The Pledge of Allegiance to the Flag was led by Director of Personnel and Labor Relations Reynolds. The invocation was offered by the Reverend Glenn Ratcliff, Associate Pastor of the Redding First Church of the Nazarene. The meeting was called to order at 7:00 P.M. by Mayor Demsher with the following Council Members present: Gard, Kirkpatrick, and Demsher. Absent: Council Members Fulton and Pugh. Also present were City Manager Brickwood, Assistant City Manager Courtney, Public Works Director Arness, Planning and Community Development Director Harris, Director of Electric Simpson, Director of Personnel and Labor Relations Reynolds, Deputy Planning Director Perry, City Clerk Brayton. and Deputy City Clerk Richter. APPROVAL OF MINUTES MOTION: Made by Councilman Kirkpatrick, seconded by Councilwoman Gard approving the minutes of the regular meeting of June 18, 1979, as mailed to each Council Member, and correcting the minutes of June 5, 1978 as follows (Volume 39, Page 155) : "ACCEPTANCE OF FINAL MAP - Grandview Manor Subdivision Councilman Pugh abstained from discussion and voting on this item. MOTION: Made by Councilman Kirkpatrick, seconded by Councilman Fulton that the Final Map, Grandview Manor Subdivision, be accepted, and that the City Clerk be instructed to file the map with the Shasta County Recorder, and that the improvements be accepted as being completed satisfactorily. The Vote: Unanimous Ayes with Councilman Pugh abstaining." The Vote: Unanimous Ayes Note that because only three Council Members were present tonight and Councilman Kirkpatrick was absent from the June 25, 1979 meeting, approval of said minutes was postponed to a later meeting. APPROVAL OF PAYROLL AND ACCOUNTS PAYABLE REGISTER MOTION: Made by Councilman Kirkpatrick, seconded by Councilwoman Gard that Accounts Payable Register No. 25, check nos. 64088 to 64334, inclusive, in the amount of $668,837.35 be approved and paid, and that Payroll Register No. 26, check nos. 115487 to 116046, inclusive, salaries in the amount of \cij� $288,169.42 for the period June 10, 1979 through June 23, 1979 be approved. • Total $957,006.77 Voting was as follows: Ayes: Council Members - Gard, Kirkpatrick, and Demsher Noes: Council Members - None Absent: Council Members - Fulton and Pugh CLAIM FOR DAMAGE - 1st hearing Richard J. The Vote: Unanimous Ayes ORDINANCE - Regulation of Development in Overcrowded-School Attendance Areas MOTION: Made by Councilman Kirkpatrick, seconded by Councilwoman Gard that full reading of Ordinance No. 1451 be waived, and that the City Attorney's representative be instructed to scan same. ESSENTIAL AIR SERVICE FOR CALIFORNIA COMMUNITIES - PUC Meeting City Manager Brickwood reviewed his memorandum to Council dated June 26, 1979, which memo is hereby made a part of these minutes by reference. Mr. Brickwood advisied that the Public Utilities Commission will hold meetings on July 25, 197.9, at 1:30 and 7:00 p.m. in the Council Chambers to determine a coordinated state response regarding "Essential Air Service" for California communities as (specified in the Airline Deregulation Act of 1978. Mr. Brickwood discussed the issue and recommended that Councilman Kirkpatrick be appointed to give testimony at said meeting on behalf of the City of Redding. He also requested authorization to contact Shasta County, the three Northern (California Counties, the Chamber of Commerce, and other / / )) C interested organizations in order to gain a massive display of strength and unity in support of maximum essential air service for our communities. MOTION; Made by Councilwoman Gard, seconded by Councilman Kirkpatrick approving the aforestated request. The Vote: Unanimous Ayes APPEAL OF USE PERMIT UP-93-79 by Gwen Schulze At its June 25,1979, meeting, Council held a public hearing re appeal of Use Permit Application UP-93-79 by Gwen Schulze. At the close of the hearing, the decision in this matter was postponed in order to obtain clarification o information received from the County Health Department. III Planning and Community Development Director Harris reviewed his memo to Council dated June 28, 1979, stating that according to Richard Wymore of I the Shasta County Health Department, the sewage system for the rest home is adequate for 15 full-time people. It is his understanding that there is an aide on the premises around the clock, and a cook is present during the day who he (does not consider to be a full-time employee. Mr. Harris said the septic system for Mrs. Andrus' mobile-home was not used to 170 determine the occupancy limit of 15 persons. Mr. Harris noted that in January, 1979, the Redding Fire Department told Mrs. Andrus they would approve an increase of up to 12 persons with the existing rooms, provided a use permit was obtained for the increase. Mr. Harris said it remains the opinion of the Planning staff that a rest home of more than six persons is inconsistent in a single-family zone and should be located in a multiple family zoning district. It is the staff recommendation that the request for increased occupancy be denied. Mr. Harris said that if Council favors approval of the application, the nega- tive declaration should be ratified and the following conditions imposed: 1. Dedication of 25 feet of right of way along the front of the property for street purposes; 2. The applicant is to agree to participate in an assessment district when one is formed for street improvements; 3. Five off-street parking spaces are to be provided in accordance with City Council Resolution No. 3540 for the rest home and an additional two spaces for the mobilehome by October 1, 1979; 4. A fence is to be constructed along the north property line adjacent to the parking area; 5. Requirements of the Fire Marshal, the Building Official, and the Shasta County Health Department are to be met prior to occupancy; 6. Maximum occupancy may not exceed 14 patients. In a communication to Council dated June 25, 1979, Gwen Schulze advised that she would not be attending the Council meeting and expressed reasons for opposing the increase in the occupancy of the rest home. Said letter is on file in the office of the City Clerk. Councilwoman Gard asked if the road is an easement. She noted that it is narrow and such a use has to have an impact on the area. Mr. Harris replied that it is a private road easement and that they are responsible for its upkeep. Mrs. Gard asked about fire plugs in the area. A resident at 5701 Wildwood Drive, three doors from the rest home, stated that there are two fire plugs near this property. Mrs. Gard observed that there is a great need for this type of service; however, feels the rest home is located in the wrong area. She noted that the City did not grant the original permit for the rest home for 10 persons; it came into the City as a non-conforming use with the Cascade annexation. Councilman Kirkpatrick agreed that there is a need for this service. MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick that Council makes the following findings re Use Permit Application UP-93-79, by Dorothy Andrus, requesting permission to expand an existing residential- care facility from ten to 14 residents, on property located at 5730 Wildwood Drive, in a "U" Unclassified District: 1. Project is compatible with the Redding General Plan; 2. Project will not significantly alter existing land form; 3. Project is compatible with surrounding land use; 4. Project is compatible with the Code of the City of Redding, California; 5. Project is compatible with "U" zoning district requirements, and ratifies the Negative Declaration adopted by the Planning Commission on May 22, 1979. The Vote: Unanimous Ayes MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick that the appeal of Use Permit Application UP-93-79 be denied and approval be • 171 granted for expansion of the existing residential-care facility from ten to 12 residents subject to the following conditions: 1. Dedication of 25 feet of right of way along the front of the property for street purposes; 2. The applicant is to agree to participate in an assessment district when one is formed for street improvements; 3. Five off-street parking spaces are to be provided in accordance with City Council Resolution No. 3540 for the rest home and an additional two spaces for the mobileiome by October 1, 1979; 4. A fence is to be constructed along the north property line adjacent to the parking area; 5. The Vote: Unanimous Ayes Mrs. Gard explicitly stated that as far as she is concerned, should the applicant desire further expan i.on, they will have to locate in an area where there is multiple family zoning consistent with this use. OLSEN PETROGLYPH SITE - Offer of Dedication Planning and Community Develo•' ent Director Harris reviewed his memo to Council dated June 28, 1979, stating that the developer of Whispering Oaks Subdivision is offering . 10-acre site known nationally as the Olsen Petroglyph Site to the City o Redding. Mr,. Harris said that it is the opinion of staff that the Cit , through the Redding Museum, is the best vehicle to ensure the continugd preservation of this valuable resource. It is recommended that the City accept the offer in principle and that the legal documents and conditions of acceptance be submitted for approval prior to the recording of the final subdivision map. Mayor Demsher said he has visited the site and has viewed some of the petroglyphs noting that they _Ire in a very good state of preservation and concurs in the recommendation. Councilwoman Gard said that t e City needs to express its gratitude for this offer and for the opport nity to protect it. Mayor Demsher said that prese vation could be a problem and requested press cooperation and discret'on in describing the location of the site. Mr. Demsher also requested th t Mr. Harris arrange for a Council field trip to the site. MOTION: Made by Councilman Ki kpatrick, seconded by Councilwoman Gard accepting the offer of dedication of the Olsen Petroglyph site in principle and that the legal documents and conditions of acceptance be submitted for approval prior to the recording of the final map. The Vote: Unanimous Ayes REDDING MUNICIPAL AIRPORT - A nexation to the City of Redding City Manager Brickwood reviewed the staff memo to Council dated June 27, 1979, stating that the Airporus Commission unanimously supports annexation 111 of the Redding Municipal Airport to the City of Redding and requests that Council explore this possibil'ty. Mr. Brickwood recommended that this /'y matter be referred to staff for study and recommendation to Council by its meeting of August 20, 1979. With the concurrence of other Council Members, Mayor Demsher referred this item to staff as recommended. 172 PUBLIC WORKS PLANNING REPORTS Public Works Director Arness submitted the Public Works Planning Reports \C) for July, 1979. NOTICE OF COMPLETION —Eureka Way - Pioneer Drive 8" Sewer Extension MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick accepting the construction of the Eureka Way - Pioneer Drive 8" sewer \'\ extension, Bid Schedule No. 1073, as being completed satisfactorily, and instructing the City Clerk to file a Notice of Completion. The Vote: Unanimous Ayes NOTICE OF COMPLETION - Improvements on Hilltop Drive and Dana Drive MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick accepting the construction of improvements on Hilltop Drive and Dana Drive, Bid Schedule No. 1078, as being completed satisfactorily, and instructing the City Clerk to file a Notice of Completion. The Vote: Unanimous Ayes NOTICE OF COMPLETION - Favretto Avenue Storm Drain - Grange Street to Fell Street / MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick \� accepting construction of the Favretto Avenue Storm Drain - Grange Street to Fell Street, Bid Schedule No. 1066, as being completed satisfactorily, and instructing the City Clerk to file a Notice of Completion. The Vote: Unanimous Ayes NOTICE OF COMPLETION - Storm Drain Pipe - Grange Street to ACID Canal MOTION: Made by Councilman Kirkpatrick, seconded by Councilwoman Gard / accepting construction of the storm drain pipe - Grange Street to ACID /))\--) � Canal, Bid Schedule No. 1056, as being completed satisfactorily, and instructing the City Clerk to file a Notice of Completion. The Vote: Unanimous Ayes CH2M HILL CONTRACT AMENDMENT - Redding Regional Wastewater System Task Order No. 12 Public Works Director Arness reviewed his memorandum to Council dated June 27, 1979, re the CH2M Hill Contract Amendment - RRWS, Task Order No. 12. Mr. Arness requests Council approval of this Task Order which fq) provides for instructional training and startup services for the new wastewater treatment facility at Clear Creek and for authorization for the City Manager to execute same. MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick approving the aforestated request. The Vote: Unanimous Ayes RESOLUTION - Delegating Authority to Public Works Director re Easements MOTION: Made by Councilwoman Gard, seconded by Councilman Kirkpatrick that Resolution No. 79-110 be adopted, a resolution of the City Council of the City of Redding delegating to the Director of Public Works the authority to accept routine utility easements, drainage easements, easements for street purposes, and easements for open space and riparian habitat, as offered for dedication on parcel maps. Voting was as follows: Ayes: Council Members - Gard, Kirkpatrick, and Demsher Noes: Council Members - None Absent: Council Members - Fulton and Pugh Resolution No. 79-110 is on file in the office of the City Clerk. The Vote: Unanimous Ayes RESOLUTION - Re Abatement at 1420 Gold Street (Pettinger/Wolfe Property) MOTION: Made by Councilman Kirkpatrick, seconded by Councilwoman Gard that Resolution No. 79-111 be adopted, a resolution of the City Council of the City of Redding rescinding Resolution No. 79-55, which declared intention to begin legal proceedings of abatement on property at 1420 Gold Street. ORDINANCE - Adopting Building, Housing and Mechanical Codes Councilman Kirkpatrick offered Ordinance No. 1452 for first reading, an ordinance of the City Council of the City of Redding amending Chapter 16.08 of the Redding Municipal Code by repealing Sections 16.08.010 and 16.08.020 / 1 and substituting therefor new Sections 16.08.010 and 16.08.020, pertaining to Housing, Building and Mechanical Codes.
