ORDINANCE NO. 2333 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING, CALIFORNIA, AMENDING ORDINANCES ESTABLISHING AND AMENDING CERTAIN LIMITATIONS WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE MIDTOWN AND MARKET STREET REDEVELOPMENT PlROJECT AREAS. WHEREAS, the City Council of the City of Redding (the "City Council ") adopted Ordinance No. 974 on July 3, 1968, as amended by Ordinance No. 1173 on August 5, 1974, Ordinance No. 1295 on November 19, 1976, and Ordinance No. 1299 on December 20, 1976, approving and adopting the Redevelopment Plan (the "Redevelopment Plan") for Midtown Project No. I, Calif. R-120 (the "Original Project"); and WHEREAS, the City Council adopted Ordinance No. 1923 on July 17, 1990, as amended by Ordinance No. 2294 on June 4, 2002, approving and adopting the Amended Redevelopment Plan (the "Amended Plan") for the Market Street Redevelopment Project, which added certain area to the Original Project (the "Added Area"), increased certain limits in the Redevelopment Plan and replaced the Original Plan in its entirety; and WHEREAS, the City Council adopted Ordinance No. 2103 on December 20, 1994, as amended by Ordinance No. 2150 on June 4, 1996 and Ordinance No. 2185 on August 5, 1997, in order to comply with Section 33333.6 of the Community Redevelopment Law; and WHEREAS, Section 33333.6 of the Community Redevelopment Law established certain limitations on the incurring and repaying of indebtedness and the duration of redevelopment, which limitations apply to every redevelopment plan adopted on or before December 31, 1993; and WHEREAS, Senate Bill No. 1045 added Section 33681.9 to the Health and Safety Code requiring the Agency to remit a certain amount of money to the County Auditor for deposit in the County's Educational Revenue Augmentation Fund (ERAF); and WHEREAS, Senate Bill No. 1045 amended Section 33333.6 of the Health and Safety Code to provide that when a payment pursuant to Section 33681.9 is required, a redevelopment plan adopted prior to January 1, 1994, from which the payment will be derived, may be amended by the legislative body by adoption of an ordinance to extend the time limits set forth in Section 33333.6 (a) and (b) by one year; and WHEREAS, it has been determined that this matter is not subject to the provisions of the California Environmental Quality Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Section 1 of Ordinance No. 2185 adopted by the City Council on August 5,1997, is amended to read as follows: "Section 1. The time limit on the establishment of the repayment ofloans, advances, and indebtedness, as set forth in the last paragraph of Section 502 of the Amended Plan, is amended to read: 'The Agency shall not establish or incur loans, advances, or indebtedness beyond January I, 2004, to finance in whole or in part the Original Project and beyond July 17,2010, to finance in whole or in part the Added Area. The Agency shall not pay indebtedness or receive property taxes pursuant to Health and Safety Code Section 33670 after January 1,2031, for the Original Project and after July 17,2041, for the Added Area. ", ~ \.);} ~ \i> '- . . Section 2. Section 2 of Ordinance No. 2150 adopted by the City Council on June 4, 1996, is amended to read as follows: "Section 2. The time limit on the effectiveness of the Amended Plan, as set forth in Section 800 of the Amended Plan, is hereby amended to read: 'Except for the nondiscrimination and nonsegregation provisions which shall run in perpetuity, the provisions of this Amended Plan shall be effective, and the provisions of other documents formulated pursuant to this Amended Plan may be made effective, untilJanuary 1,2010, for the Original Project and until July 17, 2031 for the Added Area.'" Section 3. This Ordinance amending the Original and Amended Redevelopment Plan is adopted pursuant to Health and Safety Code Section 33333.6. In addition to the specific limitations established in Sections 1 and 2 of this Ordinance, this Ordinance hereby incorporates by reference those provisions of subsections (g) and (h) of said Section 33333.6. Section 4. The City Clerk is directed to send a certified copy of this Ordinance to the Agency. Section 5. This Ordinance shall be in full force and effect thirty (30) days after its passage. Section 6. The City Clerk is ordered and directed to certify to the passage of this Ordinance and to cause the same to be published once in the Record Searchlight, a newspaper of general circulation, published and circulated in the City of Redding, California. Section 7. If any part of this Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance, and this City Council declares that it would have passed the remainder of this Ordinance, if such invalid portion thereof had been deleted.
