A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE AGREEMENT BETWEEN THE CITY OF REDDING AND
ROBERT D. HASTINGS FOR CONSULTING SERVICES FOR THE
DEPARTMENT OF GENERAL SERVICES, SOLID WASTE DIVISION, NOT
TO EXCEED $6,000, AND AUTHORIZING THE MAYOR TO SIGN ON
BEHALF OF THE CITY.
IT IS HEREBY RESOLVED by the City Council of the City of Redding
as follows:
1. That the City Council of the City of Redding hereby
approves the Agreement between the City of Redding and Robert D.
Hastings for consulting services for the Department of General
Services, Solid Waste Division, not to exceed $6,000.00, a true copy
of which is attached hereto and incorporated herein by reference.
2. That the Mayor of the City of Redding is hereby authorized
and directed to sign said Agreement on behalf of the City of Redding,
and the City Clerk is hereby authorized and directed to attest the
signature of the Mayor and to impress the official seal of the City
of Redding thereto.
I HEREBY CERTIFY that the foregoing Resolution was introduced
and read at a regular meeting of the City Council of the City of
Redding on the 6th day of November , 1990, and was duly adopted at
said meeting by the following vote:

= AGREEMENT
•
THIS AGREEMENT is made and entered into as of . the day
of November, 1990, by and between the CITY OF REDDING, a Muni-
cipal Corporation and General Law City, hereinafter referred to
as "City," and ROBERT D. HASTINGS, 1906 Bechelli Lane, Redding;
California 96002, hereinafter referred to as "Consultant";
WITNESSETH:
WHEREAS, as an Associate Civil Engineer for the City of
Redding, Consultant has provided engineering services for the
Solid Waste Division for the past 20 years; and
WHEREAS, Consultant has just retired as an Associate Civil
Engineer for the City of Redding, and City needs and desires the
historical continuity and experience in Solid Waste activities
which Consultant can provide; and •
WHEREAS Consultant is ready and willing to provide such
service for as long as Redding requires same:
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the
parties hereto as follows:
1. Consultant shall perform, on an as-needed basis begin-
ning November 7, 1990, engineering services for the City through
its General Services Department, Solid Waste Division, under the
. direction of the City Manager. Said services shall include, but
not be limited to:
* Engineering Estimates. Updating various estimates per-
taining to the transfer station--site acquisition, design,
construction, etc.
* Transfer Station Design. Preparing a Request for
Proposal for £)design engineer, evalua lg the proposals,
awarding the project for design, and monitoring the design.
* Transfer Station Construction. Preparing bid specifi-
cations for the construction project, evaluating the
proposals, awarding the contract, . and monitoring the project.
2. The term of this Agreement shall be for one year. from
the date of execution of this Agreement and approved by City
Council, and thereafter may continue on a month-to-month basis
until terminated by either party hereto.
3. City shall provide secretarial/technical services (from
the staff of the General Services and Public Works Departments)
and transportation for Consultant, as required.
4. It is anticipated that Consultant will perform said
services on an as-needed basis on behalf of City. The
compensation to be paid by City to Consultant for the authorized
services to be performed by him is the sum of Thirty-seven
Dollars and Fifty Cents ($37.50) • per hour. In no event shall
the total compensation to be paid Consultant under this
Agreement exceed $6,000.
5. This Agreement is granted upon the express condition
that City shall be free from any and all liability and claims
for damages for personal injury, death, or property damage in
any way connected with Consultant's services to be performed
hereunder, including claims of Consultant. Consultant shall
indemnify and save harmless the City, its officers, agents, and
employees, from any and all liability, loss, cost, or obligation
on account of or arising out of any such injury, death, or loss
caused by the negligence or other legal fault of Consultant.

6. .The words "City Manager" as used throughout this
Agreement shall mean the City Manager of City, or his designate.
7. This Agreement does not constitute a hiring of
Consultant by City. It is understood and agreed between the
parties hereto that Consultant, in carrying out the services to
be performed hereunder, is acting as an independent contractor
and not as an employee of the City of Redding.
8. Either party may terminate this Agreement at any time
upon thirty (30) days' written notice to the other party, in
advance.
9. Any notices or demands that may be given by either party
hereunder shall be deemed to have been fully and properly given
when made in writing, enclosed in a sealed envelope, and
deposited in the United States Post Office, certified mail,
postage prepaid, addressed as follows: to City c/o City
Manager, 760 Parkview Avenue, Redding, California 96001-3396;
and to Consultant at 1906 Bechelli Lane, Redding, California
96002.
10. It has been determined that this matter is not subject
to the provisions of the California Environmental Quality Act.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the day and year first above written.
