HomeMy WebLinkAbout _ 9.15(b)--180 day wait exception to re-hire Sheri DeMaagd, Assistant City Manage CITY OF REDDING REPORT TO THE CITY COUNCIL Recommendation Adopt Resolution approving a 180-day wait period exception and single interim appointment of Sheri DeMaagd as Assistant City Manager for the City of Redding pursuant to Government Code sections 7522.56 and 21221(h), effective February 21, 2023, for up to 1,040 hours; and granting the City Manager authority to execute the necessary hiring documentation. The resolution, if approved, would allow retired Assistant City Manager/Personnel Director, Sheri DeMaagd, to be rehired as an annuitant in the City Manager’s Office to assist with the implementation of the City-wide Enterprise Resource Planning system (ERP). Fiscal Impact The estimated salary cost for allowing the City Manager’s Office to hire the retired annuitant on a temporary basis of approximately 1,040 hours, not to exceed 960 hours per fiscal year, between Fiscal Year 2022-23 and Fiscal Year 2023-24, would be up to approximately $107,088.80. Alternative Action The City Council could choose not to adopt the attached resolution, and a retired annuitant will not be hired to assist with the ERP special project. Background/Analysis Assistant City Manager/Personnel Director, Sheri DeMaagd, retired from the City of Redding (City) on February 3, 2023, after 15 years of City service. The City is in the process of filling the vacancy created by Ms. DeMaagd’s retirement. Ms. DeMaagd possesses over 15 years of extensive knowledge of the City’s policies and procedures. Her role as the Assistant City Manager/Personnel Director has provided her with an in-depth understanding of how the City operates as a whole, which has been instrumental in the ERP project. Ms. DeMaagd’s title will be Assistant City Manager during her employment as a retired annuitant. Although Ms. DeMaagd will have the title of Assistant City Manager, as a retired annuitant, she will not be assuming all of the roles and responsibilities of that position. Environmental Review This is not a project defined under California Environmental Quality Act (CEQA), and no further action is required. Attachments ^Resolution DeMaagd PAF Resolution No. 2023-________ February 7, 2023 RESOLUTION FOR EXCEPTION TO THE 180-DAY WAIT PERIOD GC sections 7522.56 & 21224 WHEREAS, in compliance with Government Code section 7522.56 the Redding City Council must provide CalPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, Sheri DeMaagd retired from the City of Redding in the position of Assistant City Manager/Personnel Director, effective February 3, 2023; and WHEREAS, section 7522.56 requires that post-retirement employment commence no earlier than 180 days after the retirement date, which is August 2, 2023, without this certification resolution; and WHEREAS, section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirement-related incentive; and WHEREAS, the Redding City Council, the City of Redding and Sheri DeMaagd certify that Sheri DeMaagd has not and will not receive a Golden Handshake or any other retirement- related incentive; and WHEREAS, the Redding City Council hereby appoints Sheri DeMaagd as an extra help retired annuitant to lead the Personnel modules of the City’s Enterprise Resource Planning project under Government Code section 21224, effective February 21, 2023; and WHEREAS, the entire employment agreement, contract or appointment document between Sheri DeMaagd and the City of Redding has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and WHEREAS, the maximum monthly base salary for this position is $17,848.00 and the hourly equivalent is $102.97, and the minimum monthly base salary for this position is $13,729.00 and the hourly equivalent is $79.21; and WHEREAS, the hourly rate paid to Sheri DeMaagd will be $102.97; and WHEREAS, Sheri DeMaagd has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; and THEREFORE, BE IT RESOLVED THAT the Redding City Council hereby certifies the nature of the appointment of Sheri DeMaagd as described herein and detailed in the attached employment agreement/contract/appointment document and that this appointment is necessary to lead the Personnel modules of the City’s Enterprise Resource Planning project. Ms. DeMaagd’s title will be Assistant City Manager during her employment as a retired annuitant. Although Ms. DeMaagd will have the title of Assistant City Manager, she will not be assuming all the roles and responsibilities of that position. CREATE HELP DESK TICKET: Creating an IT Help Desk ticket is a required step in the onboarding and offboarding of employees. Employees cannot be assigned computer permissions and an electronic access key badge unless they are entered into the active directory via a help desk ticket. Changes to computer access and facility access for separating employees should be completed on the effective date of the separation. E.
