HomeMy WebLinkAboutReso. 1985 - 027 - Establishing electrical utility rates for service to customers within the corporate limits of the city of redding 411 110 RESOLUTION NO. q `y7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ESTABLISHING ELECTRICAL UTILITY RATES FOR SERVICE TO CUSTO- MERS WITHIN THE CORPORATE LIMITS OF THE CITY OF REDDING. WHEREAS, Section 16 . 12. 320 of the Redding Municipal Code provides that the City Council shall establish electric utility rates by resolution; and WHEREAS, due to the projected increased cost of wholesale power provided to the City by the Western Area Power Administra- tion of the United States Department of Energy and to provide funds for the power resource development program and capital improvement programs of the City Electric Department, it has been recommended that the City Council adopt new increased electric utility rates and special service charges as established in the attached "City of Redding Municipal Utilities Schedule of Rates" and "City of Redding Municipal Utilities Schedule of Service Charges" , which are attached hereto and marked Exhibits "A" , "B" and "C" ; and WHEREAS, the City Council has carefully considered this recommendation and has reviewed the existing electric utility rate structure and has studied the proposed increased costs of wholesale power to the City and the Power source development and capital improvement programs of the Electric Department and deems it to be in the best interests of the City of Redding to estab- lish the new increased electric rates and special service charges as proposed; vr-„ ' S 1111 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redding, pursuant to Section 16. 12 . 320 of the Redding Municipal Code, does hereby approve and adopt as the established rates for municipal electric service to customers within the corporate limits of the City of Redding those rates and charges set forth in the "City of Redding Municipal Utilities Schedule of Rates" and the "City of Redding Municipal Utilities Schedule of Service Charges" which are attached hereto as Exhibits "A" , "B" and "C" , and incorporated herein. BE IT FURTHER RESOLVED that the effective date of this resolution shall be February 5 , 1985 as to the power furnished to the customers of the City of Redding electric utility after that date for which meter readings occur thirty (30) days after the applicable effective date shown on Exhibits "A" and "B" . Exhibit "C" shall become effective April 1 , 1985 . BE IT FURTHER RESOLVED that the purposes for the imposition of these increases are as follows: (1) to meet the costs of purchased power, (2) for meeting operating expenses , including employee wage rates and fringe benefits, (3) purchasing or leasing supplies, equipment or materials, (4) meeting financial reserve needs and requirements, (5) obtaining funds for capital projects necessary to maintain service within existing service areas, or (6) obtaining funds necessary to maintain such intra-city transfers as are authorized by law. BE IT FURTHER RESOLVED that the City Clerk and the Finance Director of the City of Redding be and hereby are directed to maintain available certified copies of this resolution in their -2- 0 • respective offices for inspection and review by any interested person or persons . HAYS, ity�Attorney -3- • Exhibit A RESIDENTIAL SERVICE RATE AVAILABILITY Throughout the entire City of Redding service area where the facilities of the City of Redding Electric Utility are available, of adequate capacity, and are adjacent to the premises. APPLICABILITY To all single-phase residential electric service provided for single-family dwellings and apartments, separately metered by the City of Redding, and mobile home parks where all service is supplied at one point of delivery and energy is metered through one master meter and submetered to each individual dwelling. All use of this service other than as specified above except as provided for with a Home Occupation Use Permit (Chapter 18.08.030, Subpart E, of the Redding Municipal Code) , will qualify the total service for a commercial rate. Not applicable to or available for three-phase service, resale for profit, temporary construction service, standby or auxiliary service, service to any single motor exceeding a nameplate rating of 71/2 horsepower, or any equipment which will cause excessive voltage fluctuations. CHARACTER OF SERVICE Single-phase, 60 hertz, three-wire, nominal 120/240 volts (or three-wire, 120/208 volts at certain locations as are now or hereafter may be established by the City of Redding Electric Utility) . RATE • A monthly bill at the following rate plus or minus any adjustments incorpo- rated in this rate schedule or supplement hereto: Service Charge: Per meter $ 1. 75 Energy Charge: All kWh, per kWh $ 0.0399 TAX CLAUSE To the charges computed under the above rate, including any adjustments, shall be added the applicable proportionate part of any taxes or governmental impositions which are or may in the future be assessed on the basis of. gross revenues of the City of Redding and/or the price or revenue from the electric energy or service sold and/or the volume of energy generated or purchased for sale and/or sold hereunder. PAYMENT Bills for service will he rendered monthly. At the option of the City of Redding, however, the meters may be read bimonthly with the bill for the alternate month based upon an estimated kWh consumption. A billing period will not be less than 27 days or more than 33 days. APPLICABILITY To mobile home parks that are served through master meters, and which provide single-phase, submetered, residential electric service to all individual tenants. CHARACTER OF SERVICE Single-phase or three-phase, 60 hertz, and at one standard nominal voltage as mutually agreed by the City of Redding Electric Utility and the customer and subject to availability at the point of delivery. Primary metering may be used by mutual agreement. However, the primary service discount shall not apply. Miscellaneous electrical loads, such as general lighting, laundry room; general maintenance and other similar usage incidental to the operation of the mobile home park as a multi-family accommodation will be considered as domestic usage and supplied in accordance with the applicable service rate. RATE The rate applicable to this service schedule shall be the current residential rate in effect plus or minus any adjustments incorporated in this rate schedule or supplement hereto. If the monthly billing demand exceeds 500 kW and the customer takes service at a primary voltage, then primary metering will be installed. RATE A monthly bill at the following rate plus or minus any adjustments incorpo- rated in this rate schedule or supplement hereto: Service Charge: Per meter $ 1.85 Energy Charge: First 15,000 kWh, per kWh $ 0.0505 Additional kWh, per kWh $ 0.0298 DEMAND METERING Whenever the monthly energy usage exceeds 15,000 kWh for 3 months out of a 12 month period, a demand meter will be installed and the customer will be billed based upon the GENERAL SERVICE-DEMAND METERED RATE SCHEDULE, During any month usage exceeds 15,000 kWh and a demand meter is not installed, demands will be estimated as follows: The monthly billing energy divided by one-half of the billing days • • multiplied by 24 hours per day, or in equation form: Demand (kW) = Energy (kWh)/[0.5 x Billing Days x 24 (hrs.) ] The Demand Charge shall be calculated as follows: The Demand Charge per kW of billing demand is derived by multiplying $3.92 by the difference of the total monthly billing kWh less 15,000 kWh. APPLICABILITY To all general power and lighting service, when all power is supplied at one point of delivery, through one metered service, and the monthly use of energy exceeds 15,000 kWh or has exceeded 15,000 kWh for 3 months out of a consecutive 12 month period, or a new account where the energy usage is estimated by the City of Redding Electric Utility to exceed 15,000 kWh. Not applicable to or available for resale, standby, or auxiliary service. CHARACTER OF SERVICE Single-phase or three-phase, 60 hertz, and at one standard nominal voltage as mutually agreed by the City of Redding Electric Utility and the customer and subject to availability at the point of delivery. If the monthly billing demand exceeds 500 kW and the customer takes service at a primary voltage, then primary metering will be installed. When the power usage is intermittent or subject to violent fluctuations, the utility may base the billing demand upon a 5-minute interval. PRIMARY SERVICE DISCOUNT When delivery is made and power is metered at a primary voltage the following discount shall be applied to the sum of the demand and energy charges: Discount Service at 12,000 volts or higher 4% Service at 2,000 volts to 12,000 volts 3% 503-122 5 Effective Date: 1/11/85 February 5, 1985 ry I Exhibit A ' GENERAL SERVICE - DEMAND METERED RATE (con't) POWER FACTOR ADJUSTMENT When the billing demand has exceeded 500 kW for 3 consecutive months and thereafter until it has fallen below 300 kW for 12 consecutive months, bills will be adjusted for weighted monthly average power factor as follows: That portion of the monthly charge, comprising the Demand Charge and the Energy Charge, including the Primary Service Discount, if applicable, will be decreased or increased, respectively, by 0.25% for each 1% that the average power factor of customer's load in the month was greater or less than 95%, such average power factor to be computed (to the nearest whole percent) from the ratio of lagging kilovolt ampere hours to kilowatt hours consumed in the month. TAX CLAUSE To the charges computed under the above rate, including any adjustments, shall be added the applicable proportionate part of any taxes or governmental impositions which are or may tn the future be assessed on the basis of gross revenues of the City of Redding and/or the price or revenue from the electric energy or service sold and/or the volume of energy generated or purchased for sale and/or sold hereunder. APPLICABILITY To all general power and lighting service, when all power is supplied at one point of delivery, through one metered service, and the monthly maximum demand has exceeded 300 kW for 3 months out of a consecutive 12 month period, or to new customers whose monthly maximum demand is expected to exceed 300 kW. Any customer served under this schedule whose monthly maximum demand in any time period has fallen below 300 kW for any 12 consecutive months, may at the discretion of the City of Redding Electric Utility, continue to receive service under this schedule or under any other applicable schedule. Not applicable to or available for resale, standby, or auxiliary service. CHARACTER OF SERVICE Single-phase or three-phase, 60 hertz, and at one standard nominal voltage as mutually agreed by the City of Redding Electric Utility and the customer and subject to availability at the point of delivery. If the monthly billing demand exceeds 500 kW and the customer takes service at a primary voltage, then primary metering will be installed. All meter recording equipment (ie. recorder, pulse initiating meter, and recording cartridges) shall be supplied and maintained by the City of Redding Electric Utility. Service under this rate schedule must be maintained for a minimum of 1 year. RATE A monthly bill at the following rate plus or minus any adjustments incorporated in this rate schedule or supplement hereto: • Service Charge: Per meter $20.00 Energy Charge: On-peak periods First 15,000 kWh, per kWh $ 0.0505 Additional kWh, per kWh $ 0.0298 Off-peak periods All kWh, per kWh $ 0.0280 Demand Charge: The total monthly Demand Charge is derived by multiplying the sum of the on-peak and off-peak period demand charges by the difference of the total monthly billing kWh less 15,000 kWh. Off-peak period: 6:30 p.m. to 2:30 p.m. Monday through Friday, all day Saturday, Sunday, and holidays. Period B is applicable to meter readings from November 1 to April 30, inclusive, for the following hours: On-peak period: 7:00 a.m. to 11:00 a.m. Monday through Friday, except holidays. Off-peak period: 11:00 a.m. to 7:00 a.m. Monday through Friday, all day Saturday, Sunday, and holidays. The following holidays, as established by California law, will be recognized as off-peak periods: New Year's Day, Lincoln's Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving, and Christmas Day. When the billing includes usage in both Period A and Period B, no proration of charges between Period A and Period B will be made where meter readings are , taken within one work day (Monday through Friday inclusive but excluding holidays) of either May 1 or November 1 of any year. In such cases the billing will be based on the rates and charges of either Period A and Period B, whichever contains the predominant number of days in the billing period. Any customer served under this rate schedule may elect to be served under either Period A, or Period B, or both periods. For any time period when the customer elects not to be served under this rate schedule, the customer will be billed based upon the alternate applicable General Service Rate. BILLING DEMAND The maximum demand in any month shall be the average power taken during any 15-minute interval in the current month as indicated or recorded by instruments installed, owned, and maintained by the utility. This rate schedule is available only under contract with the -City of Redding, hereinafter referred to as the "City". APPLICABILITY Applicable to separately demand-metered interruptible three-phase service customers with interruptible demands in excess of 300 kW where the customer is presently being served or would qualify for either the General Service Demand-metered Rate or the General Service Time-metered Rate. CHARACTER OF SERVICE Three-phase, 60 hertz, at one standard nominal voltage as mutually agreed by the City of Redding Electric Utility and the customer and subject to availability at the point of delivery. RATE A monthly bill calculated from the appropriate General Service or Time-metered Rate Schedule plus or minus any of the following billing adjustments incorporated in this supplemental rate schedule. DEMAND CHARGE CREDIT 1. City-controlled Interruptible Demand: Applicable where the customer elects to provide only City-controlled Interruptible Demand. • The total monthly Demand Charge as determined under the applicable General Service or Time-metered Rate Schedule shall be reduced by the following percentage formula: D% _ [1 - (F / (F+IL)) ] x 5% Where: D% = Demand Charge Reduction Percentage F = Estimated On-peak Firm Service Demand IL = Estimated On-peak City-controlled Interruptible Demand 2. Customer-controlled Interruptible Demand: Applicable when the customer elects to provide only Customer-controlled Interruptible Demand. 503-122 13 Effective Date: 1/11/85 - February 5, 1985 . -1111 Exhibit .A f, SUPPLEMENTAL RATE - INTERRUPTIBLE (con't) The total monthly demand charge as determined under the applicable General Service or Time-metered Rate Schedule shall be reduced by the following percentage formula: D% = [1 - (F / (F+IC)) ] x 2.5% Where: D% = Demand Charge Reduction Percentage F = Estimated On-peak Firm Service Demand IC = Estimated On-peak Customer-controlled Interruptible Demand 3. Contract for Service: The estimated On-peak Interruptible Demand and estimated On-peak Firm Service Demand shall be mutually agreed upon and set forth in the Contract for Service. BILLING 1. Meter-recording Service Charge: A monthly supplemental service charge shall be added to each bill according to the applicable rate: MONTHLY (A) General Service - Interruptible, service charge $17.00 (B) Time-metered - Interruptible, service charge $ 0.00 2. Interrupted Demand Billing Reduction: During any billing period when one or more Demand interruptions are requested of the customer by the City and are fully accomplished by the customer, the customer's total demand charge shall be based upon the applicable General Service or Time-metered Demand Rate multiplied by the customer's maximum metered demand which occurred during any of the Demand Interruption. Periods. 3. Penalty for Non-compliance: Under the conditions applicable to Customer-controlled Interruptible Demand if, at any time, the customer fails to reduce his demand to the On-peak Firm Service Demand level when requested to do so by the City, the customer shall, in addition to all other non-demand related charges, (i.e. service charge, energy charge, primary service discount, and power factor adjustment) pay a Demand Charge for the sum of: (A) An amount equal to the applicable On-peak Demand Charge multiplied by the On-peak Firm Service Demand; plus (B) The greater of: (1) An amount equal to 5 times the applicable on-peak demand charge multiplied by the net of the customer's maximum metered demand less the On-peak Firm Service Demand during any interruption period within the billing period; or, • 503-122 14 Effective Date: 1/11/85 February 5, 1985 111 • Exhibit A SUPPLEMENTAL RATE - INTERRUPTIBLE (con't) (2) An amount equal to the sum of the additional costs to the City for supplemental purchased power and related transmission and transportation costs (expressed in $/kW) multiplied by the net of the maximum metered demand less the On-peak Firm Service Demand during any interruption period within the billing period. If more than one interruption request occurs during a billing period and the customer fully complies with at least one interruption request and does not fully comply with at least one other interruption request, the penalty for non-compliance charges under Section 3. (B) , will be reduced by multiplying it by the proportion of the total number of interruptions with which the customer failed to comply fully to the number of interruptions requested. In addition to the above penalty charges, the Demand Charge Credit will be forfeited for the month in which any non-compliance occurs. SPECIAL CONDITIONS OF SERVICE 1. Demand Interruption Periods: During system peak load conditions, where the City's demand is approaching its Western Area Power Administration CVP power allocation limit and the City would incur higher wholesale power costs for additional power purchases, Demand Interruption Periods will be initiated. The City will endeavor to reduce system load consistent with good utility practice as follows: (A) City facilities electric demand reduction. (B) Load management activation. (C) Interruptible demand activation. 2. Non-intentional Demand Interruptions: Interruptions of service other than intentional interruptions as requested and logged by the City shall be defined as: (A) interruptions caused by Acts of God, public enemy, strikes, state, or other governmental interference, windstorm, flood, fire, explosion, or any matter or thing over which the City has no control, whether in connection with the operations or property of either customer or City, or, (B) Interruptions caused by emergencies that cause the City to order curtailment of service to firm customers in order to protect the general public and preserve the integrity of its system and the systems of neighboring utilities whose electric systems are interconnected with the electric system of the City. Such Non-intentional Demand Interruptions shall not be credited towards the customer's Interrupted Billing Demand Reduction. 3. On-peak Firm Service Demand: Firm Service Demand is the maximum demand which the City is expected to supply during periods when the City has called for interruptible demand to be disconnected from the City's lines. The On-peak Firm Service Demand levels shall be specified by the customer within the Contract for Service. Notice of Interruption: The City shall attempt to give the customer not less than 10 minutes notice before interruption of the City-controlled interruptible demand. The City shall attempt to give the customer not less than 30 minutes notice before interruption of the customer-controlled interruptible demand should be accomplished before penalty charges would be assessed. Notice of Interruption shall be given to the customer by telephone from the City and logged according to time and contacted person. It shall. be the customer's responsibility to insure proper contact can be made during Demand Interruption Periods. Failure to make telephone contact with the customer during Demand Interruption Periods shall not: (A) Cause the City to incur any liability for damages arising from City-controlled Interruptible Demand being interrupted, or; (B) Relieve the customer of any liabilities incurred due to failure of the customer to interrupt Customer-controlled Interruptible Demand. After any interruption hereunder, the customer shall not resume use of • electric power except upon notice from the City. 7. Contract: A contract will be required for a period of 3 years when • service is first rendered under the schedule and for subsequent periods of one year thereafter, continuing until cancelled by either party by written notice one year in advance of the initial period or any subsequent period, provided, however, that if the customer requests a change at the end of the initial period or any subsequent period from service under this schedule to General Service Demand-metered Rate Schedule, one year's written notice must be given. 8. Communications and Metering: The customer shall provide to the City's specification communication channels to the City's Control Center for the purposes of alarming, telemetering, and signaling. To carry out the provisions of this schedule, the City shall provide and install recording watt and var meter equipment. The City shall have the right to inspect and test relay facilities, communications equipment, recording meters, and interruption equipment upon reasonable notice to the customer. 9. CHARACTER OF SERVICE Single-phase or three-phase, 60 hertz, and at one standard nominal voltage. RATE A monthly bill at the following rate plus or minus any adjustments incorporated in this rate schedule or supplement hereto: Service Charge: - Non-demand metered, per meter $ 8.00 Demand metered, per meter $ 9.00 Energy Charge: First 15,000 kWh, per kWh $ 0.0583 Additional kWh, per kWh $ 0.0327 Demand Charge: The Demand Charge per kW of billing demand is derived by multiplying $4.29 by the difference of the total monthly billing kWh less 15,000 kWh. The above product is then divided by 69.4% of the total monthly kWh, or, in equation form; $4.29 x [ (Total kwh-15,000)/(69.4% x Total kWh) ] BILLING DEMAND The maximum demand in any month shall be the average power taken during any 15-minute interval in the current month as indicated or recorded by instruments installed, owned, and maintained by the utility. • • When the power usage is intermittent or subject to violent fluctuations, the utility may base the billing demand upon a 5-minute interval. TAX CLAUSE To the charges computed under the above rate, including any adjustments, shall be added the applicable proportionate part of any taxes or governmental impositions which are or may in the future be assessed on the basis of gross revenues of the City of Redding and/or the price or revenue from the electric energy or service sold and/or the volume of energy generated or purchased for sale and/or sold hereunder. PAYMENT Bills for service will he rendered monthly. At the option of the City of Redding, however, the meters may he read bimonthly with the bill for the alternate month based upon an estimated kWh consumption. A billing period will not be less than 27 days or more than 33 days. Bills will be deemed delinquent if unpaid 20 days after the date of mailing pursuant to Chapter 14.20 of the Redding Municipal Code. 503-167 12 Effective Date: 1/14/85 September 3, 1985 • Exhibit B Supplemental Schedule of Rates for General Service - Interruptible or Time-Metered - Interruptible AVAILABILITY Throughout the entire City of Redding service area where the facilities of the City of Redding Electric Utility are available, of adequate capacity, and are adjacent to the premises. This rate schedule is available only under contract with the. City of Redding, hereinafter referred to as the "City". APPLICABILITY Applicable to separately demand-metered interruptible three-phase service customers with interruptible demands in excess of 300 kW where the customer is presently being served or would qualify for either the General Service Demand-metered Rate or the General Service Time-metered Rate. CHARACTER OF SERVICE Three-phase, 60 hertz, at one standard nominal voltage as mutually agreed by the City of Redding Electric Utility and the customer and subject to availability at the point of delivery. RATE A monthly bill calculated from the appropriate General Service or Time-metered Rate Schedule plus or minus any of the following billing adjustments incorporated in this supplemental rate schedule. DEMAND CHARGE CREDIT 1. City-controlled Interruptible Demand: Applicable where the customer elects to provide only City-controlled Interruptible Demand. • The total monthly Demand Charge as determined under the applicable General Service or Time-metered Rate Schedule shall he reduced by the following percentage formula: D% = [1 - (F / (F+IL)) ) x 5% Where: D% = Demand Charge Reduction Percentage F = Estimated On-peak Firm Service Demand IL = Estimated On-peak City-controlled Interruptible Demand 2. Meter-recording Service Charge: A monthly supplemental service charge shall be added to each bill according to the applicable rate: MONTHLY (A) General Service - Interruptible, service charge $16.85 (B) Time-metered - Interruptible, service charge $ 0.00 2. Interrupted Demand Billing Reduction: During any billing period when one or more Demand interruptions are requested of the customer by the City and are fully accomplished by the customer, the customer's total demand charge shall be based upon the applicable General Service or Time-metered Demand Rate multiplied by the customer's maximum metered demand which occurred during any of the Demand Interruption Periods. 3. Penalty for Non-compliance: Under the conditions applicable to Customer-controlled Interruptible Demand if, at any time, the customer fails to reduce his demand to the On-peak Firm Service Demand level when requested to do so by the City, the customer shall, in addition to all other non-demand related charges, (i.e. service charge, energy charge, primary service discount, and power factor adjustment) pay a Demand Charge for the sum of: . (A) An amount equal to the applicable On-peak Demand Charge multiplied by the On-peak Firm Service Demand; plus (B) The greater of: (1) An amount equal to 5 times the applicable on-peak demand charge multiplied by the net of the customer's maximum metered demand less the On-peak Firm Service Demand during any interruption period within the billing period; or, 503-167 14 Effective Date: 1/14/85 September 3, 1985 Exhibit` B SUPPLEMENTAL RATE - INTERRUPTIBLE (con't) (2) An amount equal to the sum of the additional costs to the City for supplemental purchased power and related transmission and transportation costs (expressed in $/kW) multiplied by the net of the maximum metered demand less the On-peak Firm Service Demand during any interruption period within the balling period. If more than one interruption request occurs during a billing period and the customer fully complies with at least one interruption request and does not fully comply with at least one other interruption request, the penalty for non-compliance charges under Section 3. (B) , will be reduced by multiplying it by the proportion of the total number of interruptions with which the customer failed to comply fully to the number of interruptions requested. In addition to the above penalty charges, the Demand Charge Credit will be forfeited for the month in which any non-compliance occurs. SPECIAL CONDITIONS OF SERVICE 1. Demand Interruption Periods: During system peak load conditions, where the City's demand is approaching its Western Area Power Administration CVP power allocation limit and the City would incur higher wholesale power costs for additional power purchases, Demand Interruption Periods will be initiated. The City will endeavor to reduce system load consistent with good utility practice as follows: (A) City facilities electric demand reduction. (B) Load management activation. (C) Interruptible demand activation. 2. Non-intentional Demand Interruptions: Interruptions of service other than intentional interruptions as requested and logged by the City shall be defined as: (A) Interruptions caused by Acts of God, public enemy, strikes, state, or other governmental interference, windstorm, flood, fire, explosion, or any matter or thing over which the City has no control, whether in connection with the operations or property of either customer or City, or, (B) , Interruptions caused by emergencies that cause the City to order curtailment of service to firm customers in order to protect the general public and preserve the integrity of its system and the systems of neighboring utilities whose electric systems are interconnected with the electric system of the City. Such Non-intentional Demand Interruptions shall not be credited towards the customer's Interrupted Billing Demand Reduction. 3. On-peak Firm Service Demand: Firm Service Demand is the maximum demand which the City is expected to supply during periods when the City has called for interruptible demand to be disconnected from the City's lines. The On-peak Firm Service Demand levels shall be specified by the customer within the Contract for Service. City-controlled Interruptible Demand: Such interruptible demand is that demand which the customer agrees shall be disconnected by the City from the City's lines during Demand Interruption Periods. Such interruptible demand shall be specified by the customer, with initial demand and subsequent changes subject to check and approval by the City. 5. Customer-controlled Interruptible Demand: Such interruptible demand is that demand which the customer agrees shall be disconnected by the customer from the City's lines upon notice by the City. Such interruptible demand shall be specified by the customer, with initial demand and subsequent changes subject to check and approval by the City. • 6. Notice of Interruption: The City shall attempt to give the customer not less than 10 minutes notice before interruption of the City-controlled interruptible demand. The City shall attempt to give the customer not less than 30 minutes notice before interruption of the customer-controlled interruptible demand should be accomplished before penalty charges would be assessed. Notice of Interruption shall be given to the customer by telephone from the City and logged according to time and contacted person. It shall be the customer's responsibility to insure proper contact can be made during Demand Interruption Periods. Failure to make telephone contact with the customer during Demand Interruption Periods shall not: (A) Cause the City to incur any liability for damages arising from City-controlled Interruptible Demand being interrupted, or; (B) Relieve the customer of any liabilities incurred due to failure of the customer to interrupt Customer-controlled Interruptible Demand. After any interruption hereunder, the customer shall not resume use of electric power except upon notice from the City. 7. Contract: A contract will be required for a period of 3 years when service is first rendered under the schedule and for subsequent periods of one year thereafter, continuing until cancelled by either party by written notice one year in advance of the initial period or any subsequent period, provided, however, that if the customer requests a change at the end of the initial period or any subsequent period from service under this schedule to. General Service Demand-metered Rate Schedule, one year's written notice must be given. 8. Communications and Metering: The customer shall provide to the City's specification communication channels to the City's Control Center for the purposes of alarming, telemetering, and signaling. To carry out the provisions of this schedule, the City shall provide and install recording watt and var meter equipment. The City shall have the right to inspect and test relay facilities, communications equipment, recording meters, and interruption equipment upon reasonable notice to the customer. 9.
