SUBJECT: 4.6(a)--Agreement for the construction, operation, and maintenance of
recreational facilities at the future schoollocated in the Shastina Ranch develo ment.
Recommendation
Authorize and approve the following actions regarding Parcel A, a 7.88-acre property of the
Silverstone Unit 2 (AMND-2020-01135, 5-2019-00280) map recordation of Book 25 of Map,
Page 37:
(1) Approve the Agreement for the Construction, Operation, and Maintenance of
Recreational Facilities at the Future School in the Shastina Ranch Development
(Agreement) for the construction of a future school in the Shastina Ranch Development
with the Pacheco Union School District (District);
(2) Direct staff to prepare, and the Mayor to execute, a deed to transfer ownership of the
property to the District in compliance with the State of California Housing and
Community Development Surplus Land Act.
Fiscal Impact
The value of the fees that would have been paid, to the park fund if there was no school project,
is approximately $1 million. The proposed agreement with the District provides for joint use of
the school facilities over a 30-year period, the value of which is estimated at $1 million.
Therefore, there is no net impact to the City over the term of the agreement. A grant for field
lighting is expected to cover the $150,000 necessary for installation. Should funding be needed
for the lighting installation, th�request will be made of the City Council at a future time.
Alternative Actzon
The Council could choose not to approve the agreement, change the terms of the joint use
agreement, or provide staff with alternate direetions.

Background/Analysis
Joint use of school-owned facilities with municipal recreation departments maximizes use for the
cominunity in publicly-funded facilities. The City of Redding's (City) Parks Master Plan and the
General Plan both promote joint use agreements at school facilities.
The Shastina Ranch master plan development, which includes three subdivisions, is located
south of Rancho Road, straddles the new Shasta View Drive extension, and wi11 include over 800
homes at full build-out. During the project entitlement process, staff consulted with school
representatives at the District on the need for a new schooL The District responded affirmatively
regarding the need for a new campus. This information was shared with the developer, and a
location was designated. The school-park site was included in the Public Facilities section of the
Shastina Ranch Environmental Impact Report (EIR), which was adopted in 2005. As such,
additional environmental review is not necessary at this time.
During the entitlement process, the City obtained four and one-third (4.33) acres through park
dedication and reserved an additional three and one-half (3.5) acres through the reservation
process for future purchase. The District also reserved 6.15 acres for purchase from the
developer.
The District's Board of Trustees is ready to start the lengthy process of constructing the new
school and has retained a consultant to assist with the state approval and funding processes. The
next steps require that the City's property be transferred to the District and the Council's
approval of the joint use agreement. The District will conduct a comprehensive site planning and
environmental review prior to construction.
Highlights of the agreement include:
• The City will transfer approximately seven and three-quarters ('7.75) acres of land to
Pacheco School District.
• The term of the agreement is 30 years of use once the school is opened. The City will be
provided 550-600 hours of field use and 750-800 hours of gym use annually.
� If the school is not built within 20 years of the agreement execution, Pacheco School
District will return the 7.75-acre property to the City.
• The City has the option to pay for all or a portion of the cost of�ield lighting if it is not
funded by the State of California.
• The City will have �irst rights to use the facilities outside of the school's usage.
� A pro-rated million-dollar penalty is included if the City is not provided the required use
hours.
The Community Services Advisory Commission has reviewed and endorsed the agreement. The
City Attorney has reviewed and approved the agreement as to form. The District Board of
Trustees has also approved the agr��ment.
On November 15, 2022, The Council adopted Resolution 2022-123 declaring Parcel A, 7.88-acre
property of the Silverstone Unit 2 (AMND-2020-01135, 5-2019-00280) map recordation of
Book 25 of lVlap, Page 37, as "Exempt Surplus." The resolution also authorized the City
Manager, or designee, to adhere to reporting and approval guidelines pursuant to the State of

California Housing and Community Development (CA HCD) Surplus Land Act Guidelines
Section 400(e). The request was submitted to CA HCD on December 8, 2022, with follow-up on
January 12, 2023. No response was received within the initial 30-day response window, which
allows the Council to proceed with the transaction.
Environmental Review
On June 15, 2005, the Council held a public hearing and adopted a resolution approving the
Tentative Subdivision Map Application (5-7-03) and Planned Development Application (PD-S-
04) for the Shastina Ranch Subdivision Project after adopting a resolution certifying the
completeness and adequacy of the Environmental Impact Report, EIR-1-03, on April 15, 2005.
On March 11, 2008, after a public hearing was held, the Planning Commission adopted a
Mitigated Negative Declaration and approved the Tentative Subdivision Map Application (5-09-
OS) Stonesfair Subdivision.
Condition 61 of the Stonesfair Subdivision Map (5-09-OS) and Condition 45b of the Silverstone
(formerly Stonescreek) Subdivision Map (5-2019-00280) require the developer to make an
irrevocable offer of dedication (minimum 7.55 acres) to the City in fee simple absolute. The
Stonescreek Subdivision Application was approved, and a mitigated negative declaration was
adopted after a public hearing was held by the Planning Commission on October 22, 2019. No
further action is required at this time.

THIS AGREEMENT is made and entered into by and between the City of Redding, hereinafter
referred to as "City" and the Pacheco Union School District, hereinafter referred to as "District."
WITNESSETH:
E AS,Calzfornia Education Code section 10900 et seq.authorizes cities and school districts
to organize, promote, and conduct programs of community recreation that contribute to the
attainment of general educational and recreatzonal objectives for children and adults of the Statea
E AS, the District plans to construct a new school campus at the location identified in
Exhibit A within the Stonecreek and Stonesfair subdivisions;
E AS,the City owns Parcel A as described in Exhibit 1 available for use by the Distr►ct;
WHEREAS, the City seeks use of District's recreational facilities at this new campus for
community use outside of school hours;
E AS, it is the desire of the City and the District to enter into an agreement for the joint use
of the new gymnasium and athletic fields to be constructed at the future school campus as
hereinafter set forth:
N ,T E F E,the parties hereto agree as follows:
1. Constructian. The District plans to construct an elementary school with State Facility
Funds and local bond proceeds. The campus will include an indoor gymnasium with two
courts and lighted athletic fields of such a dimension to offer soccer and baseball�softball
fields ("Recreational Facilities"). The Office of Public School Construction's ("CJPSC")
School Funding Program ("SFP") provides funding to assist school districts in the
construction of school facilities, and can provide up to one-half of the costs of newly
constructed facilities. Ifthe athletic field lighting fixtures are approved for SFP funding,the
City will subject to City approval of the low bid consistent with this Section pay for the
remainzng one-half of costs to construct the athletic field lzght fixtures. Should OPSC not
approve the athletic field lighting fixtures as eligible for SFP matching,the City will subject
to City approval of the low bid consistent with this Section be responsible for the full amount
of costs attributed to the construction and maintenance of all athletic field lightzng fixtures.
The City will review and provide input on those portions of the plans related to the field
lighting fixtures prior to publishing for bidding. The City's review of the plans shall not

take longer than ten(10) business days. The fteld lighting fixture item will be identifted out
as a unique alternative addition line item in the bid document. (Jnce the lowest responsible
bidder is determzned, the City will, within fifteen (15) business days, determine to pay for
the light fixtures or not. If the City determines not to pay for the lighting or does not make
a determination within fifteen(15)business days,the District is not required to include them
in the project.
2. Ownership. Legal title to the Recreational Facilities and the related amenities shall be held
by the District, and the District shall be responsible for the maintenance of the Recreational
Facilities and the costs of any repairs thereto. City shall transfer ownership of City-owned
parcels, a total of 7.75 acres to District within ninety (90) days of signed Joint Use
Agreement.
3. Maintenance of Recreation Facilities. District shall maintain all Recreational Facilities
in a safe and playable condition. After use by the City, the City will return the Recreational
Facilities in the same condition as received from the District,normal wear and tear excepted.
If extraordinary custodial services are required, as determined by the District, the District
shall bill the City at cost for materials and supplies. The City shall pay such invoice in full
within thirky (30) days of receipt. The District shall be responsible for the cost of utilities.
4. Use of Recreational Facilities.The City will have priority use of the Recreational Facilities
before other non-schooI users when their use is not required by the District for thirty (30)
years from the date of this Agreement. Generally, the Recreational Facilities will be
available for City use after 5:30 p.m. on weekdays and throughout the weekends. The
District will endeavor to nnake the Recreational Facilities available for City use when such
use will not conflict with District uses. The District shall at all times have priority use of the
Recreational Facilities.
It is recognized that some City uses, such as league basketball, require advance scheduling.
The Distrzct and the City will cooperate with scheduling to attempt to secure maximum use
of the Recreational Facilities. Prior to each school year and as the need may arise,the parties
will meet to discuss scheduling and the City shall be given a calendar depicting the days
and times reserved for the Czty. The City may request additional time as the need may arise.
In that event, the District will attempt to accommodate the City's request.
The District hereby commits to providing City with not less than 550 but not more than
600 hours of field use and not less than 750 but not more than 8Q0 hours of gym use. Use
beyond the hours set forth herein may result in additional charges.

volunteers as required by state law.

6. Security. The City shall maintain security of the Recreational Facilities during the hours
that it is using them.At all other time security shall be the responsibility of the District. The
City shall be solely responsible for the loss or damage of any of its property or the property
of its employees, agents, or invitees during the hours the Czty uses the Recreational
Facilities.
7. Ter , efault and Ter ination.
a. Faczl�ties constructed. The term of this Agreennent is thirty (30) years from the
date of this Agreement.
z. Default Under this Agreement. Failure to perform any covenant or
provision of this Agreement including but not limited to the minimum
hours set forth in Section 4, if the failure to perform is not cured within
thirty (30) days after delivery by either District or City to the
other of written notice. If the failure to perform cannot reasonably be
cured within thirky (30) days, subject party shall not be in default of this
Agreement if subject pariy commences to cure the failure to perform within
the thirty (30) day period and thereafter diligently and in good faith
prosecutes the cure to completion in no later than 30 additional days.
ii. Damages. The Parties to this Agreement recognize a Material Breach by
the District will result in damages to the City."Material Breach"shall mean
the District's early termination of this Agreement without cause.
Furthermore,the Parties recognize the delays, expense,and difficulties and
uncertainty involved with proving in a legal proceeding the actual loss
suffered by the City in the event of the District's Material Breach of this
Agreement. Accordingly, the Parties agree that as liquidated damages for
District's Material Breach ofthis Agreement,the District shall pay the City
the sum of $1 million from the date this Agreement is terminated by
District. District hereby agrees that the said liquidated damages are not
manifestly unreasonable under the czrcumstances and agrees that such sum
is not intended as a penalty. The total sum of liquidated damages shall be
amortized over the remaining life of this Agreement. The amount of
liquidated damages shall be reduced by 3.3 percent per year throughout the
term of this Agreement. Terminations may be prorated accordingly.
b. Failure to Construct. The District intends to construct the school including the
athletzc facilities within twenty (2Q) years from the date of this agreement. The
term may be extended by mutual agreement of the two parties. If the agreement is
terminated for failure to construct functioning athletic fields and gymnasium within
twenty years from the date of this agreement, the District will transfer without
payment titie to Parcel A back to the City. In the event of such termination,the City

shall not be entitled to liquidated damages pursuant to Section 7(a)(ii) of this
Agreement.
8. Hold Harmless by District. The District covenants and agrees that the City, its officers,
officials, employees, agents, and volunteers, shall be free from any and a11 liability and
claims for damages for personal injury, death, or property damage in any way connected
with the District's use of the Recreational Facilities, including claims of the District, its
officers, officials, employees, agents, and students. The District shall indemnify and save
harmless the City, its officers, officials, employees, agents, and volunteers, from any and
all liability, loss, cost, or obligation on account of or arising out of any such injury, death,
or loss caused by the negligence or other legal fault of the District or its officers, officials,
employees, agents, and students.
9. Hold Harmless by City. The City covenants and agrees that the District, its officers,
officials,employees,agents,and students, shall be free from any and all liability and claims
for damages for personal injury, death, or property damage in any way connected with the
City's use of the gymnasiums and athletic fields, including claims of the city, its officers,
officials, employees, agents, and volunteers. The City shall indemnify and save harmless
the District, its officers, officials, employees, agents, and students, from any and all
liability, loss, cost, or obligation on account of or arising out of any such injury, death, or
loss caused by the negligence or other legal fault of the City or its officers, officials,
employees, agents, and volunteers.
10. Liability Insurance. The City and the District shall each separately insure their respective
; liability occasioned by their respective use of the gymnasium and athletic fields.
11. Amendments.No changes,amendments,or alterations to this Agreement shall be effective
unless in writzng and signed by the parties hereto.
12. Notice. Any notices or demands that may be given by either party hereunder shall be
deemed to have been fully and properly given when made in writing, enclosed in a sealed
envelope, and deposited in the United States Post Office, certified mail, postage prepaid,
addressed as follows:

13. Entire Agreement af Parties. This Agreement constitutes the entire agreement between
the Parkies and supersedes all prior discussions,negotiations,and agreements,whether oral

or written. Thzs Agreement may be amended or modified only by a written instrument
executed by both parties.
14. California Law. This Agreement shall be governed by and the rights, duties, and
obligations of the Parties shall be dete ined and enforced in accordance with the laws of
the State of California. The Parties further agree that any action or proceeding brought to
enforce the terms and conditions of this Agreement shall be maintained in Shasta County,
California.

SUBJECT: 4.11(g)--Approve Final Maps and Execute Subdivision Agreements for

Recommendation
Authorize the following actions relative to Silverstone Subdivision, Unit 2, (��MND-2020-
01135, 5-2019-00280) and Shastina Ranch Subdivision, Unit 5 (5-7-03/PD-5-04):
(1) Approve the final maps and authorize the Mayor to execute a Subdivision Agreement
with Sierra Pacific Land and Timber Company; and direct the City C1erk to file the maps
with the Shasta County Recorder;
(2) Adopt Resolution approving and adopting the 63rd Amendment to the City Budget
Resolution No. 2021-078 appropriating $160,730 from Park In-Lieu/Southeast Quadrant
to purchase 3.56 acres of land; and
(3) Authorize payinent of $160,730 to the Sierra Pacific Land and Timber Company
(Developer) for 3.56 acres of land, described as Parcel A of the Silverstone Unit 2 final
map, upon recordation of the fmal subdivision map.
Fiscal Impact
Approval of the final map for Silverstone, Unit 2, and Shastina Ranch, Unit 5, will have a
cumulative impact to the Public Works Department due to the increase in public-street
infrastructure requiring annual maintenance, especially the asphalt pavement. The project will
generate an incremental increase in state gas-tax funds based on population and point-of-origin
sales; however, the increase i.n these revenues falls short of the anticipated annualized
maintenance cost.
In addition, there will be an incremental increase in the City of Redding (City) utilities costs due
to the additional infrastructure. Generally, except for the Storm Drain Utility, suf�cient revenue
is generated by monthly use charges to offset any increase in annual maintenance costs. The
Storm Drain Utility is challenged with i.ncr�asing requirements that current rates do not cover.

The recommended budget resolution allocates $160,730 of Park In-Lieu funds (Southeast
Quadrant), leaving a remaining fund balance of$472,576 (Southeast Quadrant) and $1,$46,201
respectively in the overall Park In-Lieu fund. There wi11 be no impact to the General Fund.
Alter�native Action
The City Council (Council) may choose not to approve staff recommendations which will
require a finding that the subdivision is not being developed in accordance with the conditions of
the approved tentative map or in conformance with the State Subdivision Map Act. In addition, it
would not allow the transfer and purchase of 3.56 acres of property to the existing subdivision
parkland. The Council could then provide staff alternative direction.
Background/Analysis
Silverstone Subdivision, Unit 2
The Silverstone Subdivision, Unit 2 (��MND-2020-01135, 5-2019-00280), was approved by the
Planning Commission on September 22, 2020. Attached is a map showing the subdivision, which
is located south of Rancho Road and Shasta View Drive.
The developer, Sierra Pacif'ic Land and Timber Company, has submitted the fmal map and all
other required data, which has been checked and approved by various City departments.
Relevant subdivision map conditions of approval have been met with the exception of some
portions of the roadway conditions (arterial wall, pouring curb/gutter/sidewalk, centerline
monument survey, street name signs, utility manhole, street lights and valve grade adjustments).
The developer has agreed to the execution of a subdivision agreement, has committed to
completing these conditions, and has submitted a related security in the amount of$391,75$ for
the remaining work. The developer has been informed that no occupancy permits will be granted
for residences constructed on lots until all related subdivision agreement conditions have been
met.
Shastina Ranch Subdivision, Unit 5
The Shastina Ranch Subdivision, Unit 2 (5-7-03/PD-5-04), was approved by the Planning
Commission on July 16, 2005. Attached is a map showing the subdivision, which is located
south of Rancho Road and Shasta View Drive.
The developer, Sierra Pacific Land and Timber Company, has submitted the final map and all
other required data, which has been checked and approved by various City departments.
Relevant subdivision map conditions of approval have been met with the exception of some

Park Resolution
The Shastina Ranch Master Plan includes land dedications and land reservations to form a park
facility at the location identified as Parcel A on the Silverstone Unit 2 final map. The park land
includes 7.88 acres of land, of which 4.32 is land dedication. This was dedicated per the
California Quimby Act, Subdivision Map Act (SMA) Section 66477, that allows a City to
require dedication of land at 510 square feet per lot. Acreage in excess of that amount must be
reserved through the entitlement process and purchased following the map recordation. As such,
3.56 acres of land will be purchased from the developer at $160,730 following the fmal map
recordation. The valuation of the property is also outlined in the Quimby Act. The City Attorney
has reviewed this arrangement.
Environmental Review
On June 15, 2005, the Council held a public hearing and adopted a resolution approving the
Tentative Subdivision Map Application (5-7-03) and Planned Development Application (PD-S-
04) for the Shastina Ranch Subdivision Project after adopting a resolution certifying the
completeness and adequacy of the Environmental Impact Report, EIR-1-03, on April 15, 2005.
On March 11, 2008, after a public hearing was held, the Planning Commission adopted a
Mitigated Negative Declaration and approved the Tentative Subdivision Map Application (5-9-
OS) Stonesfair Subdivision.
Condition 61 of the Stonesfair Subdivision Map and Condition 45a of the Silverstone (formerly
Stonescreek) Subdivision Map (5-2019-0280) require the developer to make an irrevocable offer
of dedication (minimum 7.55 acres) to the City in fee simple absolute. The Stonescreek
Subdivision Application was approved and a mitigated negative declaration was adopted after a
public hearing was held by the Planning Commission on October 22, 2019. No further action is
required at this time.

SUBJECT: 4.6(b) - Shastina Ranch Surplus Property Act
Recomrrcendation
Adopt Resolution declaring Parcel A, 7.88-acres located in the Silverstone Unit 2 (AMND-
2020-01135, 5-2019-00280) map recordation of Book 25 of Maps, Page 37, and described in
Exhibit l, as `Bxempt Surplus"; and authorizing the City Manager to adhere to reporting and
approval guidelines pursuant to the State of California Housing and Community Development
Surplus Land Act Guidelines Section 400(e).
Fiscal Impact
There is no fiscal impact to declaring the listed property as Exempt Surplus.
Alternative Action
The City Council (Council) could decline to adopt the resolution, and, therefore, not declare the
7.88-acre property as Exempt Surplus. In this case, the property could not be transferred to the
Pacheco Union School District (District), and the District's desire to build a K-8 school campus
with gymnasium and lighted athletic fields would not be feasible at this location.
Background/Analysis
On January 1, 2020, updates to legislation known as the Surplus Property Act (Assembly Bill
1486) were enacted by the State of California, redirecting the process by which cities dispose of
public land. Prior to disposal, the land must be declared "Surplus" or"Exempt Surplus." The Act
requires that public property is offered to build affordable housing before marketing the
properties for sale to the private sector. Developers may request to be notified of the available
surplus property via the California Department of Housing and Community Development (HCD)
website. Each year, the City of Redding (City) is also required to provide an updated list of its
surplus prop�rties to I-ICD; approval is required from HCD before concluding any property
disposition. The City may seek to designate a property as Exempt Surplus, if the eircumstanees

comply with HCD's guidelines. One of such guidelines is Government Code section
54221(f)(1)(D) which provides that surplus land is exempt when a local agency is transferring
the surplus land to another local, State, or federal agency for the receiving agency's use, as is the
case with this proposal.
The Shastina Ranch Master Plan includes land dedications and land reservations to form a school
facility at the location identified as Parcel A on the Silverstone Unit 2 final map. The school's
location is identified as Parcels A and B on the attached map. The land was acquired per the
California Quimby Act, Subdivision Map Act (SMA) Section 6647'7, which allows the City to
require the dedication of land at 510 feet per lot for recreation purposes. Acreage in excess of
that amount must be reserved through the entitlement process and purchased following the map
recordation, as outlined in the attached October 18, 2022, Council meeting staff report.
The attached Resolution declares the 7.88-acre parcel as Exempt Surplus and authorizes the City
Manager to execute the necessary documents to facilitate the transfer of the property to Pacheco
Union School District.
Environmental Review

04) for the Shastina Ranch Subdivision Project after adopting a resolution certifying the
