HomeMy WebLinkAboutReso. 1984 - 236 - Intention to begin legal proceedings of abatement under chapter 9.36 • 111 RESOLUTION NO. <53C--.. 6, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9. 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDDING (OWNED BY ROY J. WEAVER AND LOCATED AT 5831 EASTSIDE ROAD) . WHEREAS, the provisions of Chapter 9. 36 of the Redding Municipal Code provide that all buildings or structures located within the City of Redding which are structurally unsafe or are dilapidated from old age, neglect, decay or other causes which constitute a fire menace or are dangerous to human life or a likely resort for vagrant or dissolute persons, may be declared a nuisance by the City Council of the City of Redding and there- after abated as provided therein; and WHEREAS, the Fire Marshal of the City of Redding has made an inspection of the building located on real property as herein- after described and has declared it to be unsafe and/or a hazard to safety, health and public welfare; and WHEREAS , it has been determined that this matter is categor- ically exempt from the provisions of CEQA; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding that it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9. 36 of the Redding Municipal Code on the following described property: The real property situate in the City of Redding, County of Shasta, State of California, described as follows: Parcel 2 , as shown on the certain map entitled "Parcel Map No. 12-72 for Laco Estate of four parcels of land in the south one-half of Lots 34 and 35, of the Bonnyview Tract in J S • the unincorporated territory of Shasta County, California" filed in the office of the County Recorder June 9 , 1972 in Book 1 of Parcel Maps at page 40 , Shasta County Records. BE IT FURTHER RESOLVED that said building mentioned herein- above is hereby declared to be a public nuisance as provided by Chapter 9 . 36 of the Redding Municipal Code and is hereby ordered to be abated by repair, rehabilitation, demolition or removal. BE IT FURTHER RESOLVED that the Fire Marshal and the Board of Appeals of the City of Redding are hereby directed to take all proceedings provided in Chapter 9. 36 of the Redding Municipal Code. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be and hereby is authorized and directed to forward a certified copy of this resolution to the Shasta County Recorder for recordation.
