HomeMy WebLinkAboutReso 1990-574 - Adopting Interim Review and Approval Process for Solid Waste Facilities 411 RESOLUTION NO. `IO -S I RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING AN INTERIM REVIEW AND APPROVAL PROCESS FOR CERTAIN SOLID WASTE FACILITIES. WHEREAS, Assembly Bill (AB) 939 , Chapter 1095 , Statutes of 1989, repealed the statutory authority for all County Solid Waste Management Plans (CoSWMP) , and directed the formation of local task forces to develop Integrated Waste Management Plans for each county; and WHEREAS, AB 2296 , Chapter 1617 , Statutes of 1990 , requires each county and the cities in the county to establish a process for planning, approving, and siting new or expanded solid waste facilities during the "Gap" period between the repeal of the CoSWMPs and the approval of the new Integrated Waste Management Plans; and WHEREAS, if the proposed facility was in the CoSWMP, or if it is a landfill, transformation facility, or transfer station not designed to recover material for recycling, the county and cities representing a majority of the incorporated area population may approve the facility by resolution through the normal review and approval process which was used for CoSWMP amendments; and WHEREAS, if the county and cities fail to approve the process described above, such facilities will be subject only to review and DJ approval by the local task force for the Integrated Waste 1S) Management Plan; and WHEREAS, it is deemed to be in the best interests of Shasta County to have the review and approval authority for such facilities remain with the county and cities; NOW, THEREFORE, BE IT RESOLVED THAT any proposed or expanded solid waste facility that was included in the County Solid Waste Management Plan, or is a landfill, transformation facility, or transfer station, shall be reviewed and approved by the Board of Supervisors and the City Councils of the cities representing a majority of the incorporated area of the county.
