HomeMy WebLinkAbout1602 - Plan Check Fee on Resubmittal of Expired Building Permits CITY OF REDDING, CALIFORNIA COUNCIL POLICY SUBJECT RESOLUTION POLICY EFFECTIVE PAGE NUMBER NUMBER DATE PLAN CHECK FEE ON RESUBMITTAL OF EXPIRED BUILDING PERMITS 92-313 1602 07/21/92 1 BACKGROUND Sometimes building permits are issued and, for one reason or another, construction does not commence. On occasion, these applications are resubmitted. According to the Building Code, "in order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan-review fee." If the application is resubmitted within one year, the building fees shall be one-half the amount required for a new permit. After one year, the building permit fee shall be the full amount if the plans are res~]bmitted. The Building Code is silent on the amount of fees to be paid for plan check. PURPOSE The purpose of this policy is to clarify the City's policy regard- ing payment of plan check fees upon the resubmittal of building permit application after a permit has expired. POLICY It is the policy of the City that the Building Official may give a credit of 80 percent of the plan check fee on the resubmittal of a building permit if all of the following facts are in evi- dence: 1. The plans are resubmitted within three months of expiration of the building permit. 2. The Building Codes have not changed. 3. The 'building plans, specifications, and location have not changed and the architect's and engineer's licenses are valid. 4. State laws related to construction have not changed. 5. The building complies with all other applicable laws in effect at the time the permit is resubmitted, and the develop- er pays all applicable fees in effect at the time a new building permit is issued. 6. This is a one-time only occurrence. IMPLEMENTATION This policy shall be implemented by the Building Division when the above criteria are found to be in evidence. CR 0049
