RESOLUTION NO. 2022-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING PARCEL A 7.88 -ACRE PROPERTY OF THE SILVERSTONE SUBDIVISION, UNIT 2 AS EXEMPT SURPLUS PROPERTY AND AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO NEGOTIATE THE TERMS OF THE TRANSFER OF OWNERSHIP AND EXECUTE ANY OTHER DOCUMENTS NECESSARY WITH THE PACHECO UNION SCHOOL DISTRICT WHEREAS, The Silverstone Subdivision, Unit 2 (ANIND-2020-01135, S-2019-00280), was approved by the Planning Commission on September 22, 2022; and WHEREAS, Council approved the final maps and authorized the Mayor to execute a Subdivision Agreement with Sierra Pacific Land and Timber Company; and direct the City Clerk to file the maps with the Shasta County Recorder; and WHEREAS, On October 31, 2022, the Silverstone Unit 2 (AN4ND-2020-01135, S-2019- 00280) map was recorded (Book 25 of Map at Page 37), attached and incorporated herein, dedicated Parcel A (7.88 acres) in fee to the City of Redding; and WHEREAS, Sierra Pacific Land and Timber Company was required by Condition 61 of the Stonesfair Subdivision Map (S-09-05) and Condition 45b of the Silverstone (formerly Stonescreek) Subdivision Map (S-2019-00280) to dedicate a portion of the above identified subdivision map for school purposes; and WHEREAS, as a consequence of the specific purpose of the dedication for school purposes the property is not available to the City of Redding for any other use, including affordable housing; and WHEREAS, a portion of the above described property was also offered for sale by the Sierra Pacific Land and Timber Company with the understanding that this portion of the above referenced party would also be made available to the Pacheco Union School District for school purposes such as a K-8 school campus with gymnasium and lighted athletic fields ("Recreational Facilities"); and WHEREAS, the property dedicated by means of Condition 45a of S-2019-00280 and the property purchased from Sierra Pacific Land and Timber Company are collectively referenced as ("Property) herein; and WHEREAS, the City of Redding has determined that there is a need to utilize the Property to construct a K-8 school campus with gymnasium and lighted athletic fields ("Recreational Facilities") in conjunction with the school campus; and WHEREAS, the Surplus Property Act (California Government Code section 54220 et seq.) provides guidelines for local agencies to follow regarding the sale and lease of City -owned property; and WHEREAS, Government Code section 54221(a) defines "local agency" as every city, whether organized under general law or by charter, county, city and county, and district, including school districts of any kind or class, empowered to acquire and hold real property; and WHEREAS, Government Code section 54221(b) requires that a local agency shall, at a regular public meeting, declare land as either "surplus land" or "exempt surplus land" before it may take any action to dispose of the land; and WHEREAS, Government Code section 54221(t)(1)(D) provides that surplus land is exempt when a local agency is transferring the surplus land to another local, state, or federal agency for the receiving agency's use; and WHEREAS, Government Code section 54221(c)(1) provides, in pertinent part, that "agency's use" includes land that is being used to support agency work or operations; and WHEREAS, the Property is proposed for use Pacheco Union School District for its agency use because it is anticipated that the Property will be used for school purposes such as a K-8 school campus with "Recreational Facilities;" NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES HEREBY RESOLVE THAT: 1. The above recitals are true, correct, and are adopted herein as findings of fact. 2. The Property is declared exempt surplus property and shall hereafter be available for sale and lease subject to compliance with all federal grant assurances and the retention of any easement(s), if required, for public service purposes. 3. Council adopted a resolution approving the Tentative Subdivision Map Application (S-7- 03) and Planned Development Application (PD -5-04) for the Shastina Ranch Subdivision Project after adopting a resolution certifying the completeness and adequacy of Environmental Impact Report EIR-1-03 on April 15, 2005. The development of the property for school use park project was included in the approved Environmental Impact Report. 4. The City Manager shall, pursuant to State of California Housing and Community Development ("HCD") Surplus Land Act Guidelines Section 400(e), provide a copy of this Resolution to the State of California Housing and Community Development Department at least thirty days prior to disposition of the Property.
