HomeMy WebLinkAboutReso. 1986 - 202 - Establishment of a parking and business improvement area pursuant to the parking and business improvement area law of 1979 streets and highways code sections 36500 es seq J ' • • RESOLUTION 6(o- -,,20� A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF REDDING IN THE MATTERS OF THE ESTABLISHMENT OF A P4ARKING AND BUSINESS IMPROVEMENT AREA PURSUANT TO THE PA{RKING AND BUSINESS IMPROVEMENT AREA LAW OF 1979, STREETS AND HIGHWAYS CODE SECTIONS 36500 ET SEQ. , AND THE DISESTABLISHMENT OF THE EXISTING PARKING AND BUSINESS IMPROVEMENT AREA PURSUANT TO THE PARKING AND BUSINESS AREA IMPROVEMENT LAWS OF 1965 , STREETS AND HIGHWAYS CODE SECTIONS 36000-36081 , AND REDDING MUNICIPAL CODE SECTION 6. 18 . 140 . WHEREAS, a large number of businesses and merchants in the downtown area have expressed a desire for the formation of a Parking and Business Improvement Area; WHEREAS, a Parking and Business Improvement II Area will promote the economic revitalization of the community through programs for promotion of public events , cooperative coordination of business activities, improvement of parking, and general promotion of business activities in the area; WHEREAS, economic growth in the downtown area is important to the economic health and stability of the City of Redding; WHEREAS, the proposed Parking and Business Improvement Area would be a larger and more comprehensive program than the exist- ing Parking and Business Improvement Area, so that the new Parking and Business Improvement Area would serve to replace the existing Parking and Business Improvement Area; NOW, THEREFORE: BE IT RESOLVED by the City Council of the City cif Redding, Shasta County, California, that it is the intention of said City Council to establish a Parking and Business Improvement Area in , . , III 410 accordance with the provisions of the Parking and Business Area Improvement Law of 1979 of the State of California, Lwithin the boundaries of the area depicted on the diagram attached hereto as Exhibit "A" and incorporated herein by reference, more particu- larly described on Exhibit "B" and incorporated herein by refer- ence. BE IT FURTHER RESOLVED that it is the intention of the City Council of the City of Redding pursuant to Redding Municipal Code Section 6. 18 . 140 to disestablish the existing Parking and Busi- ness Improvement Area created under the Parking and Business Improvement Area Law of 1965 , described in Redding Municipal Code Section 6. 18. 150 , depicted on the diagram attached hereto as Exhibit "C" and incorporated herein by reference, and more particularly described in Exhibit "D" and incorporated herein by reference. BE IT FURTHER RESOLVED that Monday , the /5' fh day of .JEPTEMI3E'R , 1986 , at the hour of 7:OOpM in the City Council Chambers at 1313 California Street in the City of Redding, are hereby set as the time and place for hearing all persons interested in or objecting to the establishment of the new parking and business improvement area and the disestablish- ment of the existing parking and business improvement area. At the time set for such hearing, the City Council shall hear all protests and receive evidence for or against the proposed action. The City Council shall also rule upon all protests , which deter- mination shall be final. The City Council may continue the public hearing from time to time. Proceedings shall terminate if -2- 111 a protest is made by businesses in the proposed area 'which will pay a majority of the assessments or charges proposed to be imposed. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be, and she is hereby instructed to give notice of this hearing as follows: (a) To cause publication of this Resolution of Intention once in a newspaper published and circulated in the City of Redding. (b) To cause to be mailed a complete copy of the Resolution of Intention, postage prepaid, in a sealed envelope, by U.S. Mail, to each business in the proposed parking and business improvement area, and to each business in the existing parking and business improvement area, as shown upon the active business license rolls ,on file in the office of the City Clerk. (c) To cause both the publication and mailing of said notices to be completed at least fifteen (15) days prior to the holding of the aforesaid hearing. BE IT FURTHER RESOLVED that the purpose for the establish- ment of the proposed Parking and Business Improvement Area is to impose assessments or charges, or both, on businesses within a Parking and Business Improvement Area which is in addition to any assessments, fees, charges, or taxes imposed in the City and to use such proceeds for the benefit of businesses within such Parking and Business Improvement Area by doing any of the follow- ing: (a) The acquisition, construction, or maintenance of parking facilities for the benefit of the Area. (b) Decoration of any public place in the Area. (c) Promotion of public events which are to take place on or in public places in the Area. (d) Furnishing of music in any public place in the Area. (e) The general promotion of business activities in the Area. -3- BE IT FURTHER RESOLVED that the purpose for the disestab- lishment of the existing Parking and Business Improvement Area is to replace same with the proposed Parking and Business Improve- ment Area. BE IT FURTHER RESOLVED that the proposed Parking and Business Improvement Area shall utilize the following system of assessments or charges: (1) "Assessment" means a levy for the purpose off obtaining funds to construct physical improvements which will benefit a Parking and Business Improvement Area. (2) "Charge" means a levy for the purpose of providing services and for programs which will benefitla Parking and Business Improvement Area. (3) Both assessments and charges may be levied on a busi- ness. (4) The assessments or charges levied on businesses shall, to the maximum extent feasible, be levied onithe basis of the estimated benefit to the businesses within the proposed Parking and Business Improvement Arepa. (5) Each amount collected under the following schedule shall be considered both an assessment and a charge, so that all monies collected may be expended for the purposes designated for either an assessment or a charge, or both. (6) The annual assessment/charge shall be calculated according to: business classification, the zone in which the business is located, and the number of employees (full time or equivalent) of the business. Chart 1 sets out the business classifications and the benefit percentage multiplier for each classification in the proposed zones. Chart 2 sets out the "basic benefit charge" for the number of employees; businesses with more than 55 employees would add a basic benefit charge of $5. 00 per employee in excess of 55 employees. The annual assessment/charge is calculated bylmultiply- ing the benefit percentage by the basic benefit charge. Part-time, shortl-term, or seasonal employees shall be converted to an equivalent measure of full-time employees, in the manner provided -5- 411 by Redding Municipal Code §6. 02. 110 for computing the business license tax, except that exemptions under the business license tax shall not apply for purposes of the Parking and Business Improvement Area assessment/ charge. However, any employee who is paid for working away from the Parking and Business Improvement Area for more than 50% of the time for which he is pa4d during a fiscal year shall be deemed an exempt emplloyee , and that employee shall not be included in the computation above , except that a business in which all employees qualify for the exemption shall pay an assessment/ charge using one employee as a basis for computing the assessment/charge due. (8) Where a business consists of one owner/operator, then the business shall be considered to have onel employee; except that (1) real estate agents acting a's indepen- dent contractors shall be counted as employees and their supervising broker shall be assessed/charged accordingly, and (2) licensed beauticians acting as independent contractors shall be counted ass employees and the business providing the station or chair shall be assessed accordingly. All independent contractors who have their primary place of business in the Parking and Business Improvement Area, and who do not� own, rent or lease their business location, shall be counted as employees of the proprietor of the business location. (9) Temporary businesses shall be assessed/charged on a prorated basis on 1/12th the annual assessment/charge for each month, or portion thereof, for which the business is licensed to operate. (10) If the proposed Parking and Business Improvement Area is adopted, and any business believes that the assess- ment/charge is based upon inaccurate information as to the business classification, number of employees , or benefit zone, and the assessment/charge is not yet delinquent, then such business (es) may submits corrected information to the City Clerk. In the event of any dispute the business (es) shall pay the assess- ment/charge determined by the City Clerk, and the matter may be appealed to the next regular meeting of the Parking and Business Improvement Area Budget and Benefit Review Board. The decision of the Review Board shall be final. (11) The regular assessment/charge funds shall not be utilized for acquisition, construction or maintenance of parking facilities , unless the followinglsteps are taken. The Parking and Business Improvement Area Budget and Benefit Review Board, hereafter "Review Board, " shall first hold a public hearing on the matter after giving fifteen (15) days notice by mail to the -6- , . ID III 1 members of the Parking and Business Improvement Area. The recommendation of the Review Board shall be forwarded to the City Council, which may reject the recommendation or refer it back to the Review Board, or move forward with the recommendation-- either in its original form or as modified by the City Council-- by adopting a Resolution of Intention specifying the proposed action and the time and place of alhearing on the matter, and published in a newspaper of general circulation, and a copy of the Resolution shall be mailed to all businesses in the Parking and Business Improvement Area listed on the most current assess- ment/charge rolls, at least fifteen (15) days prior to a public hearing before the City Council too consider adoption of an ordinance to impose assessments/charges for parking facilities. Failure to mail a copy of the Resolution to all businesses in the Parking and Business Improvement Area shall not invalidate the proceedings. At the hearing on the matter the City Council shall determine the amount of any proposed assessments/charges for parking facilities on, the basis of benefit, after giving consideration to the following factors: (a) the total cost to be recovered from the businesses upon which the assessment or charge is to be imposed, (b) the total area within the boundaries of the Parking and Business Improvement Area to be benefited by the parking improvement, (c) the assessed value of the land and improvements within such area, (d) the total business volume generated within such area, and (e) such other factors as the City Council may find and determine to be a reasonable measure of benefit from the construction or maintenance of parking facilities. The assessment/charge shall be attributed to the individual businesses which benefit from the construction or maintenance of parking facilities. The benefit attributed to the construction or maintenance of parking facilities shall proportionately decrease the funds otherwise available for expenditure for the benefit of the zone (s) and business (es) benefited by the parking improvement. The allocation of benefits for parking facilities, and the corresponding reductions in expenditures from general assess- ment/charge funds , shall be accurate to the greatest extent reasonably practicable under the circgmstances, but no such assessment/charge , allocation, orOreduction shall be invalid if there is substantial compliance with the requirements herein. If the amount of all assessments/charges thus determined for parking facili- ties does not exceed the regular assessment/charge for any of the affected individual businesses, and the assessments/charges are approved, then the assess- ments/charges for parking facilities may be taken from the regular funds , and the transfer will be authorized upon the effective date of a duly adopted ordinance. -7- • 111 If the cumulative amount of the assessments/charges for parking facilities exceeds the regular assess- ment/charge for any affected individual busiOness , then the assessment/charge for parking facilities under consideration may not be adopted. However the City Council may elect to modify or increase the general assessment/charge by following the procedure set forth in Paragraph (12) hereunder. (12) To change the general assessments, charges or uses to which revenue is put, the Review Board shallifirst hold a public hearing on the matter, after giving fifteen (15) days notice by mail to the members of the Parking and Business Improvement Area. The recommendation of the Review Board shall be forwarded tol the City Council, which may reject the recommendation or refer it back to the Review Board, or move forward with the recommendation-- either in its original form or as modified by the City Council --by adopting afiResolution of Intention specifying the proposed change and the time and place of a hearing on the matter, to be published in a newspaper of general circulation and mailed to all members of the Parking and Business Improvement Area at least fifteen (15) days 1 prior to the hearing on the matter. Any change (s) shall be made by ordinance adopted after the hearing before the City Council. (13) The annual assessment/charge shall be due on July 1 of each year and delinquent if not paid within thirty (30) days. A newly established business shall bdassessed/ charged on a prorated basis of 1/12th the annual assessment/charge for each month or portio9n thereof, for that portion of the first year in which the business is established; the assessment/charge shall be due immediately when the business is established, and delinquent if not paid within thirty (30) days. (14) For the year of 1986 and through June 30 , 1987 , only, businesses shall be assessed/charged on a prorated basis of 1/12th the annual assessment/charge for each month remaining through June 30 , 1987 , which assessment shall become due on the first day of the calendar month following the effective date of an ordinance implement- ing the proposed Parking and Business Improvement Area, and delinquent if not paid within thirty (30) days. Businesses in the existing Parking and Business Improvement Area which have already paid an annual charge for 1986 shall be entitled to a prorated offset against assessments/charges due under then proposed Parking and Business Improvement Area for 1986; in the event the offset exceeds the amount of the assess- ment/charge due for the remaining months in 1986 , no -8- e • offset shall carry over to the 1987 portion of the annual assessment/charge. (15) If any assessment/charge is unpaid and delinquent then a penalty of five percent (5%) per month shall be added to the assessment/charge for each month thatOit remains unpaid, not exceeding in the aggregate a total penalty of fifty percent (50%) of the amount of the assess- ment/charge. Any penalty so imposed shall be collected by the person in charge of the collection of the assessments/charges. (16) Nonprofit corporations with registered tax exempt status shall not be subject to an assessment/charge. (17) The City of Redding, County of Shasta, State of California, United States Government, and subdivisions, agencies and departments thereof shall not be subject to an assessment/charge. (18) Businesses, property owners, or other interested. parties not within the Parking and Business Improvement Area may, even though not subject to assessment or charge, voluntarily contribute monies in furtherance of the programs and purposes of the Parking and. Business Improvement Area. All monies voluntarily contributed shall be directed to the benefit of the zone closest to the location of the contributor, or such other zone as the contributor may direct. BE IT FURTHER RESOLVED that the City Council intendsllthat any collected and unspent funds from the existing Parking and Business Improvement Area shall, upon its disestablillshment, be turned over to the new Parking and Business Improvement Area for partial funding of same. The new Parking and Business Improve- ment Area shall thereupon assume all debts and liabilities of the former Parking and Business Improvement Area; except for that debt for "free customer parking" in the amount of $29, 500 , for the calendar years 1987 and following, evidenced by the agreement dated December 12, 1984 , between the City of Redding and the Parking and Business Improvement Area Board. i -9- • • . BE IT FURTHER RESOLVED that the City Council intends to establish a Budget and Benefit Review Board, hereafter referred to as the "Review Board, " which shall be composed of: (1) a City Council member, (2) the City Manager, (3) the Director of Fi- nance, (4) a member of the Redding Redevelopment Agency appointed by the City Council to serve for a term of three (3) years, (5) (6) (7) a business person from Zone A, Zone B, and Zone C of the Parking and Business Improvement Area appointed by the City Council for staggered terms of three (3) years. The City Council member shall only vote whennecessary to break a tie. The City Council member shall have the option, at his or her discretion, to abstain from any vote. The purposes of the Review Board are to: review the budget and finances of the Parking and Business Improvement Area to ensure that assessments/charges are being collected and that expenditures are made for the benefit of the Parking and Business Improvement Area; to review the programs, events, and expendi- tures to ensure that benefits are fairly distributed between the benefit zones and the various businesses; to act as a liaison to the City Council to receive input from the administration of the Parking and Business Improvement Area, businesses, and the public; to review any requests for changes in assessments/charges and make recommendations to the City Council; to hear appeals as to the classification, number of employees, and zone assigned to any business for purposes of determining the amount of the assessment/charge; to prepare an annual report to 1the City Council reviewing the progress of the Parking and Business -10- , . . • • Improvement Area, its budget, the distribution of benefits, and ( planned expenditures and programs. The Review Board shall have authority to inspect the books and financial records of the Parking and Business Improvement Area at any time and to audit same. The Review Board shall act as an advisory body to the City Council and shall not have authority to direct or control the management of the Parking and Business Improvement Area. The Review Board shall receive staff support from the Finance Depart- ment for purposes of reviewing financial information and audits; otherwise, staff support shall be provided by the City Clerk' s office and the Planning Department. The Review Board shall hold public meetings no less than four (4) times per year at quarterly intervals. At each quarterly meeting the review board shall: (1) review a report from the Administrator (s) of the Parking and Business Improvement Area detailing the budget and financial condition of the Parking and Business Improvement Area, the progress of current programs, the plans for future programs or events , and any other informa- tion that the Review Board deems relevant to assessing the budget or benefits of the Parking and Business Improvement Area; (2) entertain written and oral communications from businesses and members of the public; (3) forward the report of the Parking and Business Improvement Area Administrator (s) to the City Council together with any recommendations or comments on the budget and benefits of the Parking and Business Improvement Area; and (4) conduct any other business consistent with the purposes of the Review Board. -11- • • BE IT FURTHER RESOLVED that the City Council proposes that the City Clerk' s office, the Planning Department and the Finance Department shall recover from the Parking and Business Improve- ment Area funds administrative charges for staff time, resources, and expenses directly incurred providing staff support to the Review Board, auditing financial information, and administering the levy and collection of assessments/charges. At the beginning of each budget year for the Parking and Business Improvement Area, prior to the expenditure of funds collected for such budget year, the administrative charge shall be estimated and the City Council shall approve a "not to exceed" limitation. After adoption of a "not to exceed" limitation for a budget year, it may only be modified by City Council action after a public hearing with ten (10) days notice by mail to the businesses in the Parking and Business Improvement Area. At the conclusion of the budget year for the Parking and Business Improvement Area, the City Council shall approve a reimbursement to the City Clerk' s office, the Planning Department and the Finance Depart- ment for actual administrative charges and expenses within the "not to exceed" limitation. BE IT FURTHER RESOLVED that the City Council proposes to exercise the sole discretion as to how the revenue from the assessments/charges of the proposed Parking and Business Improve- ment Area shall be used, within the scope of the purposes of the proposed Parking and Business Improvement Area as previously enumerated. However, the City Council shall be empowered, and in its discretion may enter a contract with a properly constituted -12- • nonprofit corporation for the purpose of administering programs, services , and events and distributing benefits in the Parking and Business Improvement Area.
