HomeMy WebLinkAboutReso. 1983 - 112 - Abatement under chapter 9.36 of the redding municipal code ' • 1 RESOLUTION NO. 85-/( A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9. 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDDING (OWNED BY DONALD M. STOVER, JR. AND ROBERTA L. STOVER, AND LOCATED AT 1411 AND 1415 SPRUCE STREET) . WHEREAS, the provisions of Chapter 9. 36 of the Redding Muncipal Code provide that all buildings or structures located within the City of Redding which are structurally unsafe or are dilapidated from old age, neglect, decay or other causes which constitute a fire menace or are dangerous to human life or a likely resort for vagrant or dissolute persons, may be declared a nuisance by the City Council of the City of Redding and there- after abated as provided therein; and WHEREAS, the Fire Marshal of the City of Redding has made an inspection of the building located on real property as herein- after described and has declared it to be unsafe and/or a hazard to safety, health and public welfare; and WHEREAS, it has been determined that this matter is categor- ically exempt from the provisions of CEQA; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding that it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9. 36 of the Redding Municipal Code on the following described property: The real property situate in the City of Redding, County of Shasta, State of California, described as follows: 00 C,� 4 Parcel No. 1 . Lot 6 , Block 16 as shown on the Map of Park Subdivision, recorded May 25, 1936 in Book 5 of Maps at Page 12, Shasta County Records. Parcel No. 2. Beginning at a 12 inch iron pipe monument marked RE 4603 ; whence a 6"x6" concrete monument marking the Northeast corner of Lot 4 of the Lassen View Subdivision, as per plat on file in the office of the County Recorder of Shasta County, bears N. 16°08 ' 07" E. , a distance of 1683 . 27 feet; thence S. 1°36 ' W. , 140 feet; thence S. 88°24 ' E. , 50 feet; thence N. 1°36 ' E. , 140 feet; thence N. 88°24 ' W. , 50 feet to the place of beginning. BE IT FURTHER RESOLVED that said building mentioned hereinabove is hereby declared to be a public nuisance as pro- vided by Chapter 9. 36 of the Redding Municipal Code and is hereby ordered to be abated by repair, rehabilitation, demolition or removal. BE IT FURTHER RESOLVED that the Fire Marshal and the Board of Appeals of the City of Redding are hereby directed to take all proceedings provided in Chapter 9. 36 of the Redding Municipal Code. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be and hereby is authorized and directed to forward a certified copy of this Resolution to the Shasta County Recorder for recordation.
