ORDINANCE NO. 2341
AN ORDINANCE OF THE CITY OF REDDING AMENDING THE
ZONING MAP OF THE REDDING MUNICIPAL CODE RELATING TO
THE REZONING OF CERTAIN REAL PROPERTY IN THE CITY OF
REDDING (RZ-7-04)
The City Council of the City of Redding does ordain as follows:
Section 1. That the boundaries of the districts referred to in Section 18.01.050 of the Redding
Municipal Code, as designated on a map entitled "Zoning Map of the City of Redding, California," .dated
January 7,2003, are hereby altered as set forth on the map attached hereto and made a part hereof by:

The shoppilllg center at 1010,1020, 1030, 1040, 1060, 1070, 1080, and 1090 East
Cypress Avenue

"RM-15" Residential Multiple Family
"RC" Regional Commercial District
A 7.9-acre portion of 1201 Industrial Street ,

"GC" General Commercial District
Section 2. On the basis of the Initial Study for Rezoning Application RZ- 7 -04, prepared by the
Development Services Department, the City Council finds that the subject rezoning will not have a significant
effect on the environment and adopts the Mitigated Negative Declaration with the following findings:
1. The City of Redding has completed a Mitigated Negative Declaration for the rezoning. Based on
the whole record (including the Initial Study and comments received), there is no substantial
evidence the project will have a significant effect on the environment.
2. The Mitigated Negative Declaration and its supporting documentation reflect the independent
judgment and analysis of the City of Redding.
Section 3. In order to compensate for the loss of future housing opportunities at 1200 East Cypress
Avenue and 1201 Industrial Street, the applicant/developer (Lowe's Company Inc.) has agreed to make an
in-lieu payment to the City of Redding in the amount of $1,000,000 to provide funds to assist in the
development of housing within the City of Redding. Funds will be deposited by the City into an account that
is to be used at the sole discretion of the City Council for projects which the City Council deems to be in
furtherance of the goals stated in the City of Redding General Plan Housing Element.

Section 4. This ordinance shall not take effect until such time that the City Attorney certifies to the
City Clerk that: (1) the provisions of Section 3 of this ordinance have been performed and fully satisfied by
Lowe's Company Inc and (2) that a minimum of 30 days has passed since adoption of the ordinance.
I HEREBY CERTIFY that this ordinance was introduced and read at a regular meeting of the City
Council on the 1st day of March, 2005, and was read and adopted at a regular meeting of the City Council on
the 15th day of March, 2005, by the following vote:
