The meeting was called to order by Mayor Gard with the following Council
Members present: Demsher, Fulton, Kirkpatrick, Pugh, and Gard
Also present were City Manager Courtney, City Attorney Hays, Electric
Director Lindley, Housing and Redevelopment Administrator Henson, City
Clerk Nichols, and Minute Clerk Rupp.
RESOLUTION - re Arbitration Agreement Between NCPA and PGandE
City Attorney Hays advised that the City of Redding has expressed several
concerns regarding an Interconnection Agreement between the Northern
California Power Agency and the Pacific Gas and Electric Company. He
stated that other agencies involved have also recognized these concerns,
and at least two other cities have withdrawn or rescinded their support of
the original agreement. Mr. Hays explained that Sections 2A and 2B of the
proposed resolution relate to the specific concerns of the City of Redding.
He recommended Council ' s adoption of the resolution as the City' s condi •

tional approval of the Arbitration Agreement.
Councilman Pugh stated that fortunately, the City has had the staff
capabilities to realize and point out to many other people, the
inadequacies of some sections of the Interconnection Agreement. He said
that negotiations have been under way for years to reach an agreement,
without resolution as to how it would be structured and the costs which
would be involved.
111111 Mr. Pugh advised that since the Shell 2 Power Plant is about to come on
line, PGandE has taken the posture that they did not have to file any
agreement until they felt all parties agreed. He said that because of this
posture, NCPA filed a violation against PGandE and a hearing was held with
the N.R.C. It was determined that PGandE would be found in violation of
their Diablo license if they did not agree to negotiate and file an agree-
ment addressing NCPA's needs with regard to Shell 2. PGandE then recom-
mended binding arbitration which was accepted by the NCPA management. Mr.
Pugh said that arbitration proceedings were conducted and the City tried to j
point out problem areas to the members of NCPA. He feels that by adopting 1
this proposed resolution, the City' s interests would be protected.
Mayor Gard asked how one can have conditional acceptance of binding
arbitration. Councilman Pugh stated that the arbitrator has agreed that
the six paragraphs of the agreement indicated in Section 1 of the
resolution, will be subject to arbitration; however, there are a number of
other paragraphs that are unclear and have not yet been submitted to the
arbitrator.
MOTION: Made by Councilman Demsher, seconded by Councilman Kirkpatrick
that Resolution No. 83-22 be adopted, a resolution of the City Council of
the City of Redding ratifying, approving and authorizing the execution of
an Arbitration Agreement by and between the Northern California Power
Agency and Pacific Gas and Electric Company, subject to conditions
subsequent.
Voting was as follows:
Ayes: Council Members - Demsher, Fulton, Kirkpatrick, Pugh, and Gard
Noes: Council Members - None

There being no further business, at the hour of 12:15 P.M. , Mayor Gard
declared the meeting adjourned.
