park e e Meadow Creek Park Minder Park Northridge Gardens Park Old City Hall Park Parkview Riverfront Park Peppertree Park Ravenwood Park Redding Soccer Park Redding Sports Complex (except within Big League Dreams fenced area) Ridgeview Park Riverfront Park River Ridge Park Rose Tree Park Rolling Hills Neighborhood Park Softball Park South Bonnyview Boat Launch South City Park Stillwater Heights Park Sulphur Creek Campground T.R. Woods Memorial Park Turtle Bay Park (excluding areas under lease to Turtle Bay Exploration Park, the Sundial Bridge and adjacent plazas) Turtle Bay Park East Twin View Park Valley Ridge Park Vista Ridge Park Waverly Park Western Oaks Park Whistling Park Section 2. Subsection B.2. of Section 10.20.040 (Possession or Consumption of Alcoholic Beverages in City Parks) of the Redding Municipal Code is amended to read as follows: 10.20.040. B.2. Possession or Consumption of Alcoholic Beverages in City Parks. This prohibition shall not apply within the interiors of specific buildings or those park areas described below in Section B3 during such times as sponsored events are taking place within the confines of such buildings and parks; provided that if alcoholic beverages are to be served within such building or parks, the sponsor of the event has: a. First complied with the provisions of Section 2.55.120 ofthis code; appeals from decisions of the director of community services shall be made directly to the city council; b. First complied with Chapter 11.44, Special Events, of this code; I !,.r I I (It e c. Obtained any necessary alcoholic beverage control permit for the event; the consent required to be submitted to permitting authority may be given by the city manager or designee; d. Posted with the city clerk a damage and cleanup deposit in the sum of three hundred dollars; e. Filed with the risk manager a certificate evidencing public liability insurance coverage for the event in the form and amount approved. by the risk manager; and f. First complied with the provisions of Resolution No. 4148 and any amendments thereto on file in the office of the city clerk relating to the use of parks and recreation areas. B.3. The buildings and park areas where possession and consumption of alcoholic beverages may be permitted in accordance with procedures described in Section B2 are as follows: Carter House Gallery Martin Luther King, Jr. Memorial Center Building Caldwell Recreation Center Senior Citizens Hall Big League Dreams Fenced Activity Area Redding Soccer Park Fenced Activity Area or within: Caldwell Memorial Park City Hall Sculpture Park Enterprise Community Park Lake Redding Park Library Park Redding Soccer Park Riverfront Park Softball Park South City Park . ...... . . e e Section 3. Section 10.20.048 Possession or consumption of alcoholic beverages prohibited on the Sacramento River Trail of the Redding Municipal Code is amended to read as follows: 10.20.048. Possession or consumption of alcoholic beverages prohibited on public trails. It is unlawful for any person to possess or consume any alcoholic beverages at any time within the boundaries of or the parking lots of the following public trails or their environs, provided, The Sundial and Diestelhorst Bridges and their adjacent plazas are excluded when permission is obtained as outlined in Section 10.20.040. Violation of this section shall be an infraction. The passage of this ordinance is not a {'project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 5. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify the adoption thereof and cause its publication according to law. Section 6.
