HomeMy WebLinkAboutReso. 1987 - 321 - Requesting the local agency formation commission to take proceedings for the annexation to the city of redding I • RESOLUTION NO.57,41/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF APPLICATION BY THE CITY OF REDDING REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE ANNEXATION TO THE CITY OF REDDING OF UNINHABITED TERRITORY DESIGNATED CITY OF REDDING ANNEXATION NO. 85-9 (FIG TREE LANE). BE IT RESOLVED by the City Council of the City of Redding asilfollows: WHEREAS, the City of Redding desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the annexation to the City of Redding of the uninhabited territory designated City of Redding Annexation No. 85-9 (Fig Tree Lane); and WHEREAS, the territory proposed to be annexed is uninhabited and a description of the boundaries of the territory is set forth in Exhibit "A" and depicted in Exhibit "B" attached hereto and by this reference incorporated 1 herein; and WHEREAS, this proposal is consistent with the sphere of influence of the City of Redding; and WHEREAS, it is desired to provide that the proposed annexation be subject it to the following terms and conditions: 1. Property Owner shall meet conditions of Annexation Agreement dated October 20, 1987; and 2. If the Local Agency Formation Commission includes O'ig Tree Lane right-of-way in this annexation, it is required that annexation of the abutting property owned by the City of Redding on the south side of Fig Tree Lane be included in this annexation. WHEREAS, the reasons for this proposed annexation are as filllows: The advantage to property owners within this territory of the avail- ability of certain City services; and N4 - 1 - UJ tNJ it � i • WHEREAS, a plan for providing services within the affected territory is set forth in Exhibit "C" attached hereto and incorporated herein by reference, as required by Government Code Section 56653; NOW, THEREFORE, this resolution is hereby adopted and approved by the City Council of the City of Redding, and the Local Agency Formation Commission of Shasta County is hereby requested to take proceedings for the annexation of territory as described in Exhibit "A," according to the terms aid conditions stated above and in the manner provided by the Cortese-Knox Local Government Reorganization Act of 1985. BE IT FURTHER RESOLVED that the City Clerk of the City oif Redding is authorized and directed to file a certified copy of this resolution, along with appropriate fees, with the Executive Officer of the local Agency Formation Commission of Shasta County. Lines will be extended by property owners, in accordance with the Master Water Plan through an ! assessment district when they want service. Sewer - Within the Regional Sewer Service boundary, sewer service will be provided by the City in' accordance with adopted policies, standards, an'd charges . Sewer lines will be extended by property owners . Solid Waste - Solid-waste collection will be provided, to exist- ing residents after five years as per State law or when the existing collector chooses to discontinue service. New customers will be serviced by the City, and all residents may use the City landfill. Streets - Existing streets shown on the County Road Log will be maintained by the City only to the extent they are presently improved. New dedicated public streets will be constructed according to City standards and maintained by the City accordingly. At the time of development of the property, all adjoining streets will be improved by the owner to City standards, and all necessary right-of-way will be dedicated. Police and Fire - Upon annexation, police and fire services will be available to the area. Development 41 occur in a manner to maintain the City' s fire rating. Electric - It is the policy of the City of Redding to be the sole provider of electric service to electric utility customers within the corporate limits . City electric service will be made available when electric facilities can be purchased or made otherwise provided to the owners in accordance with adopted policies, standards, and charges of the City of Redding and based on logical extension of the City' s electric distribution system. Storm Drainage - Natural drainage ditches will be maintained by the property owner through whose property the drain or stream passes . • • PROPERTY TAX EXCHANGE AGREEMENT BETWEEN THE CITY OF REDDING (City) AND THE COUNTY OF SHASTA ('County) FOR ANNEXATION NO. 85-9 (Fig Tree Lane, Uninhabited) WHEREAS, subparagraph (b) of Section 99 of the Revenue and Taxation Code requires the County and the City Council to agree to the exchange of property tax revenues with respect to property annexed to the City after July 24, 1979, and WHEREAS, the City of Redding proposes to annex to the City certain uninhabited territory commonly known and described as Annexation No. 85-9, Fig Tree Lane (the Area) ; NOW, THEREFORE, the parties agree as follows: 1 . For the annexation listed above, the property tax, both secured and unsecured, shall be distributed as follows (a) Base year tax - the base year tax as defined in Revenue and Taxation Code Section 98( f) shall continue to be distributed in the same manner as in the fiscal year previous to annexation. (b) Annual tax increment - that portion of the tax as defined in Revenue and Taxation Code section 97(b) resulting from increases in assessed valuation over the � base year valuations shall be distributed to the City of Redding in an amount sufficient to insure that the annexed property earns the same percentage of total tax as was earned by other property in the City immediately prior to annexation. (c) Upon annexation, taxes previously distributed to any special district which, after annexation will no longer render services to the territory annexed, will be first distributed to the City to insure the City will receive the same percentage of the total tax earned by other property in the City immediately prior to annexation. 2 . This annexation, to be recorded by the end of the calendar year (December 31) , shall be entitled to distribution of property taxes from and after the first day of the next succeed- ing fiscal year (July 1 ) . - 1 - ' II • • 3 . That the County Auditor shall be notified of this agreement pursuant to subparagraph (b) of Section 99 of the above referenced Code. 4 .
