HomeMy WebLinkAboutReso. 1985 - 248 - Establishing rates for the collection and removal of solid waste pursuant to the provisions of section 9.28.110 of the redding municpal code (2) 410 RESOLUTION NO. l - $, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ESTABLISHING RATES FOR THE COLLECTION AND REMOVAL OF SOLID WASTE PURSUANT TO THE PROVISIONS OF SECTION 9. 28 . 110 OF THE REDDING MUNICIPAL CODE, AND REPEALING RESOLUTION NO. 81-180 WHEREAS, Section 9. 28 . 110 of the Redding Municipal Code provides that the City Council may establish by resolution the rates for the collection and removal of solid waste, and WHEREAS, the City Council has determined that the exist- ing rates and charges do not produce sufficient revenue to pay all the costs related to the collection and removal of solid waste, and WHEREAS, the City Council deems it to be in the best interests of the City and its citizens that all utility services of the City of Redding be self-supporting and not subsidized as to their operational costs by revenues raised through the imposition of ad valorem taxes or other sources of revenue, and WHEREAS, it has been determined that this matter is categorically exempt from the provisions of CEQA, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows : 1. That Resolution No. 81-180 is hereby repealed, upon the effective date of this Resolution. 2 . That a flat rate of $4 . 00 per month shall be charged to all occupied single family residences located within the City of Redding for solid waste collection and disposal service by the City, without regard to the use thereof by the resident. 3. That the same flat rate shall apply to each of multiple residential units on any one parcel of real property with the following exceptions: -1 Rescinded by Resolution R-89-53 (a) If the landlord locates all the garbage containers for all the multiple units on the particular parcel of real property in a single location, and in addition, consolidates the solid waste utility billing in a single customer account, the rate shall be based on the cost of providing service as discussed in 5 below. (b) If, in addition to the provisions of subparagraph (a) above, the landlord shall install in a single location only approved containers with a capacity of one cubic yard or greater each, the solid waste rate will be based upon the cost of providing service as discussed in 5 below. 4 . That a minimum monthly charge of $4 . 00 shall be paid by all commercial, industrial, or professional business locations within the City to which garbage and refuse collection service is made available by the City without regard to use. 5. Where the actual cost to the City for providing the service to a particular establishment exceeds the minimum charge provided for hereinabove, the Director of General Services shall establish a rate by using time and motion studies or other methods to determine the cost of collection and removal of the average amount of solid waste generated by the particular establishment involved. 6 . The minimum monthly charges established above apply to all residential, commercial, industrial and institutional establishments within the City and is limited to six (6) standard size garbage cans of solid waste generated or collected and trans- ported by the City and is established in part to offset the cost of -2-
