ORDINANCE NO. 2337 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING ADDING SECTION 9.04.060 (URINATION AND DEFECA TION) TO TITLE 9 OF THE REDDING MUNICIP AlL CODE The City Council of tllIe City of Redding does ordain as follows: Section 1: The deposit of human urine or feces on public or private property in a manner not otherwise regulated by law poses a serious detriment to public health, safety and quality of life. Section 2: Redding Municipal Code Chapter 9.04 (Health and Sanitation - 'General Provisions) is amended by adding Section 9.04.060 to read asfollows: 9.04.060 - Urination and Defecation. A. It is unlawful for any person to deposit, or cause to be deposited, any human urine or feces upon any public or private highway or road, including any portion ofthe right- of-way thereof, or in or upon any public property other than property designated or set aside for that purpose, or in or upon any private property where the public is admitted by easement, license or other permission, or upon any pIivate property which is exposed to public view. B. Notwithstanding Subdivision A, persons who violate this ordinance due to one or more verified medical conditions shall be exempt from the enforcement of this ordinance. Section 3: The passage of this ordinance is not a "project" according to the definition in ti,e California Environmental Quality Act (Cal. Pub. Res. Code g 21000 et seq.), and is not subject to the provisions requiring environmental review. Section 4: Eacll provision of this ordinance shall be considered severable, and in the event any part of this ordinance is declared invalid, unconstitutional or void by a court of competent jurisdiction, the remainder of the ordinance shall continue in full force and effect. Section 5: This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause its publication according to law. ~ ~ ~ -1 1 . .
