A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9. 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDDING, LOCATED AT 1540 DIVISION STREET (OWNERS: BLAKE M. BEVILLE AND EDITH S. BEVILL AS TRUSTEES UNDER THE BEVILL TRUST, UNDER A TRUST: DECLARATION DATED MAY 1 , 1975, AS TO AN UNDIVIDED 1/2 INTEREST; AND DIVISION STREET CO. , A LIMITED PARTNERSHIP, SAS TO AN UNDIVIDED 1/2 INTEREST) . WHEREAS, the provisions of Chapter 9. 36 of the Redding Municipal Code provide that all buildings or structures located within the City of Redding which are structurally unsafe or are dilapidated from old age, neglect, decay or other causes which constitute a fire menace or are dangerous to human life or a likely resort for vagrant or dissolute persons , may be declared a nuisance by the City Council of the City of Redding and there- after abated as provided therein; and WHEREAS, the Fire Marshal of the City of Redding has made an inspection of the building (s) located on the real property as hereinafter described and has declared them to be unsafe and/or a hazard to safety, health and public welfare; and WHEREAS, it has been determined that this matter is categor- ically exempt from the provisions of CEQA; NOW, THEREFORE, BE IT RESOLVED by the City Council of the 6-. 4 1 City of Redding that it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9. 36 of the Redding Municipal Code on the the real property situate in the City of Redding, County of Shasta, State of California, more particularly described in Exhibit "A" attached hereto and incorporated herein by reference, commonly known as 1540 Division Street. BE IT FURTHER RESOLVED that said building (s) mentioned hereinabove are hereby declared to be a public nuisance as provided by Chapter 9 . 36 of the Redding Municipal Code and are hereby ordered to be abated by repair, rehabilitation, demolition or removal. BE IT FURTHER RESOLVED that the Fire Marshal and the Board of Appeals of the City of Redding are hereby directed to take all proceedings provided in Chapter 9 . 36 of the Redding Municipal Code. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be and hereby is authorized and directed to forward a certified copy of this Resolution to the Shasta County Recorder for recordation. PARCEL 2: BEGINNING at the Southwest corner of Block 5, as shown on the map of the Original Town cf Redding, recorded Eptember 25, 1872 in .nook of Old Plats at page 65; thence, along the Southerly line of said Block 5; thence North 726.20' East 150.00 feet to the Southeast corner of Lot 5 of said Block 5; South 17'40' East 10.50 feet; thence, parallel with said Southerly line, South 72°20' West 150.00 feed; thence, North 17°40' vest 10.50 feet to the true point of beginning.
