HomeMy WebLinkAboutReso. 1983 - 101 - Approving the landmark and heritage tree plan 410 411 RESOLUTION NO. j / 0/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE LANDMARK AND HERITAGE TREE PLAN. WHEREAS, a Landmark and Heritage Tree Plan has been deve- loped by the Recreation and Parks Commission; and WHEREAS, said Plan was developed in an effort to identify and preserve those trees which meet the criteria set forth therein; and WHEREAS, a copy of said Plan is marked Exhibit "A" , attached hereto and incorporated herein by reference; and WHEREAS, the City Council deems it to be in the best inter- ests of the City of Redding to adopt such Plan; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding that the Landmark and Heritage Tree Plan established by Sections 13. 40. 010 and 13 . 40. 020 of the Redding Municipal Code , which Plan is attached hereto as Exhibit "A" , is hereby approved and shall become effective upon adoption of this resolution. BE IT FURTHER RESOLVED that the City Council of the City of Redding wishes to encourage the citizens of Redding to save designated trees and keep them in good condition and to otherwise diligently seek to implement the goals of this Plan. HAYS, ity Attorney -2- • • LANDMARK AND HERITAGE TREE PLAN OF THE CITY OF REDDING Definition: Landmark and Heritage Trees may be so designated because they are unique in being: 1 . an outstanding specimen of a desirable species; or 2 . one of the largest or oldest trees in Redding; or 3. of historical interest; or 4. of distinctive form. The Street Tree Committee of the City of Redding and/or the Director of Parks and Recreation, or his designee, are authorized to identify and prepare an inventory of all of the trees on private as well as public property in the City of Redding in determining the Landmark and Heritage Trees. City tree crews, with the permission of property owners, will physically inspect each tree for soundness and health. Objective: Landmark and Heritage Trees help make Redding a unique place in which to live, promote scenic beauty, enhance property values , reduce soil erosion, improve air quality, abate noise and provide shade to reduce energy consumption. To preserve this atmosphere, every effort should be made to preserve these Landmark and Heritage Trees. These trees should be memorialized and their noteworthiness made known to the public. Property owners and developers are asked to saved these trees and to keep them in good condition for the benefit of present as well as future citizens of Redding. A second group of trees, Trees Worth Saving, add signifi- cantly to the Redding environment but do not meet all the cri- teria of Landmark and Heritage Trees. Wherever possible, these trees should be saved and preserved with adequate care. Official Register: Upon completion of the identification and inventory of Landmark and Heritage Trees, the Director shall recommend to the City Council that an Official Landmark and Heritage Tree Register be an addendum to the existing Street Tree Plan and appropriately identify as to location, size and species the Landmark and Heritage Trees of the City of Redding. Where practicable, the street address of the property on which the tree stands shall be included as part of the location. The Director may periodically review the Register for the purpose of making additions and -3- 411 411 • deletions thereto. After review and upon notification by the Director, the City Clerk shall delete from the Official Register and notify the property owner in writing of any tree that no longer meets the requirements. Notification of Designation: Upon notification, the owner of property on which is located any tree designated in the Official Register as a Landmark and Heritage Tree would be requested not to: 1 . change the amount of irrigation provided to any Land- mark and Heritage Tree from that which was provided prior to the commencement of construction activity; 2. trench, grade or pave into the drip line area of a Landmark and Heritage Tree; 3. change by more than two (2) feet, grade elevations within thirty (30) feet of the drip line area of a Landmark and Heritage Tree; 4. park or operate any motor vehicle within the drip line area of any Landmark and Heritage Tree; 5 . place or store any equipment or construction materials within the drip line area of any Landmark and Heritage Tree; 6 . attach any signs, ropes, cables or any other items to any Landmark and Heritage Tree; 7. cut or trim any branch of a Landmark and Heritage Tree for temporary construction purposes; 8 . place or allow to flow into or over the drip line area of any Landmark and Heritage Tree any oil, fuel, concrete mix or other deleterious substance. Activities affecting Landmark and Heritage Trees: It is requested that none of the following activities be performed by the property owner or person authorized by the property owner: 1 . the removal of any Landmark and Heritage Tree; 2. pruning of any segment of a Landmark and Heritage Tree greater than thirty-six inches (36" ) in circumference or the placement of any chemical or other deleterious substance by spraying or otherwise on any Landmark and Heritage Tree. -4- • ' ~ • . • 3. disturbing the soil or placing any chemical or other deleterious substance or material on the soil within the drip line area of any Landmark and Heritage Tree. It is also requested that prior to any removal of a Landmark and Heritage Tree because of disease, that the property owner meet and confer with the Director of Parks and Recreation or his designated representative to determine whether the City can provide any assistance with the preservation of the diseased tree. Removal of Landmark and Heritage Trees : A property owner may consider the removal of a Landmark and Heritage Tree if: 1 . the Landmark and Heritage Tree must be removed in order for the applicant to use the property for any use permitted as of right or by special permit under the City of Redding Zoning Ordinance for the zoning dis- trict in which the property is located and that such use could not be made of the property unless the tree is removed; or 2. the condition of the tree with respect to disease, danger of falling or interference with utility services is such that the public health, safety or welfare require its removal; or 3. the tree or tree roots are causing or threatening to cause damage to any main structure on the owner' s property; or 4 . the tree no longer meets the criteria for a Landmark and Heritage Tree. -5-
