HomeMy WebLinkAboutReso 1990-571 - Arrangement for Legal Assistance Regarding Water Rights Applications RESOLUTION NO. 90 -s7/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING CONTINUING ITS ARRANGEMENT WITH McDONOUGH, HOLLAND AND ALLEN FOR LEGAL ASSISTANCE REGARDING WATER RIGHTS APPLICATIONS IN WORK ASSOCIATED WITH STATE WATER RIGHTS FOR THE SPRING CREEK PUMPED STORAGE PROJECT, NOT TO EXCEED $30 ,000 . 00 . WHEREAS, application for water rights is a critical part of the process to obtain development rights for the Spring Creek Pumped Storage Project; and WHEREAS, the law firm of McDonough, Holland and Allen has been working closely with the City on the Spring Creek Pumped Storage Project, and has satisfactorily provided the legal assistance needed since 1984 ; and WHEREAS, it is in the best interests of the City of Redding to obtain outside legal assistance regarding water rights appli- cations, which is a very specialized area of law; and WHEREAS, the Electric Department recommends that the City continue to utilize the assistance of McDonough, Holland and Allen to obtain the appropriate water rights for the Spring Creek Pumped Storage Project; NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby authorizes the expenditure of up to $30 ,000. 00 (included in the 1989 Electric System Project Financing) for legal services to be provided by McDonough, • • • Holland and Allen for work associated with State water rights for the Spring Creek Pumped Storage Project.
