HomeMy WebLinkAboutReso 2022-063 - Resolution For Exception To The 180-Day Wait Period And Interim Appointment Of Retiree Angela Udovich RESOLUTIQN NO. 2022-063 June 21,2Q22 RESOLUTION FtJR EXCEPTIQN TO THE 180-DAY WAIT PERIOD AND INTERIM APPOINTMENT OF RETIREE ANGELA UDOVIC�I GC sections 7522.56 & 21221{h} WHEREAS, in compliance with Government Code section 7522.Sb the Redding City CQuncil must provide Ca1PERS this certification resolutic�n when hiring a retiree before I80 days has passed since his or her retirement date; and �i'HEREAS, Angela Udovich, Ca1PERS ID 79b24'78236, retires from the City of Redding in the position of Safety Specialist in the Public Works Z�epartment effective July 1, 2Q22; and WHEREAS, section 7522.56 requires that post-retirement employment commence no ear�ier than 1$0 days after the retirement date, which is December 28, 2022, without this certification resolutic�n; and WHEREAS, sectian 7522Sb provides that this exception to the 180-day wait period shall nat apply if the retiree accepts any retirement-related incentive; and WHEREAS, the Redding City Council, the City of Redding and Angela Udovich certify that Ange�a Udovich has not and wi11 not receive a Golden Handshake or any other retirement-related incentive; and WHEREAS, the I�edding City Council hereby appoints Angela Udovich as an interim appointment retired annuitant ta the vacant position t�f Safety Specialist for the City of Redding under Government Gode section 21221(h), effective Ju�y 11, 2022; and WHEREAS, an appaintment under Government Code section 21221{h) requires an active publicly posted recruitment far a permanent replacement; and W�-TEREAS,the eurrent status of this recruitment is in proeess and is anticipated to be complete by the end of November 2022; and V4JHEREAS, this section 21221{h) appc�intment sha�l only be made once and therefore wi�1 end na later than March 11, 2023; and WHEREAS, the entire employment agreement, contraet or appointment document between Angela Udovich and the City af Redding has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or eonditions related to this employment and appointment have been ar will be placed on a consent calendar; and � � WHEREAS,the employment shall be limited to 960 hours per�scal year; and � � � � �, � WHEREAS, the campensatian paid to retirees cannat be less than the minimum nor exceed the maXimum manthly base salary paid to other employees perfarming comparable duties, divided by 173333 to equal the hourly rate; and WHEREAS, the maximum monthly base salary for this pasitifln will be $7,589 and the hourly equivalent is $43.'78, and the minimum monthly base salary for this position is $5,394 and the hc�urly equivalent is $31.12; and �VHEREAS,the hourly rate paid to Angela Udavich wi11 be $43.78; and WHEREAS, Angela Udovich has not and witl not receive any ather benefit, incentive, compensatifln in lieu of benefit ar other form of compensation in addition to this hourly pay rate; TIIEREFQRE,BE IT RESOLVED THAT the Redding City Council hereby certifies the nature of the appointment of Angela Udavich as described herein and that this appointment is necessary to fill a critieally needed role of Safety Specialist for the City of Redding during recruitment for a permanent appointment. Ms. Udovich wi11 manage the safety,training and regulatory compiiance program for the Public Works Department,maintain the Department's cammercial driver database, maintain the new hire training program, and assist with regulatory inspections. Ms. Udavich's title wi11 be Safety Specialist during her employment as a retired annuitant.
