The meeting was called to order by Mayor Pugh with the following Council Members present: Demsher, Fulton, Gard, and Kirkpatrick Also present were City Manager Brickwood, City Attorney Hays, Public Works Director Arness, Planning and Community Development Director Perry, Associate Civil Engineer Hastings , Supervising Accountant Downing, Secretary to the City Council Rupp, and City Clerk Richter HARTNELL AVENUE ASSESSMENT DISTRICT - No. 1980-3 Mayor Pugh resumed consideration of the Hartnell Avenue Assessment District No. 1980-3. The following documents are on file in the office of the City Clerk: Affidavit of Posting - Notice of Adjournment Mayor Pugh advised that the City Council ' s action was continued on this matter due to concerns which needed to be reviewed. He noted that the public hearing was closed at the previous meeting of July 6 . The Mayor said he has had the opportunity to review the assess- S$k/ ments on the Harter and Rother properties and it appears to him that there are some basic adjustments which need to be made and that some other problems need to be handled such as access and other specific benefits . However, he recommends that Council proceed with the Assessment District at this time. He said the extension of Hartnell and widening to four lanes has been planned for a long time and it needs to be done. He feels there is a need for some negotiation on the assessments in the area. Council Member Gard said she was glad to have the opportunity to review the situation and that she now feels very comfortable about making a decision. Mrs. Gard stated there is no question that the properties need to be included in the Assessment District and that there is a direct benefit to the Harter and Rother properties . She would be in favor of voting for a resolution to readjust the assessments and increase the City' s participation. She added that since both property owners will be compensated by Mr. Stokes, they will not be damaged finan- cially. Councilman Demsher said there is a benefit to both parties who opposed these proceedings and he is in favor of the Assessment District. Mayor Pugh stressed the need to act on this project. He assured Mr. Harter and Mr. Rother that the City will help them resolve as many problems as possible. The following documents were submitted for filing and adoption: 7/9/81 279 Resolution - Overruling Protests MOTION: Made by Councilman Kirkpatrick, seconded by Councilman Demsher that Resolution No. 81-148 be adopted, a resolution of the City Council of the City of Redding overruling written and oral protests in the Hartnell Avenue Assessment District No. 111 1980-3. Voting was as follows : Ayes: Council Members - Demsher, Fulton, Gard, Kirkpatrick, and Pugh Noes: Council Members - None Absent: Council Members - None Resolution No. 81-148 is on file in the office of the City Clerk. Amended Engineer' s Report Resolution - Approving Amended Engineer' s Report MOTION: Made by Councilman Demsher, seconded by Councilwoman Gard that Resolution No. 81-149 be adopted a resolution of the City Council of the City of Redding approving the Amended Engineer' s Report in Hartnell Avenue Assessment District No. 1980-3. Voting was as follows: Ayes : Council Members - Demsher, Fulton, Gard, Kirkpatrick, and Pugh Noes: Council Members - None Absent: Council Members - None Resolution No. 81-149 is on file in the office of the City Clerk. Resolution - Authorizing Changes in Work MOTION: Made by Councilwoman Gard, seconded by Councilman Demsher that Resolution No. 81-150 be adopted, a resolution of the City Council of the City of Redding authorizing changes in work in Hartnell Avenue Assessment District No. 1980-3 . Voting was as follows: Ayes : Council Members - Demsher, Fulton, Gard, Kirkpatrick, and Pugh Noes : Council Members - None Absent: Council Members - None Resolution No. 81-150 is on file in the office of the City Clerk. Resolution - Establishing Bond Reserve Fund MOTION: Made by Councilman Demsher, seconded by Councilwoman Gard that Resolution No. 81-151 be adopted, a resolution of the City Council of the City of Redding establishing bond reserve fund in Hartnell Avenue Assessment District 1980-3 . Voting was as follows: Ayes : Council Members - Demsher, Fulton, Gard, Kirkpatrick, and Pugh Noes : Council Members - None Absent: Council Members - None Resolution No. 81-151 is on file in the office of the City Clerk. Resolution - re Foreclosure of Delinquent Assessment Liens MOTION: Made by Councilman Demsher, seconded by Councilwoman Gard that Resolution No. 81-152 be adopted, a resolution of the 7/9/81 280 City Council of the City of Redding re foreclosure of delinquent assessment liens in Hartnell Avenue Assessment District 1980-3. Voting was as follows : Ayes : Council Members - Demsher, Fulton, Gard, Kirkpatrick, and Pugh Noes : Council Members - None Absent: Council members - None Resolution No. 81-152 is on file in the office of the City Clerk. City Attorney Hays clarified that it is Council ' s instruction that staff contact Mr. Harter and Mr. Rother regarding benefit and readjustment of assessments . Mayor Pugh said this is correct and that after discussions with Special Bond Counsel Sperry, he feels this action is appro- - priate. Mayor Pugh asked Mr. Harter if he understands what has taken place and he advised that he does . Mr. Rother was not present. Mr. Stokes asked that he be advised of these negotiations and that he be allowed to be present. Mayor Pugh advised Mr. Stokes that his attorney, Mr. Wingate will be advised of all negotia- tions. Mayor Pugh asked Mr. & Mrs. Harter if they were represented by counsel or should they be contacted directly by staff regarding these negotiations. The Harters said they were not represented by counsel at this time. EXECUTIVE SESSION At the hour of 4 : 11 P.M. , Council adjourned to an executive session.
