HomeMy WebLinkAboutReso. 1986 - 037 - Approving the letter agreement between the city of redding and kadison pfaelzer woodard quinn & rossi for legal services II/ 111 a RESOLUTION NO. 2t 3 J II A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE LETTER AGREEMENT BETWEEN THE CITY OF REDDING AND KADISON, PFAELZER, WOODARD, QUINN & ROSSI FOR LEGAL SERVICES, AND AUTHORIZING THE CITY MANAGER TO SIGN SAME. BE IT RESOLVED by the City Council of the City of Redding as follows: 1 . That the City Council of the City of Redding hereby approves the attached Letter Agreement between the City of Redding and the firm of Kadison, Pfaelzer, Woodard, Quinn & Rossi for legal services in an amount not to exceed $25 , 000 . 00; and 2 . That the City Manager of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the City Manager and to impress the official seal of the City of Redding on the aforesaid documents, when appropriate; and 3 . That a true copy of the Letter Agreement,._referred to herein is attached hereto and made a part hereof. FILE NURSER: - Rick Coleman City of Redding • 760 Parkview Avenue Redding, California 96001 Re: Renewal of Contract for Legal Services Dear Rick: As we have discussed, we have now exhausted the $25, 000 which was authorized by the Redding City Council on July 1, 1985. for . legal services to be provided by Kadison, Pfaelzer, Woodard,� Quinn & Rossi ( "Kadison" ) on Washington hydroelectric matters.!I Accord- ingly, I am now forwarding to you this letter proposing Ithat we renew our contract. The renewed contract would be for $125, 000 and would permit us to continue the hydroelectric-related mattersrin which we are involved in Washington. The amount authorized on July 1, 1985 has been expended on activities relating, primarily, to the Lake Redding Project and o the Spring Creek Pumped Storage Project. In the third quarter of 1985, we expended a considerable amount of time getting legislation • introduced in the U. S. Senate and the House of Representatives to permit the U. S. Bureau of Reclamation to enter into an agreement that would permit Redding to proceed with its proposed L kake Red- o ding Power Project. As you know, while we had good progress in that we managed to have our bills introduced, we became stalled in the fourth quarter of 1985 when it became apparent that there was considerable political sentiment for delaying action on our pro- posed legislation until the FERC completes its environmental impact study for the Lake Redding Project. While it nowlappears it will not be possible to go forward with the legislation until • the study is completed, we have laid the groundwork for moving 411' Rick Coleman January 29, 1986 Page 2 ahead with the proposed legislation when we obtain a positive environmental impact report from the FERC. The activity that has consumed even more of our time during the fall and winter of 1985 has been the Spring Creek Pumped Stor- age Project. Redding has continued to face oppositionllfrom Iron Mountain Mines to either a preliminary permit or a license which would allow Redding to develop a project that would encompass the site that Iron Mountain Mines proposes to use for a small hydro- electric project. Currently, our efforts continue to be focused on obtaining FERC rejection of Iron Mountain Mines' exemption application for its proposed project. As you know, rejection of . Iron Mountain Mines' application would, potentially, open the way for Redding to obtain a preliminary permit which wouldqencompass not only the area on Spring Creek below the IMM project but would encompass the IMM site as well. In my view, the approach adopted on July 1, 1985, 1i . e. , hav- ing a set dollar amount to be used on hydroelectric matters, gives us more flexibility than we had under the "purchase order" approach we used for the three years prior to July 1, 1985 . We propose that we continue to operate as at present. Thus, Kadison will continue to perform services as required by Redding, and Kadison will bill Redding on a month-to-month basis for services rendered during the previous month. The services that will be tendered wily continue to be those that are related to hydroelectric matters, including both matters at the FERC and before Congress. Servicesilwillbe provided to Redding on a "as requested" basis until we reach the dollar limit reached in the new contract as approved byllthe City Council. Our monthly statements will continue to provide you with a complete description of all activities undertaken on each matter for each month, and they will continue to contain a complete item- ization of all costs. The established relationship between Kadison and Redding is a source of pride to myself and the firm.. We very much enjoy the opportunity to provide service to Redding, and we look forward to continuing our relationship.
