LIF MAR 4 1987 RESOLUTION NO. 86-276 '72Feffs °) 0 0 FEE R£CORDFEE S A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION AND ABANDONMENT OF AN OPEN SPACE EASEMENT LOCATED ON PROPERTY AT 817 MONARCH COURT 1(A-12-86) . WHEREAS, proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways and Service Easements Vacation Law, Streets and Highways Code §8300 , et seq. ; and WHEREAS, the City Council of the City of Redding finds and determines that, provided the conditions contained in paragraph 2 hereof are met, the hereinafter described real property is not necessary for present or prospective open space easement purposes; NOW, THEREFORE, the City Council of the City of Redding hereby resolves and orders as follows: 1 . That the City Council makes the following findings in connection herewith: (a) The project is compatible with the Redding General Plan; (b) The project will not significantly alter the existing land form; (c) The project is compatible with the surrounding land use; and (d) The project is compatible with the, Redding Municipal Code. 2. That with respect to the deck to be built to create a private rear-yard space at the rear of the house situated on the BOOK 2296PAGE 797 111 subject property, the following conditions are to be met by the owner thereof: (a) A sprinkler system protecting the deck shall be installed to the specifications of the Fire Marshal; and (b) An area below the deck shall be cleared of vegetation as per the requirements of the Fire Marshal. 3. That once the above conditions have been met and approved by the Fire Marshal, that certain real property in the City of Redding, County of Shasta, State of California, being an open space easement located on property at 817 Monarch Court, as the same is more particularly described in Exhibit "A" and as illustrated in Exhibit "B" attached hereto and incorporated herein, be and the same is hereby vacated and abandoned as an open space easement. 4. That after the above conditions have been met and approved by the Fire Marshal, the City Clerk of the City of Redding be and hereby is directed to record a certified copy of this Resolution, attested to by the City Clerk under the seal of the City of Redding, in the office of the Shasta County Recorder.
