A RESOLUTION OF THE CITY COUNCIL OF THE CITYIIOF REDDING
APPROVING AN AGREEMENT FOR SURVEY SERVICES BETWEEN THE CITY
OF REDDING AND HOBBS , HUBBARD AND ASSOCIATES, INC. , AND
AUTHORIZING THE MAYOR TO SIGN SAME.
BE IT RESOLVED by the City Council of the City ofliRedding as
follows :
1 . That the City Council of the City of Redding hereby
approves the attached Agreement for Survey Services between the
City of Redding and Hobbs, Hubbard and Associates , Inc . , which
provides for survey services as required in connection with the
design of a new sewer line in the Clover Creek area; and
2 . That the Mayor of the City of Redding , is hereby
authorized and directed to sign all necessary documents on behalf
of the City of Redding, and the City Clerk is hereby'
authorized
and directed to attest the signature of the Mayor and ' to impress
the official seal of the City of Redding on the aforesaid
Agreement, when appropriate.
3 . That a true copy of said Agreement is attached hereto
and incorporated herein by reference.

AGREEMENT FOR SURVEY SERVICES
THIS AGREEMENT entered into this day of September,
1987 , by and between the CITY OF REDDING, a Municipal Corporation
and General Law City of the State of California, thereinafter
referred to as "City, " and HOBBS, HUBBARD AND ASSOCIATES, INC. ,
a California corporation engaged in civil engineering in Shasta
County, California, hereinafter referred to as "Consultant. "
WITNESSETH:
WHEREAS, City is involved in the design of a new, sewer line
in the Clover Creek area in the City of Redding; and
WHEREAS, City desires to engage Consultant to provide survey

services to City as required in connection with said design;
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
1 . Scope of Services: Consultant shall perform survey
services as outlined in the attached General Provisions and
Special Provisions, which are hereby made a part of this
Agreement and as modified herein.
To further clarify the responsibilities of Consultant under
the General Provisions section entitled "Work to be performed by
Consultant, " the following modifications to that section shall be
incorporated into this Agreement:
a. Under Item 2 concerning property corners and lines, the
intent of this paragraph is that Consultant shall

provide all field work to tie in existing property

corner monuments within a reasonable distance of the
control line, and that City shall be resppnsible for
calculating the precise location of property corners
and lines.
b. Under Item 6 concerning the furnishing of ifield books
and computer program data, the field books shall be
furnished as noted, with the exception', that the
locating of topographic features shall not be required;
a data collector unit acceptable to the City shall be
used to record all topographic data; and the data
furnished to the City shall be in a form that can be
utilized by the City' s computer plotting equipment.

c. Under Item 7 concerning the removal and of
brush, where City is required to remove and dispose of
brush as a condition of a right-of-entry to any parti-
cular property, Consultant shall have said brush or
tree limbs removed and disposed of. Said work shall be
considered as extra work to the contract tolbe paid on
a labor-and-material basis plus 15% overhead. On all
other properties Consultant shall not be required to
remove and dispose of brush or tree limbs that are cut
along the route of the survey.
2 . Representative of Agency. The Director of Public Works
of City shall be the duly authorized representative of the City
concerning the performance of the work of this project :
3 . Time of Performance. The services of Consultant shall

commence upon the execution of this Agreement and receipt from
City of written notice to proceed.

The work of this project shall be diligently prosecuted to
completion within a period not to exceed sixty (60) calendar days
from and after the date of commencement. Consultantl shall have
valid insurance certificates for general liability and workers'
compensation insurance for the project in amounts mileting City
requirements on file with the City prior to beginning work on
this project, which certificates shall name the City Of Redding,
its officers, agents, and employees as additional insureds, and
which shall guarantee City at least ten (10) days' wr4tten notice
prior to any cancellation or reduction in Consultant' s insurance

coverage. City may grant time extensions based upon written
requests from Consultant for weather-related delaysjl or delays
occasioned by factors beyond the control of Consultant in the
field work of this project, but Consultant shall not be entitled
to damages or additional payment due to such delays.
4 . Compensation and Methods of Payment.
a. Compensation. Consultant shall be compensated as noted
in the section of the General Provision',s entitled
"Payment. " Compensation shall not exceed Fifty
Thousand Dollars ($50 ,000.00) except that additional
compensation may be paid as set forth in paragraph (c)
below.

b. Method of Payment. Consultant shall submit! a billing
to City by the last Friday of each month indicating the
percentage of work completed to that point in time.

City shall review said billing and make a determination
of the percentage of work completed. City shall then
authorize payment to Consultant of the completed work
based upon its determination of the percentage of work
completed.
c. Additive and Deductive Items. Consultant may be
required by City to determine the location � of certain
property corners shown as existing on record maps but

found to be missing or moved in the field;. In such
case, Consultant shall be compensated at , the rates
shown on the attached Rate Schedule labeled Exhibit "A"
and which shall be incorporated into thisAgreement.
City reserves the right to waive the determination of a
property corner location that is found to be missing in
the field as noted above.
5 . Cancellation. This Agreement may be terminated by
either party, for any reason, upon sixty (60) days' written
notice to the other.
6 . Indemnification. Consultant agrees to ; indemnify,
defend, and hold City, its officers, agents, and employees
harmless against any claims, injuries, or damages arising from
the performance of this Agreement by Consultant.
7 . California Environmental Quality Act. It, has been
determined that this matter is not subject to the provisions of
CEQA.

CONTRACT FOR PROFESSIONAL SERVICES
PART I - General Provisions
SCOPE OF WORK
This project involves the establishment of a Preliminary Survey
Control Line basically along the route of Clover Creek and Airport
Road from the Dorsch Road area north to the Old Alturas Road area.
The proposed route is generally outlined on the attached map,
entitled "Stillwater Regional Waste Water System" and detailed on
the attached route maps entitled "Clover Creek Preliminary Survey
Control Line" , sheets 1-26. Also attached as an informational item
are copies of those Shasta County Assessor's Maps that relate to
parcels that are either adjacent to or along the route of the survey.
The length of the survey route is approximately 80,000 feet. The
intent of this contract is to create sufficient sury@y data to
generate plan/profile drawings for construction of a,lnew sewer line
along the route of the survey. II
DEFINITION OF TERMS
1 . Contract documents : The contract documents shall consist of the
request for proposal, proposal , agreement, route maps nusbered
one to twenty-six , general provisions , special provisions, and
any addenda.

2. City , City of Redding, and Engineer: The terms "City", "City of
Redding" , and "Engineer" shall refer to the Director of Public
Works , City of Redding, and those designated to represent the
Director of Public Works for the work of this specific project.

3. Consultant: The individual, firs, partnership, orlcorporation
which submitted a proposal for the work contemplated, acting
directly or through a duly authorized representative.
4. City Council : Refers to the officer or body constituting the
awarding authority of the City of Redding, a General Law City ,
existing under and by virtue of the laws of the State of
California.
WORK TO BE PERFORMED BY CONSULTANT
The Consultant shall furnish all necessary equipment, tools,
materials , and labor as required to perform the following work:
1 . Establish a preliminary survey control line as shown on the
attached routing maps and as directed by the Engineer.
Station 0+00 will be located at Point P-1 as shown on sheet
1 •
1 of the route saps and the control line willproceed north
from there. The survey line shall be stationed at least every
100 feet and at all angle points with either s, hub and tack
for unpaved areas or a PK nail and shinner in paved or highly
compacted areas. All points shall be •arked either with paint
on pavement or a 1 x 2 guard stake with lath and flagging in
other areas.
2. Consultant shall be responsible for identifying property
corners and lines from recorded maps and surveys as required
to establish offset distances to the preliminary survey
control line. The proposal submitted by the Consultant shall
discuss the method of determining property corners and lines
• which have not been previously located in thefield to
include approximate costs for said work.
3. Consultant shall establish ground elevations along each
survey line as shown on the routing maps. The basis for
elevations shall be the centerline survey monuments on
Airport Road as noted in the section entilted "Basis for
bearings and elevations" . Elevations shall be taken at least
every 50 feet along the survey lines and at any other point
where the grade changes abruptly, such as a drainage ditch or
the toe of an embankment.
4. Consultant shall locate any large permanent objects, such as
buildings or trees larger than 6-inches in diameter at the
base, or that fall within 20 feel. each side off the survey
line. These objects shall be noted in the field books with
the appropiate offsets from the stationed survey line,
identification of the object and a sketch of `the location
relative to the survey line. The accuracy of the offset
measurement shall be within 0.10 feet. Consultant will be
• required to perform additional locating work beyond the 20
feet limit from Point P-56 to Point P-59 as shown on routing
map sheet 24. In this particular area, Consultant shall
locate all fences and buildings within 30 feet of each side
of the centerline of Clover Creek together with the general
shape of the creek bed.
5. Consultant shall be authorized to move the preliminary survey
line five (5) feet on either side of the indicated survey
route without prior approval from the Engineer. Any deviation
from the indicated survey route shall be documented in the
field books. Movement of the survey line morel then five (5)
feet shall be approved by the City prior to setting the line
in the field. The intent of this section is to establish
the preliminary survey line as close to the intended route
as possible without damaging existing structures, trees,
fences or landscape.
6. Furnish to the City standard field books (Orange K and E
No. 82-0002) indicating the data created by the survey work.
The data shall be clearly marked in the books such that a
person with minimal drafting experience could graphically

reconstruct the surveys solely from the notes and sketches
in the book. All notes shall be placed on the left side
pages of the book and all sketches shall be pl !ced on the
right side pages of the book . All angles shall be doubled and
noted as such in the books. Each page shall be numbered and
the front page of the book shall be indexed fore the informa-
tion within the book. Each book shall be labeled "Clover
Creek Preliminary Survey and all data shall be f reduced to
ground elevations. In addition to supplying the standard
field books, the Consultant shall be required o furnish said
data on a floppy disk which is compatible withhCogo programs
designed by Concap, or data for a Geodimeter Geodat 126
E.F.R. survey software.
7. Consultant shall be responsible for removing and disposing of
brush and tree limbs which are cut or removed as a part of
this contract. Consultant shall hold City harmless from
liability and damage resulting from the survey work of this
contract. Consultant shall be responsible for any damage to
private property resulting from the contract survey work .
City shall be responsible for notifying the owners of
those properties over which Consultant will peform the
survey work . In the event that City notifies the Consultant
that any one or more properties along the survey route can
not be entered onto, Consultant shall then be entitled to
negotiate extra work to this contract to circu®vent the
problem areas.

8. Consultant shall establish temporary bench marks at approxi-
mately 1000 feet on center along the route of the preliminary
survey control line. The bench marks shall be either a spike
in a power pole or a tree, or a permanent concrete monumen i.
per ASCE Standards.
SURVEY METHODS
The surveys shall be performed under the direct supervision of a
licensed land surveyor or a registered civil engineer. The Consultant
shall furnish and utilize surveying equipment of sufficient accuracy
to meet second order accuracy as defined by ASCE. The City shall have
the right to reject any of the work performed by the Consultant that
does not meet the intent of this contract, does not meet the accuracy
requirement as noted above, or has been performed by personnel that
the City deems to be not qualified to perform such work. In such
event, the Consultant shall immediately remedy the particular problem
at no additional cost to the City.
The Consultant shall furnish all flagmen, barricades, iigns, flags
and other equipment as necessary to maintain proper traffic control
for survey work performed on or near public streets or highways. The
Consultant shall obtain any necessary permits, licenses or related
documents for the proper performance of the work of this project.

BASIS FOR BEARINGS AND ELEVATIONS
The County of Shasta Public Works Department created alcenterline
survey along Airport Road in 1980 from the Dersch Roadarea
north to State Highway 44. The various monuments set by that survey
have been tied to the State Coordinate System and the USCSGS bench
elevations, and certain specific points shall be used as base control
for the preliminary survey line. Consultant shall tie into specific
monuments from that centerline survey as follows:
1 . Tie Point P-5 to monument marked "AC 9" on Airport Road
south of Fig Tree Lane.
2. Tie Point P-14 to monument marked "AC 17" on Airport Road
just north of Meadow View Drive.
3. Tie Point P-23 to monument marked "AC 22" on Airport Road
at the entrance road to the old Airport Terminal building.
4. Tie Point P-27 to monument marked "AC 40" on Airport Road
at Lupine Drive.
5. Tie Point P-29 to monument marked "AC 45" on Airport Road
at the extension of Argyle Road. �I
In addition to the ties noted above, Consultant shall also create
closed traverses as follows to establish the accuracy of the
preliminary survey line:
1 . Tie Point P-40 on Rancho Road just east of GooIwater to Point
P-26 on Rancho Road at Airport Road.
2. Tie Point P-51 on Hartnell west of Goodwater t�l Point P-31
on the north side of Highway 44.
The centerline monuments on Airport Road shall be used to establish
the coordinates and elevations of angle points for the preliminary
survey control line. The data for the survey on Airport Road by
Shasta County is available for review by Consultant.
PAYMENT
Payment for the work of this project shall be made on a monthly basis
= depending on the percentage of work completed each month. The
Consultant shall submit a written estimate and description of the
work completed for each month. The City shall determine the percent-
age of completion based on the following guidelines:
1 . Thirty percent 430%) of the contract amount for completion of
the preliminary survey control line and the setting of all
angle points.

2. Thirty percent (30%) of the contract amount for, the
completion of all profile elevations along the survey route
and such topographic work as noted in these specifications
or shown on the route maps.
8. Thirty percent (8011) of the contract amount for submittal of
the completed survey field books and related data.
4. Ten percent (10%) of the contract amount after jthe survey
data has been verified as total and complete.
QUALIFICATIONS OF CONSULTANT
Consultant shall meet the following basic requirements to be considered
for the work of this project:
1. All work shall be done by the Consultant's firs and no portion
shall be done by subcontract.
2. The managing employee of the Consultant shall have not less
than ten (10) years of recent experience in responsible charge
of engineering work of the type involved in this project. He
shall be licensed as a Civil Engineer in the Stiate of California.
3. The member in charge of all field control operations must have at
least five (5) years experience in projects of this type and
magnitude, and shall be either licensed as a Land Surveyor or
a Civil Engineer in the State of California.
In addition, Consultant shall submit the name, address, phone number and
contact person for previously completed jobs that are comparable in size
and scope to this project.
INSURANCE
The successful firm will be required to show proof of insurance in a
form acceptable to the City Attorney covering the City it's officers,
agents and employees from property damage in the sum of $100,000 per
person and $250,000 aggregate, bodily injury in the sum of $300,000
per person. $500,000 per occurance, and $500,000 aggregate completed
products. or $1 ,000,000 combined single limit. Such coverage shall
include the use of automobiles.
PREVAILING WAGE RATE
The Consultant shall be required to pay the latest prevailing wage rate
as determined by the State of California, Director of Industrial
Relations, for the classification of field surveyor. Contract costs shall
reflect these pay rates. The Consultant shall be responsible for obtain-
ing the latest wage rate determination from the State ®f California.

CONTRACT FOR PROFESSIONAL SERVICES
Part II - Special Provisions
Termination of Contract for Cause
If, an through cause, the consultant shall fail to fulfill in a timely

and proper canner his obligations under this contract, orffl the
consultant shall violate any of the covenants, agreements or
stipulations of this contract, the City shall thereupon have the right
to terminate this contract by giving written notice to the consultant of
such termination and specifying the effective date of succi termination.
In such event, all finished or unfinished documents, data studies,
surveys, drawings, maps, models, photographs, and reports *epared by
the consultant under this contract shall, at the option of the City,
become its property and the consultant shall be entitled to receive just
and equitable compensation for any work satisfactorily completed
hereunder.
t;otwithstanding the above, the consultant shall not be relieved of
liability to the City for damages sustained by the City by virtue of any
breach of the contract by the consultant, and the City may withhold any
payments to the consultant for the purpose of set-off until such time as
the exact ar.iount of damages due the City from the consultant is
determined.
Termination for Convenience of the City
The City may terminate this contract at any time by giving at least ten
(10) days notice in writing to the consultant. If the contract is
terminated by the City as provided herein, the consultant will be paid
for the time provided and expenses incurred up to the termination date.
If this contract is terminated due to the fault of the consultant,
Paragraph 1 hereof relative to termination shall apply.

Changes,
The City may, from time to time, request changes in the scope of the
services of the consultant to be performed hereunder. Such changes.
including any increase or decrease in the amount of the consultant's
compensation, which are mutually agreed upon by and between the City and
the consultant, shall be incorporated in written amendments to this
contract.
Personnel
•
1. The consultant represents that he has, or will secure at his own
expense. all personnel required in performing the services under

this contract. Such personnel shall not be employees; of or have
any contractual relationship with the City. I,
2. All of the servicesrequired hereunder will be performed by the
consultant or under his supervision and all personnell engaged in
the work shall be fully qualified and shall be authorized or
permitted under State and local law to perform such services.

subcontracted without the prior written approval of the City. Any
work or services subcontracted hereunder shall be specified by
written contract or agreement and shall be subject to each
provision of. this contract. 1
Assignability
The consultant shall not assign any interest on this contract, and shall
not transfer any interest in the same, (whether by assignment or
novation) , without the prior written consent of the City thereto;
provided, however, that claims for money by the consultant from the City
under this contract may be assigned to a bank, trust company, or other
financial institution without such approval . Written notice of any such
assignment or transfer shall be furnished promptly to the City.
Reports and Information
The consultant, at such times and in such forms as the City may require.
shall furnish the City such periodic reports as it may request
pertaining to the work or services undertaken pursuant tolthis contract,
the costs and obligations incurred or to be incurred in connection there
with, and any other matters covered by this contract.
Records and Audits
The consultant shall maintain accounts and records, including personnel ,
property, and financial records, adequate to identify and account for
all costs pertaining to the contract and such other records as may be
deemed necessary by the City to assure proper accounting for all project
funds. These records will be made available for audit
pur oses to the
City or any authorized representative, and will be retained for three
years after the expiration of this contract unless permission to destroy
them is granted by the City.
Findings Confidential ,I
All of the reports, information, data, etc., prepared or assembled by
the consultant under this contract are confidential and the consultant
• agrees that they shall not be made available to any individual or
organization without the prior written approval of the City.

No report, raps, or other documents produced in whole or to part under
this contract shall be the subject of an application for copyright by or
on behalf of the consultant.
Compliance with local Laws
The consultant shall comply with all applicable laws, ordinances, and
codes of the State and local governments. and the consultant shall save
the City harmless with respect to any damages arising from any tort done
in performing any of the work embraced by this contract.
