A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
FINDING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN REAL PROPERTY INTERESTS FOR PUBLIC
IMPROVEMENTS, NAMELY THE CONSTTRUCTION AND MAINTENANCE OF THE
CANBY RELIEF SEWER PROJECT, THE OWNERS OF WHICH ARE ROBERT
D. STRANTZ and DOLORES L. STRANTZ.
BE IT RESOLVED by the City Council of the City of Redding as
follows:
Section 1 . The City Council of the City of Redding finds
and determines that public convenience and necessity require the
extension by the City of Redding of public improvements, to wit,
the construction and maintenance of the Canby Relief Sewer
Project, and that Government Code Section 37350 . 5 authorizes the
City to acquire the necessary real property interests for said
public improvements by eminent domain.
Section 2. The City Council finds and determinels that the
subject project has been planned and is to be located in the
manner that will be most compatible with the greatest public good
and the least private injury.
Section 3 . In compliance with CEQA requirementsl, the City
Council ratified the Negative Declaration for this Project on
August 4 , 1986, finding that there is no significane impact on
the environment.
Section 4 . The City Council also finds and determines that
the acquisition of the property interests depicted in Exhibit "A"
attached hereto, situate in the City of Redding, County of
Shasta, State of California, are necessary for the construction
and maintenance of the aforesaid public improvements , and that
the taking of said property interests is necessary therefor.
Section 5 . The City Attorney of the City of Redding is
hereby authorized, empowered and directed to perform as follows:

a. Commence an action or actions in eminent domain in the
Superior Court of the State of California, County of
Shasta, in the name of the City of Redding to acquire
the necessary property interests.
b. To incur in the name of the City of Redding, and on
behalf thereof, all obligations and expenses! necessary
to acquire the above-mentioned property interests.
Section 6. The City Clerk of the City of Redding is hereby
directed to cause a certified copy of this ResolutJion to be
recorded in the office of the Shasta County Recorder.
I HEREBY CERTIFY that the forgoing Resolution was
adjourned
introduced and read at a regular /meeting of the City ii ouncil of
the City of Redding on the 29th day of September , 1987, and was
duly adopted at said meeting by a four-fifths vote as follows :

All that real property situate in the State of California, County
of Shasta , City of Redding, described as follows:
The North 15 ' of the following-described parcel:
All that portion of the Southeast Quarter of the Southwest
Quarter of Section 5 , Township 31 North, Range 4 West, M.D.M. ,
described as follows:
COMMENCING at the South Quarter corner of said Section 5; thence
North 89°18 ' 37" West, 498. 67 feet to the point of beginning of
this Parcel; thence North 00°28 ' 47" East, 301 . 69 feet along the
East line of West Half of the West Half of the East! Half of the
Southeast Quarter of the Southwest Quarter of said Section 5;
thence North 89°18 ' 37" West, 166. 20 feet; thence South 00°29 '
West, 301 . 69 feet; thence South 89°18 ' 37" East, 166 . 23 feet to
the point of beginning of this description.
EXCEPTING THEREFROM that portion described in the !Deed to the
County of Shasta recorded October 4 , 1974 , in Book 1242 of
Official Records at page 476 .

TOGETHER WITH a 30 ' wide temporary construction easement
described as follows : The South 30 ' of the North! 45 ' of the
above-described parcel.
Said temporary construction easement shall terminate upon
issuance of a "Notice of Completion" of the Sewer Prloect by the
City of Redding Department of Public Works .
