A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE REVENUE SHARING AGREEMENT WITH THE FRIENDS OF
SHASTA COUNTY LIBRARIES, AND AUTHORIZING THE MAYOR TO SIGN.
BE IT RESOLVED by the City Council of the City of Redding as
follows :
1 . That the City Council of the City of Redding hereby
approves the attached Revenue Sharing Agreement between the City
of Redding and the Friends of Shasta County Libraries; and
2. That the Mayor of the City of Redding is hereby
authorized and directed to sign all necessary documents on behalf
of the City of Redding, and the City Clerk is hereby authorized
and directed to attest the signature of the Mayor and to impress
the official seal of the City of Redding on the aforesaid
documents, when appropriate; and
3. That a true copy of the Revenue Sharing Agreement
referred to herein is attached hereto and made a part hereof.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of

REVENUE SHARING FUNDING AGREEMENT
FRIENDS OF SHASTA COUNTY LIBRARIES
THIS AGREEMENT made and entered into this day of
, 1986 , by and between the CITY OF REDDING, a Municipal
Corporation and General Law City, hereinafter referred to as
"CITY, " and the FRIENDS OF SHASTA COUNTY LIBRARIES , a Non-profit
Organization, hereinafter referred to as "LIBRARIES. "
WITNESSET H:
WHEREAS, CITY, as a General Law City and Municipal
Corporation of the State of California, has the power and
authority to render financial assistance for the education of its .
citizens; and
WHEREAS, LIBRARIES is a non-profit organization formulated
to support the Shasta County .Libraries system; and
WHEREAS, LIBRARIES is better equipped and staffed to render
assistance to the Shasta County Libraries system than is CITY;
NOW, THEREFORE, IT IS HEREBY AGREED by and between the
parties hereto as follows:
1 . The above recitals are true and correct.
2. CITY shall pay to LIBRARIES the sum of Nine Thousand
Dollars ($9 , 000 . 00) in consideration of LIBRARIES using said
funds for the capital-outlay purpose set forth in •Ex'hibit "A"
attached hereto and incorporated herein by reference, with the
approval of CITY, for the period commencing September 1 , 1985 ,
and terminating August 31 , 1986. Payment of said funds will be

made in accordance with a schedule established by the Finance
Director of CITY, and upon submission to CITY of proper invoices
to be approved by said Finance Director, with provision being
made for any monies which may have already been paid to
LIBRARIES. Nothing herein shall be construed as a promise or
indication whatsoever of the availability of future funding by
CITY for LIBRARIES.
3 . During the term of this Agreement, LIBRARIES shall
continue to render assistance to the Shasta County Libraries
system pursuant to State and Federal laws applicable thereto.
4 . Unless otherwise approved, funds paid hereunder shall
be deposited in a Redding bank, with fiscal control as approved
by the Finance Director of CITY. All funds paid hereunder shall
be used within two (2) years after the date hereof.
5. Upon ten (10) days ' notice, LIBRARIES covenants and
agrees to provide td CITY all of its books and records of account
showing its sources of income and all of its expenditures and
costs of operation.
6. No portion of the funds herein provided by CITY to
LIBRARIES shall be used for any purpose other than that agreed to
herein.
. 7 . No provision herein shall conflict with or override any
Federal or State statutes and regulations which control the
operations of LIBRARIES.
8. In providing its services , LIBRARIES shall act as an
independent contractor, and no officer or employee of LIBRARIES

will be deemed a CITY officer or employee for any purpose.
9 . LIBRARIES shall comply with the prevailing wage
provisions of the Davis-Bacon Act on any project costing in
excess of $2 , 000 . 00 when 25% or more of the costs of such project
are paid with revenue-sharing funds .
10. LIBRARIES shall pay individuals employed in jobs
financed in whole or in part with revenue-sharing funds not less
than the prevailing rates of pay for such jobs. This provision
does not apply to an employee or employees in any program
category who are being paid in whole or in part with general
revenue-sharing funds unless 25% or more of the total wages paid
to all employees in that category are paid from revenue-sharing
funds.
11 . LIBRARIES shall not discriminate against any person on
the grounds of race, color, national origin, age, sex or
religion, or against an otherwise qualified handicapped
individual .
12 . LIBRARIES shall maintain Workers ' Compensation
insurance, as well as public liability insurance in amounts as
follows:
$100 , 000 . 00 per person and $300 , 000 . 00 per occurrence for
public liability; and
$50, 000 . 00 for property damage.
Prior to payment by CITY of any funds , LIBRARIES shall provide to
the City Clerk of CITY a Certificate evidencing the existence of
such insurance during the term of this Agreement.

13. In the event LIBRARIES violates the provisions of this
Agreement for any reason other than the occurrence of circum-
stances over which it can exercise no effective control, and such
violation shall not be cured or remedied within sixty (60) days
after notice thereof by CITY, in addition to any other remedies
provided for in this Agreement, CITY shall have the right to
terminate this Agreement by written notice duly served upon
LIBRARIES.
IN WITNESS WHEREOF, the parties hereto have executed this .
