HomeMy WebLinkAboutReso. 1986 - 175 - Approving the lerre agreement between the city of redding and kadison pfaelzer woodard quinn & rossi for legal services . , . s .. ,• II I RESOLUTION NO. plc- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE LETTER AGREEMENT BETWEEN THE CITY OF REDDING AND KADISON, PFAELZER, WOODARD, QUINN & ROSSI FOR LEGAL SERVICES IN CONNECTION WITH REDDING HYDROELECTRIC MATTERS AT THE FEDERAL ENERGY REGULATORY COMMISSION, AND AUTHORIZING THE CITY MANAGER TO SIGN SAME. � BE IT RESOLVED by the City Council of the City of Redding as follows : 1 . That the City Council of the City of Redding hereby approves the attached Letter Agreement dated July 15 , 1986 , between the City of Redding and the firm of Kadison,' Pfaelzer, Woodard, Quinn & Rossi for further legal services in an amount not to exceed $25 , 000 . 00 ; and 2 . That the City Manager of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the .City Man ger and to impress the official seal of the City of Redding on th , aforesaid documents , when appropriate; and 3 . That a true copy of. the Letter Agreement deferred to herein is attached hereto and made a part hereof. Accordingly, I .am now forwarding to you this letter proposing that we renew our contract. The renewed contract would, again, be for $25, 000. I also propose that the scope of work include electric transmission and rate proceedings. Our work for Redding in this area was previously covered by sepa- • rate contract (Resolution No. 86-50) . Amounts authorized to be expended under that contract have, also, been exhausted The amount authorized in February has been expended, primarily, • . on the litigation at FERC over the Spring .Creek Pumped Storage Pro- ject. During the winter and spring of , 1986, we continued to oppose Iron Mountain Mines ' attempt to block the Spring Creek project by obtaining an exemption for a small hydroelectric project on Spring Creek. As you know, our litigation effort has proven to be •success- ful : Iron Mountain Mines' exemption application was rejected by the FERC and, on June 13 , 1986, Redding was ' issued . a preliminary permit for the Spring Creek project. • • Rick Coleman July 15, 1986 Page Two There are still some aspects of the Redding/Iron Mountain Mines litigation that remain to be completed, however. IMM has filed an appeal of the issuance of the preliminary permit to Red- ding, and we now are required to respond to that appeal . Also, we are still awaiting FERC action on IMM' s petition for rehearing of the Commission' s denial of IMM' s exemption application. j We are now entering the licensing phase of the Spring Creek proceeding. As you know, licensing proceedings tend to be more complex than preliminary permit proceedings. This is especially true of projects that are as large and that have as much regional significance as the Spring Creek Pumped Storage Project. Extension of our contract will enable us to continue work into the licensing phase of the Spring Creek project. Additionally, extension of the contract with the expanded scope that I have proposed will enable us to continue too represent Redding in transmission and electric rate proceedings. lAs Redding' s load growth continues, PG&E' s rates and conditions of service will have increasing importance for the City. PG&E' s service to the City is, of course, regulated by the FERC, and we represented the City in PG&E' s last FERC rate case under separate contract. An extended contract that encompasses both hydroelectric and electric rale work will enable us to become involved promptly in ny ne:: rate proceeding that may arise at the EERC. Under our renewed contract, Kadison will continue to perform services on an "as requested" basis for Redding, and Kadison will bill Redding on a month-to-month basis . Services will be provided until we reach the dollar limit in our new contract. Our monthly statements will continue to provide you with a completeldescription of all activities undertaken on each matter for each month, and they will continue to contain a complete itemization of all costs. The established relationship between Kadison and Redding is a source of pride to myself and the firm. We very much enjoy the opportunity to provide service to Redding, and we look forward to continuing our. relationship. As I mentioned during our. telephone conversation today, our firm opened a Northern California office in Palo Alto this week. Hopefully, that will allow us, in one way or another, to provide even better service to Redding.
