HomeMy WebLinkAboutReso. 1987 - 311 - Declaring its intention to vacate surplus street right of way adjacent to property located at 5275 caterpillar road M M RESOLUTION NO. 77-1// A RESOLUTION OF THE CITY COUNCIL OF THE CITY SOF REDDING DECLARING ITS INTENTION TO VACATE SURPLUS STREET RIGHT-OF- WAY ADJACENT TO PROPERTY LOCATED AT 5275 CATERPILLAR ROAD (A-7-87) . WHEREAS, certain real property, namely a street right-of-way described in Exhibit "B" attached hereto and incorporated herein by reference, has been heretofore reserved on property located adjacent to 5275 Caterpillar Road, in the City of Redding, as the same is set forth on a map and/or plan on file in the office of the City Clerk of the City of Redding, being more particularly described in the maps attached hereto and incorporated herein by reference; and WHEREAS , it is believed by and it appears to, the City Council of the City of Redding that the surplus street right-of- way adjacent to property located. at 5275 Caterpillar Road, as shown on the attached maps, is not necessary, subject to the conditions set forth below; and WHEREAS, the Director of Public Works of the Citylof Redding has duly investigated the proposed abandonment of said surplus street right-of-way adjacent to the property located at 5275 Caterpillar Road, and has advised the City Council that there is no indication that it will ever be required, subject to the conditions set forth below; and i' � CbJ N. WHEREAS , the Planning Commission of the City of Redding has held a public hearing regarding the abandonment of sand surplus street right-of-way, and at the conclusion of said hearing has recommended that the surplus street right-of-way adjacent to property located at 5275 Caterpillar Road be abandoned, subject to the following conditions : ii 1 . Necessary easements shall be granted to Pacific Gas and Electric Company for its existing overhead and I'. underground facilities. 2 . The adjacent property owner shall dedicate right-of-way for a 60-foot-radius corner rounding at the intersection of Twin View Boulevard and Caterpillar Road, as depicted on Exhibit "A" attached hereto and incorporated herein by reference. 3 . At the time of development of the adjacent property, the property owner shall construct vertical curb, gutter and sidewalk, and install the necessary aggregate base and asphalt concrete surfacing between the gutter and the travelled lane for the length of the frontage along both Caterpillar Road and . Twin View Boulevard. 4 . The property owner shall dedicate access rights along Twin View Boulevard and the Southerly 30 feet of Caterpillar Road to the City of Redding. -2- M OH AND WHEREAS , the City Council of the City of Redding elects to proceed in this matter under the provisions of the Public Streets , Highways and Service Easements Vacation Law a!s the same J is set forth in Section 8300 , et seq. , of the Streets and Highways Code of the State of California, with the provision that this Resolution shall be deemed a Resolution of Intention; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows: A. That all of the foregoing recitals ares' true and correct. B. That the City Council intends to and hereby declares its intention to vacate and abandon the surplus street right-of- way adjacent to property located at 5275 Caterpillar Road, as described above and shown on the attached maps, subject to the following conditions: 1 1 . Necessary easements shall be granted to Pacific Gas and Electric Company for its existing overhead and underground facilities. 2 . The adjacent property owner shall dedicate right-of-way for a 60-foot-radius corner rounding at the intersection of Twin View Boulevard and Caterpillar Road, as depicted on Exhibit "A" attached ,hereto and incorporated herein by reference. 3 . BE IT FURTHER RESOLVED that all persons interested in or objecting to the proposed abandonment will be heard on Tuesday, November 17 , 1987 , at the hour of 7 : 00 p.m. , or as soon thereafter as the matter may be heard, in the City Council Chambers and Police Department Building located at 1313 California Street, Redding, California. BE IT FURTHER RESOLVED that the Director of Public Works of the City of Redding be and hereby is instructed to post or cause to be conspicuously posted, at points not more than 300 feet apart in distance and along the line of property now proposed to be abandoned, notices of this intention to vacate and abandon said surplus street right-of-way. Said notices shall set forth the passage of this Resolution of Intention and shall, set forth the time and place of hearing as hereinabove set forth' At least three (3) such notices shall be posted in the manner set forth above, and posting of said notices shall be complete not less than fifteen (15) days prior to the date of the hearing. ij -4- M N BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this Resolution of Intention and shall cause the same to be published once in a ne,lspaper of general circulation in the City of Redding at least fifteen (15) days before the date set for public hearing of prote'tts to the aforesaid proposed vacation. 'S•-,• ?- i.:% ,'''1, 7! • . - ..,• 1 EXHIBIT "B" A-7-87 Commencing at that certain monument shown as being 165 feet left of Interstate 5 Engineers Station 170+00 as shown on that certain map recorded in Book 44 of Land Surveys at page 116 , Shasta County Records, said Monument lying on the Westerly Right-of-Way line of Interstate 5 ; thence on and along said Right-of-Way line S. 05°12 ' 21" E. , 26 . 02 feet to the point of beginning; thence running the following bearings and distances: Leaving said Right-of-Way line from a tangent which bears S. 6°00 ' 34" W. on a 282 . 00 foot radius curve to jithe right, through a central angle of 23°07 ' 55" a distance 113 . 85 feet, thence S. 29°08 ' 29" W. , 455 . 80 feet; thence on a 60 foot radius curve to the left through a central angle of 73°31 ' 17" ila distance of 76 . 99 feet to a point on the Easterly Right-of-Way line of the State Highway as shown on that certain Map of Keen Subdivision recorded in Book 5 of Maps at page 42 , Shasta County Records; thence on and along said Right-of-Way N. 29°08 ' 29" 1E. , 81 . 25 feet; thence continuing on said Right-of-Way on a 5074 . 39 foot radius curve to the left through a central angle of 5°25 ' 43" a distance of 480 . 78 feet to a point on the above-mentioned Right-of-Way line; thence on and along said Right-otf-Way line N. 5°12 ' 21" W. , 76 .05 feet to the point of beginning; The above shown distances are based on California Coordinate System Zone 1 ; divide distances shown by 0 . 99987907' to obtain ground level distances. 1 1 1 1
