WHEREAS, proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways and Service Easements Vacation Law, Streets and Highways Code §8300 , et seq. ; and WHEREAS , the City Council of the City of Redding finds and determines that the hereinafter described real property is not necessary for present or prospective open space easement pur- poses; NOW, THEREFORE, the City Council of the City of Redding hereby resolves and orders as follows: 1 . That the City Council make the following findings in connection herewith: (a) The project is compatible with the Redding General Plan; (b) The project will not significantly alter the existing land form; (c) The project is compatible with the surrounding land use; and (d) The project is compatible with the Redding Munici- pal Code. 2 . That certain real property in the City of Redding, County of Shasta, State of California, being the open space easement across properties located at 853 and 881 Sunkist Court, excepting the area of the 8-inch sewer crossing the property �<u '3487 VAGE 594 . 410 110. located at 853 Sunkist Court, as the same is more particularly described in Exhibit "A" and as illustrated in Exhibit "B" attached hereto and incorporated herein, be and the same hereby is vacated and abandoned as open space easement, subject to the following condition: at the time of development of both lots, the requirements of the Fire Marshal for the City of Redding regarding fire access , fire clearance and fire resistant roof material shall be met. 3 . That the City Clerk of the City of Redding be and hereby is directed to record a certified copy of this resolution, attested to by the City Clerk under the seal of the City of Redding, in the office of the Shasta County Recorder.
