RESOLUTION NO. S9-61
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF
INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER
CHAPTER 9 . 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL
PROPERTY IN THE CITY OF REDDING (OWNED BY MARK AND MARIE
POISTER AND LOCATED AT 1502 COTTONWOOD AVENUE) .
WHEREAS, the provisions of Chapter 9. 36 of the Redding
Municipal Code provide that all buildings or structures located
within the City of Redding which are structurally unsafe or are
dilapidated from old age , neglect, decay or other causes which
constitute a fire menace or are dangerous to human life or a
likely resort for vagrant or dissolute persons , may be declared a
nuisance by the City Council of the City of Redding and there-
after abated as provided therein; and
WHEREAS, the Fire Marshal of the City of Redding has made an
inspection of the building located on real property as herein-
after described and has declared it to be unsafe and/or a hazard
to safety, health and public welfare; and
WHEREAS, it has been determined that this matter is categor-
ically exempt from the provisions of CEQA;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Redding that it is the intention of this City Council to
begin legal proceedings of abatement under Chapter 9. 36 of the
Redding Municipal Code on the following described property:
The real property situate in the City of Redding, County of
Shasta, State of California, described as follows :
All that portion of the H. C. Quirk Tract, as shown on the
map entitled "Survey of Various Parcels of Land in the H. C.
Quirk Tract Adjacent to the Highland Addition to Redding" ,

recorded in the office of the County Recorder December 7 ,
1953 in Book 14 of Land Surveys at page 46 , Shasta County
Records , described as follows:
Commencing at the northeast corner of said Quirk Tract as
shown on said map; thence along the north line of said Quirk
Tract, S. 72°20 ' W. , 143 . 30 feet; thence S. 17°42 ' E. , 15. 00
feet to the point of beginning of this parcel; thence
continuing S. 17°42 ' E. , 74 . 98 feet; thence S. 72°18 ' W. ,
125 . 00 feet; thence N. 17°42 ' W. , 75. 06 feet; thence N.
72°20 ' E. , 125 . 00 feet to the point of beginning.
Excepting therefrom that portion lying within the parcel
described in the deed to Rena Belle Slaughter, recorded in
the office of the County Recorder March 5 , 1951 in Book 345
of Official Records at page 360 , Shasta County Records.
BE IT FURTHER RESOLVED that said building mentioned herein-
above is hereby declared to be a public nuisance as provided by
Chapter 9 . 36 of the Redding Municipal Code and is hereby ordered
to be abated by repair, rehabilitation, demolition or removal.
BE IT FURTHER RESOLVED that the Fire Marshal and the Board
of Appeals of the City of Redding are hereby directed to take all
proceedings provided in Chapter 9 . 36 of the Redding Municipal
Code.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Redding be and hereby is authorized and directed to forward a
certified copy of this Resolution to the Shasta County Recorder
for recordation.
I HEREBY CERTIFY that the foregoing Resolution was intro-
duced and read at a regular meeting of the City Council of the
City of Redding on the 2nd day of April , 1984 , and
was duly adopted at said meeting by the following vote:
