City Council, Adjourned Regular Meeting

The meeting was called to order at 12 : 00 Noon by Mayor Demsher with
the following Council Members present: Fulton, Gard, Kirkpatrick,
and Demsher. Absent: Council Member Pugh
Also present were Assistant City Manager Courtney, City Attorney
Murphy, Public Works Director Arness, Planning and Community Develop-
ment Director Perry, and City Clerk Brayton.
APPEAL OF SITE PLAN REVIEW SPR-3-79 by Tony Maier
Planning Director Perry noted that at the conclusion of the October 1,
1979 meeting, it was decided that a decision on this matter be con-
tinued to 12: 00 Noon, October 9, 1979, in order to determine whether
a further compromise could be reached. Mr. Perry stated that Mr.
Maier and his attorney have come back with two alternate proposals.
Council was shown sketches illustrating the two proposals which
basically provide as follows:
Alternate A provides that the westerly door on the front
of the building is to be relocated to the rear of the
building as recommended on October 1, 1979, and a paved
driveway is to be extended to Old Beltline Road from the /4/k/6
rear of the building. The developer would install a
wood fence along Woggon Lane in lieu of the chain-link
fence.
Alternate B provides that the two overhead doors on the
front of the building be retained, two doors are to be
installed on the back of the building opposite the doors
on the front, the door on the west side of the building
is to be removed, and a paved driveway to be extended to
Old Beltline Road from the rear of the building.
It was noted that Alternate B removes the noise factor by eliminating
the door on the west side of the building.
Mr. Perry stated that staff recommends acceptance of Alternate B
subject to certain conditions which he outlined.
In the discussion of this matter, Councilwoman Gard asked about
the architectural treatment on the front of the building.
Gary Borchard, Attorney, representing Mr. Maier, said it was the
intention of Mr. Maier to go ahead with the original plans for
changing the facia; however, if Alternate B is selected, it will
be broken up because the two overhead doors will remain on the
front of the building. It is anticipated that there will be
contrasting panels between the two overhead doors.
Another factor discussed was the necessity of providing that an
easement be retained for access to Beltline Road in the event
the property to the east is divided at some future date. City
Attorney Murphy agreed that this also should be listed as a
condition of approval.
MOTION: Made by Councilwoman Gard, seconded by Councilman
Kirkpatrick to reconsider the appeal of Mr. Maier re SPR-3-79 .

MOTION: Made by Councilwoman Gard, seconded by Councilman
Kirkpatrick to uphold the appeal and approve a revised site
plan (Alternate B) as follows :
1. Door on west side of building to be removed.
2 . Developer may install two doors on back of building
opposite existing doors on the front.
3. Area between the westerly door on the north side of
the building and the westerly driveway is to be
intensively landscaped.
4 . Chain-link fence is to be relocated to a point 25
feet from the west property line. Cedar slats are
to be installed in the fence along Woggon Lane and
along the first fifty feet of the south property
line east of Woggon Lane.
5. A paved driveway is to be extended to Old Beltline
Road from the rear of the building.
6. Between the relocated fence and the existing tree
holes the developer shall install , between Oasis
Road to the south property line, a row of five-
gallon Camphor trees at 30-foot intervals .
7 . Night security lights shall be designed to be
oriented away from adjoining residential areas.
Standards shall be set back 25 feet from the west
property line and shall not exceed 25 feet in
height. Lights shall incorporate cut-off shields
to prevent back glare.
8 . A landscape planter is to be installed in front of
the chain-link fence between Woggon Lane and the
westerly driveway.
9. Doors on the front of the building shall be kept
closed except when vehicles enter or exit the building.
10. Screening requirements of Ordinance No. 1346 are to
be met re storage and unloading.
11. Architectural treatment on the front of the building.
12. An easement is to be retained for a driveway to Belt-
Line Road from the back of Mr. Maier' s building.
Voting was as follows:
Ayes: Council Members - Fulton, Gard, Kirkpatrick, and Demsher
Noes: Council Members - None
Absent: Council Members - Pugh
ADJOURNMENT
There being no further business, at the hour of 12 :20 P.M. , Mayor
Demsher declared the meeting adjourned.
