S4--,..1.3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AN EXTENSION AND MODIFICATION OF THE CONTRACT BETWEEN THE CITY OF REDDING AND KEN SCHWARTZ FOR THE PLACEMENT OF BUS BENCHES ALONG THE ROUTES OF THE REDDING AREA BUS AUTHORITY BUSES , AND AUTHORIZING THE MAYOR TO SIGN SAME. BE IT RESOLVED by the City Council of the City of Redding as follows : 1 . The City Council of the City of Redding hereby approves the Extension and Modification of the existing Agreement between the City of Redding and Ken Schwartz for the placement of bus benches along the routes of the Redding Area Bus Authority. 2. The Mayor of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid documents, when appropriate. 3 . A true copy of the Extension and Modification of Agreement referred to herein is attached hereto and made a part hereof. HAYS, ity Attorney -2- 411 • • EXTENSION AND MODIFICATION OF AGREEMENT THIS AGREEMENT entered intoby and between the CITY OF REDDING and KEN SCHWARTZ as of the 3nt day of TyielLAzzat,iC 1986, as follows: RECITALS WHEREAS, by Contract dated February 18, 1982, LARRY RAY agreed to install, pursuant to that document, bus benches along. the routes for Redding Area Bus Authority buses; and WHEREAS, by Agreement dated September 19, 1982, the benefits and obligations of that Contract between the CITY OF REDDING and LARRY RAY were assigned to and assumed by KEN SCHWARTZ; and WHEREAS, the term of the Contract was due to Il expire on January 18 , 1986, and has continued on a day-to-day basis from that date, and the parties hereto desire to affirm and ratify the uninterrupted extension of the Contract for a period of four (4) years; and WHEREAS, the parties hereto desire to make several substantive modifications in the Contract; NOW, THEREFORE, the parties hereto affirm and agee to the following extension and modifications of the subject Contract: 1 . The term of the Contract is extended from January 18, 1986 , for a period of four (4) years, to termination on January 17, 1990, subject to review and renewal as provided in the Contract. 411 • t 2. A minimum of five (5) additional bus benches shall be placed on the recently-approved Route 8 to the Central Valley Area. It is understood that a majority of this route is outside City limits , and the City is currently reviewing the development of an agreement with Shasta County for the placement of these benches. 3. The fee payable to the City of Redding per bull bench is hereby increased by five percent (5%) , rounded to the nearest cent, effective January 19, 1986. The fee shall be increased annually on January 19 of each year, by five percent (5%) (compound interest) , rounded to the nearest cent. 4 . All future contracts entered into by Ken Schwartz for advertising, and renewals of existing contracts for advertising, shall be restricted so as to specifically exclude thelfollowing types of advertising messages: (a) Advertisement of alcoholic beverages; (b) Advertisement of cigarettes or cigars; (c) Political messages in support of candidates, propositions , or other matters; (d) Religious messages; (e) Personal messages; (f) Pornography. 5. It is understood that Ken Schwartz desires to place additional bus benches along the routes inside the City of Redding. The City will approve the placement of additional bus benches in a manner which best promotes the public convenience -2- :... ..- , III 1 : . . 1 and necessity, while reserving the right to refuse permission for placement of benches at any new locations.
