RESOLUTION NO. _ I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING A CHANGE IN THE CONTRACT BETWEEN THE CITY OF REDDING AND EA ENGINEERING, SCIENCE, AND TECHNOLOGY, INC. TO PROVIDE ADDITIONAL SERVICES ON THE LAKE REDDING PROJECT ENVIRONMENTAL IMPACT REVIEW, AND AUTHORIZING THE MAYOR TO SIGN SAME. 1 WHEREAS, on November 18 , 1975 , City Council awarded contracts to EA ENGINEERING, SCIENCE, AND TECHNOLOGY, INC. and CH2M HILL for the preparation of an. Environmental Impact Review I (EIR) on the Lake Redding Project; and WHEREAS, two significant issues were discussed in the public hearings regarding the EIR, namely the success of existing fish hatchery operations and the Project' s compliance with the Department of Fish and Game Code of the State of California; and WHEREAS, the California Environmental Quality Act (CEQA) requires that a discussion of these issues be included in the final EIR; and WHEREAS, the attached Letter Agreement between the City of Redding and EA ENGINEERING, SCIENCE, AND TECHNOLOGY, INC. dated July 14 , 1986 , sets forth the proposed changes in the scope of services to be provided. by EA ENGINEERING, SCIENCE, AND TECHNOLOGY, INC. , under its contract with the City, in ' order that it may conduct the necessary studies with respect to these issues; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows : c • • 1 . That the City Council of the City of Redding hereby approves the attached Letter Agreement dated July 14 , 1986 , between the City of Redding and the firm of EA ENGINEERING, SCIENCE, AND TECHNOLOGY, INC. for additional services under its contract with the City of Redding for the preparation of an Environmental Impact Review of the Lake Redding Project, in an amount not to exceed $35 , 215 . 00; and 2. That the Mayor of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid documents , when appropriate; and 3 . That a true copy of the Letter Agreement referred to herein is attached hereto and made a part hereof. Rick Coleman City of Redding Electric Department 760 Parkview Avenue Redding , California 96001 Dear Rick: In the course of conducting the agency consultations and authorized research for the Lake Redding Power Project Environmental Impact Report , (EIR) it has become apparent that the City of Redding would benefit from a more detailed examination of two specific areas than called for in the EIR statement of work. These two areas are : 1 . The current status of case law and legal opinion regarding California Department of Fish and Game code sections relating to sc:ceefliit � b , fish pds54e , and state protection of spawning areas , and . 2. Current thinking on hatchery management priactices and hatchery design throughout the Pacific coast .; This letter constitutes a proposal to conduct these additional studies which we believe will be of significant value in providing the Federal Energy Regulatory Commission with a broad perspective on these issues to the benefit of the Lake Redding Power Project . Task 1 : Code Compliance and Regulatory Issues The CDFG has emphasized the need for the EIR to address compliance with Fish and Game code sections gelating • to screening , fish passage , and state protection of spawning areas . Several agencies also have requested discussions specific to how the project is compatible with their stated policies or guidelines . Code issues similar to those for the Lake Redding Power Project are now being tested in the courts in relation to projects proposed by the City of Los Angeles . Ms. Jan Goldsmith an attorney with Kronick, Moskovitz, Tiedemann & Girard in Sacramento , is familiar with these issues and is participating in hearings scheduled for mid-July on the City of . I!os Angeles' projects . EA has discussed with Ms . Goldsmith , the City of Redding ' s need to review these same issues with respect to the BALTIMORE 0 CHICAGO 0 CINCINNATI D LINCOLN 0 NEW YORK 0 SAN FRANCISCO • • ^ EA ENGINEERING,;. This work would be completed most cost-effectively after the initialhearing date, and would take the form of a draft position paper and discussion ofi alternative scenarios for obtaining project approvals if strict interpretation of the code is not likely to be compatible with a viable project alternative. In the same timeframe , and with Ms. Goldsmith serving in an advisory role, EA would explore project compatibility with agency guidelines and policies. Results from both studies would be presented in proposed EIR Section 4.4.7. Sia Morhardt 4 days 2,080 Secretarial/staff support 2 days 400 Travel expenses , phone, copier 200 Estimated consultant expenses 100 Total for Task 1 $ 9,970 Task. 2 : Hatchery Operations and Problem Solving The acceptability to the agencies of hatchery production of salmon as part of the proposed project mitigation i.s becoming an increasingly important issue. In the agency responses to EIR scoping , USFWS has requested that the EIR address the success of other salmon hatcheries in meeting their production goals. The Coleman , Trinity , Iron Canyon , and Mad River hatcheries were mentioned in particular . Other agencies •stressed the need to demonstrate that hatchery operations would follow an acceptable . strategy and avoid problems that are now typical of hatchery production . - • • • { EA ENGINEERING, • �OASCIENCE, AND TECHNOLOGY, INC. Rick Coleman 14 July 1986 Page Three A fairly broad-based review of existing hatcheries is proposed to examine strategy, facilities, and management practices for the purpose of developing creative and well documented approaches to overcoming known and anticipated problems. It is important to carry this review beyond the boundaries of California, because hatchery strategies and approaches differ and ae actively researched in Oregon , Washington , and British Columbia . A review of programs in these areas will bring the needed diversity into the background information on approaches . Five to eight hatcheries should be selected from out of state, for inclusion in the operations studies , for a total of 10 to 15 site-specific reviews. Also , information addressing similar hatchery questions is being compiled by the Northwest Power Planning Council , Washington Department of Game, Washington Department of Fisheries , the USFWS Fisheries Assistance Office , and possibly others. Part of the proposed work is to glean whatever useful information is available from tnese and other agency and academic sources . Results of the hatchery studies will be presented as a separate report that will be summarized and cited in the EIR. EA proposes to conduct the study by assigning a salmonid biologist to the project essentially full-time for approximately 6 weeks, to visit hatcheries , conduct interviews, and assemble information . EA' s staff would work with 1 or 2 consultants from academia who have published and have established credentials relevant to the issues. Potential consultants include Dr . William 1Hershberger from the University of Washington , School of Fisheries , and Dr . Graham Gall from the University of California, Davis. , The expected costs of conducting hatcheries studies are as follows : Academic consultants 10 days $ 5,000 Dr .
